    دستور المملكة المغربية

    الباب الأول

    أحكام عامة ، المبادئ الأساسية






    تصديـــر
    المملكة المغربية دولة إسلامية ذات سيادة كاملة، لغتها الرسمية هي اللغة العربية، وهي جزء من المغرب العربي الكبير.

    وبصفتها دولة إفريقية، فإنها تجعل من بين أهدافها تحقيق الوحدة الإفريقية.

    وإدراكا منها لضرورة إدراج عملها في إطار المنظمات الدولية، فإن المملكة المغربية، العضو العامل النشيط في هذه المنظمات، تتعهد بالتزام ما تقتضيه مواثيقها من مبادئ وحقوق وواجبات وتؤكد تشبثها بحقوق الإنسان كما هي متعارف عليها عالميا.

    كما تؤكد عزمها على مواصلة العمل للمحافظة على السلام والأمن في العالم.



    أحكــام عامــة

    المبــادئ الأساسية



    الفصل الأول

    نظام الحكم بالمغرب نظام ملكية دستورية ديمقراطية واجتماعية.



    الفصل الثاني



    السيادة للأمة تمارسها مباشرة بالاستفتاء وبصفة غير مباشرة بواسطة المؤسسات الدستورية.



    الفصل الثالث

    الأحزاب السياسية والمنظمات النقابية والجماعات المحلية والغرف المهنية تساهم في تنظيم المواطنين وتمثيلهم.

    ونظام الحزب الوحيد نظام غير مشروع.



    الفصل الرابع

    القانون هو أسمى تعبير عن إرادة الأمة، ويجب على الجميع الامتثال له، وليس للقانون أثر رجعي.



    الفصل الخامس

    جميع المغاربة سواء أمام القانون.



    الفصل السادس

    الإسلام دين الدولة، والدولة تضمن لكل واحد حرية ممارسة شؤونه الدينية.



    الفصل السابع

    علم المملكة هو اللواء الأحمر الذي يتوسطه نجم أخضر خماسي الفروع.

    شعار المملكة : الله، الوطن، الملك.



    الفصل الثامن

    الرجل والمرأة متساويان في التمتع بالحقوق السياسية.

    لكل مواطن ذكرا كان أو أنثى الحق في أن يكون ناخبا إذا كان بالغا سن الرشد ومتمتعا بحقوقه المدنية والسياسية.



    الفصل التاسع

    يضمن الدستور لجميع المواطنين :

    -حرية التجول وحرية الاستقرار بجميع أرجاء المملكة؛

    -حرية الرأي وحرية التعبير بجميع أشكاله وحرية الاجتماع؛

    -حرية تأسيس الجمعيات وحرية الانخراط في أية منظمة نقابية وسياسية حسب اختيارهم.

    ولا يمكن أن يوضع حد لممارسة هذه الحريات إلا بمقتضى القانون.



    الفصل العاشر

    لا يلقى القبض على أحد ولا يعتقل ولا يعاقب إلا في الأحوال وحسب الإجراءات المنصوص عليها في القانون.

    المنـزل لا تنتهك حرمته ولا تفتيش ولا تحقيق إلا طبق الشروط والإجراءات المنصوص عليها في القانون.



    الفصل الحادي عشر

    لا تنتهك سرية المراسلات.



    الفصل الثاني عشر

    يمكن جميع المواطنين أن يتقلدوا الوظائف والمناصب العمومية وهم سواء فيما يرجع للشروط المطلوبة لنيلها.



    الفصل الثالث عشر

    التربية والشغل حق للمواطنين على السواء.



    الفصل الرابع عشر

    حق الإضراب مضمون.

    وسيبين قانون تنظيمي الشروط والإجراءات التي يمكن معها ممارسة هذا الحق.



    الفصل الخامس عشر

    حق الملكية وحرية المبادرة الخاصة مضمونان.

    للقانون أن يحد من مداهما وممارستهما إذا دعت إلى ذلك ضرورة النمو الاقتصادي والاجتماعي للبلاد.

    ولا يمكن نزع الملكية إلا في الأحوال وحسب الإجراءات المنصوص عليها في القانون.



    الفصل السادس عشر

    على المواطنين جميعهم أن يساهموا في الدفاع عن الوطن.



    الفصل السابع عشر

    على الجميع أن يتحمل، كل على قدر استطاعته، التكاليف العمومية التي للقانون وحده الصلاحية لإحداثها وتوزيعها حسب الإجراءات المنصوص عليها في هذا الدستور.



    الفصل الثامن عشر

    على الجميع أن يتحملوا متضامنين التكاليف الناتجة عن الكوارث التي تصيب البلاد.

    الملكية


    الفصل التاسع عشر

    الملك أمير المؤمنين والممثل الأسمى للأمة ورمز وحدتها وضامن دوام الدولة واستمرارها، وهو حامي حمى الدين والساهر على احترام الدستور، وله صيانة حقوق وحريات المواطنين والجماعات والهيئات وهو الضامن لاستقلال البلاد وحوزة المملكة في دائرة حدودها الحقة.



    الفصل العشرون

    إن عرش المغرب وحقوقه الدستورية تنتقل بالوراثة إلى الولد الذكر الأكبر سنا من ذرية جلالة الملك الحسن الثاني، ثم إلى ابنه الأكبر سنا وهكذا ما تعاقبوا، ما عدا إذا عين الملك قيد حياته خلفا له ولدا آخر من أبنائه غير الولد الأكبر سنا، فإن لم يكن ولد ذكر من ذرية الملك فالملك .ينتقل إلى أقرب أقربائه من جهة الذكور ثم إلى ابنه طبق الترتيب والشروط السابقة الذكر.



    الفصل الحادي والعشرون

    يعتبر الملك غير بالغ سن الرشد قبل نهاية السنة السادسة عشرة من عمره، وإلى أن يبلغ سن الرشد يمارس مجلس الوصاية اختصاصات العرش وحقوقه الدستورية باستثناء ما يتعلق منها بمراجعة الدستور، ويعمل مجلس الوصاية كهيئة استشارية بجانب الملك حتى يدرك تمام السنة العشرين من عمره.

    يرأس مجلس الوصاية الرئيس الأول للمجلس الأعلى ويتركب، بالإضافة إلى رئيسه، من رئيس مجلس النواب ورئيس مجلس المستشارين ورئيس المجلس العلمي الإقليمي لمدينتي الرباط .وسلا وعشر شخصيات يعينهم الملك بمحض اختياره.

    قواعد سير مجلس الوصاية تحدد بقانون تنظيم .



    الفصل الثاني والعشرون

    للملك قائمة مدني.



    الفصل الثالث والعشرون

    شخص الملك مقدس لا تنتهك حرمته.



    الفصل الرابع والعشرون

    يعين الملك الوزير الأول.

    ويعبن باقي أعضاء الحكومة باقتراح من الوزير الأول.

    وله أن يعفيهم من مهامهم.

    ويعفي الحكومة بمبادرة منه أو بناء على استقالتها.



    الفصل الخامس والعشرون

    يرأس الملك المجلس الوزاري.



    الفصل السادس والعشرون

    يصدر الملك الأمر بتنفيذ القانون خلال الثلاثين يوما التالية لإحالته إلى الحكومة بعد تمام الموافقة عليه.



    الفصل السابع والعشرون

    للملك حق حل مجلسي البرلمان أو أحدهما بظهير شريف طبق الشروط المبينة في الفصلين 71 و 73 من الباب الخامس.



    الفصل الثامن والعشرون

    للملك أن يخاطب الأمة والبرلمان ويتلى خطابه أمام كلا المجلسين، ولا يمكن أن يكون مضمونه موضوع أي نقاش.



    الفصل التاسع والعشرون

    يمارس الملك بمقتضى ظهائر السلطات المخولة له صراحة بنص الدستور.

    الظهائر الشريفة توقع بالعطف من لدن الوزير الأول ما عدا الظهائر المنصوص عليها في الفصول 21 (الفقرة الثانية) و24 (الفقرات الأولى والثالثة والرابعة) و35 و69 و71 و79 و84 و91 و105.



    الفصل الثلاثون

    الملك هو القائد الأعلى للقوات المسلحة الملكية.

    وله حق التعيين في الوظائف المدنية والعسكرية كما له أن يفوض لغيره ممارسة هذا الحق.



    الفصل الحادي والثلاثون

    يعتمد الملك السفراء لدى الدول الأجنبية والمنظمات الدولية، ولديه يعتمد السفراء وممثلو المنظمات الدولية.

    يوقع الملك المعاهدات ويصادق عليها غير أنه لا يصادق على المعاهدات التي تترتب عليها تكاليف تلزم مالية الدولة إلا بعد الموافقة عليها بقانون.

    تقع المصادقة على المعاهدات التي يمكن أن تكون غير متفقة مع نصوص الدستور باتباع المسطرة المنصوص عليها فيما يرجع لتعديله.



    الفصل الثاني والثلاثون

    يرأس الملك المجلس الأعلى للقضاء والمجلس الأعلى للتعليم والمجلس الأعلى للإنعاش الوطني والتخطيط.



    الفصل الثالث والثلاثون

    يعين الملك القضاة طبق الشروط المنصوص عليها في الفصل 84.



    الفصل الرابع والثلاثون

    يمارس الملك حق العفو.



    الفصل الخامس والثلاثون

    إذا كانت حوزة التراب الوطني مهددة أو وقع من الأحداث ما من شأنه أن يمس بسير المؤسسات الدستورية، يمكن الملك أن يعلن حالة الاستثناء بظهير شريف بعد استشارة رئيس مجلس النواب ورئيس مجلس المستشارين ورئيس المجلس الدستوري وتوجيه خطاب إلى الأمة؛ ويخول بذلك، على الرغم من جميع النصوص المخالفة، صلاحية اتخاذ جميع الإجراءات التي يفرضها الدفاع عن حوزة الوطن ويقتضيها رجوع المؤسسات الدستورية إلى سيرها العادي أو يتطلبها تسيير شؤون الدولة.

    لا يترتب على حالة الاستثناء حل البرلمان.

    ترفع حالة الاستثناء باتخاذ الإجراءات الشكلية المقررة لإعلانها.
    البرلمان

    تنظيم البرلمان



    الفصل السادس والثلاثون

    يتكون البرلمان من مجلسين، مجلس النواب ومجلس المستشارين، ويستمد أعضاؤه نيابتهم من الأمة وحقهم في التصويت حق شخصي لا يمكن تفويضه.



    الفصل السابع والثلاثون

    ينتخب أعضاء مجلس النواب بالاقتراع العام المباشر لمدة خمس سنوات؛ وتنتهي عضويتهم عند افتتاح دورة أكتوبر من السنة الخامسة التي تلي انتخاب المجلس.

    ويبين قانون تنظيمي عدد أعضاء مجلس النواب ونظام انتخابهم وشروط القابلية للانتخاب وأحوال التنافي ونظام المنازعات الانتخابية.

    وينتخب رئيس مجلس النواب أولا في مستهل الفترة النيابية ثم في دورة أبريل للسنة الثالثة من هذه الفترة، وذلك لما تبقى منها.

    وينتخب أعضاء مكتب المجلس لمدة سنة على أساس التمثيل النسبي لكل فريق.



    الفصل الثامن والثلاثون

    يتكون ثلاثة أخماس مجلس المستشارين من أعضاء تنتخبهم في كل جهة من جهات المملكة هيئة ناخبة تتألف من ممثلي الجماعات المحلية، ويتكون خمساه الباقيان من أعضاء تنتخبهم أيضا في كل جهة هيئات ناخبة تتألف من المنتخبين في الغرف المهنية وأعضاء تنتخبهم على الصعيد الوطني هيئة ناخبة تتألف من ممثلي المأجورين.

    ينتخب أعضاء مجلس المستشارين لمدة تسع سنوات، ويتجدد ثلث المجلس كل ثلاث سنوات، وتعين بالقرعة المقاعد التي تكون محل التجديدين الأول والثاني، ويحدد بقانون تنظيمي عدد أعضاء مجلس المستشارين ونظام انتخابهم وعدد الأعضاء الذين تنتخبهم كل هيئة ناخبة وتوزيع المقاعد على مختلف جهات المملكة وشروط القابلية للانتخاب وحالات التنافي وطريقة إجراء القرعة المشار إليها أعلاه وتنظيم المنازعات الانتخابية.

    ينتخب رئيس مجلس المستشارين وأعضاء مكتبه في مستهل دورة أكتوبر عند كل تجديد لثلث المجلس، ويكون انتخاب أعضاء المكتب على أساس التمثيل النسبي لكل فريق.

    عند تنصيب مجلس المستشارين لأول مرة أو بعد حل المجلس الذي سبقه ينتخب رئيسه وأعضاء مكتبه في أول دورة تلي انتخاب المجلس ثم يجدد انتخاب الرئيس وأعضاء المكتب في مستهل دورة أكتوبر عند تجديد ثلث المجلس.



    الفصل التاسع والثلاثون

    لا يمكن متابعة أي عضو من أعضاء البرلمان ولا البحث عنه ولا إلقاء القبض عليه ولا اعتقاله ولا محاكمته بمناسبة إبدائه لرأي أو قيامه بتصويت خلال مزاولته لمهامه ما عدا إذا كان الرأي المعبر عنه يجادل في النظام الملكي أو الدين الإسلامي أو يتضمن ما يخل بالاحترام الواجب للملك.

    ولا يمكن في أثناء دورات البرلمان متابعة أي عضو من أعضائه ولا إلقاء القبض عليه من أجل جناية أو جنحة غير ما سبقت الإشارة إليه في الفقرة الأولى من هذا الفصل إلا بإذن من المجلس الذي ينتمي إليه ما لم يكن العضو في حالة تلبس بالجريمة.

    ولا يمكن خارج مدة دورات البرلمان إلقاء القبض على أي عضو من أعضائه إلا بإذن من مكتب المجلس الذي هو عضو فيه ما عدا في حالة التلبس بالجريمة أو متابعة مأذون فيها أو صدور حكم نهائي بالعقاب.

    يوقف اعتقال عضو من أعضاء البرلمان أو متابعته إذا صدر طلب بذلك من المجلس الذي هو عضو فيه ما عدا في حالة التلبس بالجريمة أو متابعة مأذون فيها أو صدور حكم نهائي بالعقاب.



    الفصل الأربعون

    يعقد البرلمان جلساته في أثناء دورتين في السنة، ويرأس الملك افتتاح الدورة الأولى التي تبتدئ يوم الجمعة الثانية من شهر أكتوبر وتفتتح الدورة الثانية يوم الجمعة الثانية من شهر أبريل.

    إذا استمرت جلسات البرلمان ثلاثة أشهر على الأقل في كل دورة جاز ختم الدورة بمقتضى مرسوم.



    الفصل الحادي والأربعون

    يمكن جمع البرلمان في دورة استثنائية إما بطلب من الأغلبية المطلقة لأعضاء أحد المجلسين وإما بمرسوم.

    تعقد دورة البرلمان الاستثنائية على أساس جدول أعمال محدد، وعندما تتم المناقشة في المسائل التي يتضمنها جدول الأعمال تختم الدورة بمرسوم.



    الفصل الثاني والأربعون

    للوزراء أن يحضروا جلسات كلا المجلسين واجتماعات لجانهما؛ ويمكنهم أن يستعينوا بمندوبين يعينونهم لهذا الغرض.

    علاوة على اللجان الدائمة المشار إليها في الفقرة السابقة يجوز أن تشكل بمبادرة من الملك أو بطلب من أغلبية أعضاء أي من المجلسين لجان نيابية لتقصي الحقائق يناط بها جمع المعلومات المتعلقة بوقائع معينة وإطلاع المجلس الذي شكلها على النتائج التي تنتهي إليها أعمالها، ولا يجوز تكوين لجان لتقصي الحقائق في وقائع تكون موضوع متابعات قضائية ما دامت هذه المتابعات جارية؛ وتنتهي مهمة كل لجنة لتقصي الحقائق سبق تكوينها فور فتح تحقيق قضائي في الوقائع التي اقتضت تشكيلها.

    لجان تقصي الحقائق مؤقتة بطبيعتها وتنتهي مهمتها بإيداع تقريرها.

    يحدد قانون تنظيمي طريقة تسيير لجان تقصي الحقائق.



    الفصل الثالث والأربعون

    جلسات مجلسي البرلمان عمومية، وينشر محضر المناقشات برمته بالجريدة الرسمية.

    ولكل من المجلسين أن يعقد اجتماعات سرية بطلب من الوزير الأول أو بطلب من ثلث أعضائه.



    الفصل الرابع والأربعون

    يضع كل من المجلسين نظامه الداخلي ويقره بالتصويت، ولكن لا يجوز العمل به إلا بعد أن يصرح المجلس الدستوري بمطابقته لأحكام هذا الدستور.



    سلط البرلمان



    الفصل الخامس والأربعون

    يصدر القانون عن البرلمان بالتصويت.

    وللقانون أن يأذن للحكومة أن تتخذ في ظرف من الزمن محدود ولغاية معينة بمقتضى مراسيم تدابير يختص القانون عادة باتخاذها ويجري العمل بهذه المراسيم بمجرد نشرها، غير أنه يجب عرضها على البرلمان بقصد المصادقة عند انتهاء الأجل الذي يحدده قانون الإذن بإصدارها، ويبطل قانون الإذن إذا ما وقع حل مجلسي البرلمان أو أحدهما.



    الفصل السادس والأربعون

    يختص القانون بالإضافة إلى المواد المسندة إليه صراحة بفصول أخرى من الدستور بالتشريع في الميادين الآتية :

    -الحقوق الفردية والجماعية المنصوص عليها في الباب الأول من هذا الدستور؛

    -تحديد الجرائم والعقوبات الجارية عليها والمسطرة الجنائية والمسطرة المدنية وإحداث أصناف جديدة من المحاكم؛

    -النظام الأساسي للقضاة؛

    -النظام الأساسي للوظيفة العمومية؛

    -الضمانات الأساسية الممنوحة للموظفين المدنيين والعسكريين؛

    -النظام الانتخابي لمجالس الجماعات المحلية؛

    -نظام الالتزامات المدنية والتجارية؛

    -إحداث المؤسسات العمومية؛

    -تأميم المنشآت ونقلها من القطاع العام إلى القطاع الخاص.

    للبرلمان صلاحية التصويت على قوانين تضع إطارا للأهداف الأساسية لنشاط الدولة في المبادين الاقتصادية والاجتماعية والثقافية.



    الفصل السابع والأربعون

    إن المواد الأخرى التي لا يشملها اختصاص القانون يختص بها المجال التنظيمي.



    الفصل الثامن والأربعون

    النصوص التشريعية من حيث الشكل يمكن تغييرها بمرسوم بعد موافقة المجلس الدستوري إذا كان مضمونها يدخل في مجال من المجالات التي تمارس فيها السلطة التنظيمية اختصاصها.



    الفصل التاسع والأربعون

    يمكن الإعلان عن حالة الحصار لمدة ثلاثين يوما بمقتضى ظهير شريف، ولا يمكن تمديد أجل الثلاثين يوما إلا بالقانون.



    الفصل الخمسون

    يصدر قانون المالية عن البرلمان بالتصويت طبق شروط ينص عليها قانون تنظيمي.

    يصوت البرلمان مرة واحدة على نفقات التجهيز التي يتطلبها إنجاز مخطط التنمية، وذلك عندما يوافق على المخطط، ويستمر مفعول الموافقة تلقائيا على النفقات طوال مدة المخطط، وللحكومة وحدها الصلاحية لتقديم مشاريع قوانين ترمي إلى تغيير البرنامج الموافق عليه كما ذكر.

    إذا لم يتم في نهاية السنة المالية التصويت على قانون المالية أو صدور الأمر بتنفيذه بسبب إحالته إلى المجلس الدستوري تطبيقا للفصل 81، فإن الحكومة تفتح بمرسوم الاعتمادات اللازمة لسير المرافق العمومية والقيام بالمهام المنوطة بها على أساس ما هو مقترح بالميزانية المعروضة بقصد الموافقة.

    ويسترسل العمل في هذه الحالة باستخلاص المداخيل طبقا للمقتضيات التشريعية والتنظيمية الجارية عليها باستثناء المداخيل المقترح إلغاؤها في مشروع قانون المالية، أما المداخيل التي ينص المشروع المذكور على تخفيض مقدارها فتستخلص على أساس المقدار الجديد المقترح.



    الفصل الحادي والخمسون

    إن المقترحات والتعديلات التي يتقدم بها أعضاء البرلمان ترفض إذا كان قبولها يؤدي بالنسبة للقانون المالي إما إلى تخفيض الموارد العمومية وإما إلى إحداث تكليف عمومي أو الزيادة في تكليف موجود.



    ممارسة السلطة التشريعية



    الفصل الثاني والخمسون

    للوزير الأول ولأعضاء البرلمان على السواء حق التقدم باقتراح القوانين.

    توضع مشاريع القوانين بمكتب أحد مجلسي البرلمان.



    الفصل الثالث والخمسون

    للحكومة أن تدفع بعدم القبول كل اقتراح أو تعديل لا يدخل في اختصاص السلطة التشريعية.

    وكل خلاف في هذا الشأن يفصل فيه المجلس الدستوري في ظرف ثمانية أيام بطلب من أحد مجلسي البرلمان أو من الحكومة.



    الفصل الرابع والخمسون

    تحال المشاريع والاقتراحات لأجل النظر فيها على لجان يستمر عملها خلال الفترات الفاصلة بين الدورات.



    الفصل الخامس والخمسون

    يمكن الحكومة أن تصدر خلال الفترة الفاصلة بين الدورات وباتفاق مع اللجان التي يعنيها الأمر في كلا المجلسين مراسيم قوانين يجب عرضها بقصد المصادقة في أثناء الدورة العادية التالية للبرلمان.

    يودع مشروع المرسوم بقانون بمكتب أحد المجلسين، وتناقشه اللجان المعنية في كليهما بالتتابع بغية التوصل إلى قرار مشترك في شأنه، وإذا لم يتأت الاتفاق على ذلك داخل أجل ستة أيام من إيداع المشروع يباشر بطلب من الحكومة تشكيل لجنة ثنائية مختلطة من أعضاء المجلسين تتولى في ظرف ثلاثة أيام من عرض الأمر عليها اقتراح قرار مشترك على اللجان المختصة.

    ويعتبر الاتفاق المنصوص عليه في الفقرة الأولى من هذا الفصل مرفوضا إذا لم تتمكن اللجنة الثنائية المختلطة من اقتراح قرار مشترك داخل الأجل المضروب لها أو إذا لم توافق اللجان البرلمانية المعنية على القرار المقترح عليها داخل أجل أربعة أيام.



    الفصل السادس والخمسون

    يضع مكتب كل من مجلسي البرلمان جدول أعماله، ويتضمن هذا الجدول بالأسبقية ووفق الترتيب الذي تحدده الحكومة مناقشة مشاريع القوانين التي تقدمها الحكومة واقتراحات القوانين التي تقبلها.

    تخصص بالأسبقية جلسة في كل أسبوع لأسئلة أعضاء مجلسي البرلمان وأجوبة الحكومة.

    يجب أن تدلي الحكومة بجوابها خلال العشرين يوما التالية لإحالة السؤال إليها.



    الفصل السابع والخمسون

    لأعضاء مجلسي البرلمان وللحكومة حق التعديل، وللحكومة بعد افتتاح المناقشة أن تعارض في بحث كل تعديل لم يعرض من قبل على اللجنة التي يعنيها الأمر.

    ويبت المجلس المعروض عليه النص بتصويت واحد في النص المتناقش فيه كله أو بعضه إذا ما طلبت الحكومة ذلك مع الاقتصار على التعديلات المقترحة أو المقبولة من طرف الحكومة.



    الفصل الثامن والخمسون

    يتداول مجلسا البرلمان بالتتابع في كل مشروع أو اقتراح قانون بغية التوصل إلى اتفاقهما على نص واحد، ويتداول المجلس المعروض عليه الأمر أولا في نص مشروع القانون المقدم من الحكومة أو نص اقتراح القانون المسجل في جدول أعماله، ويتداول المجلس المحال إليه نص سبق أن صوت عليه المجلس الآخر في النص المحال إليه.

    إذا لم يتأت إقرار مشروع أو اقتراح قانون بعد مناقشته مرتين في كلا المجلسين، أو مرة واحدة في كل منهما إذا أعلنت الحكومة الاستعجال، يجوز للحكومة أن تعمل على اجتماع لجنة ثنائية مختلطة من أعضاء المجلسين يناط بها اقتراح نص بشأن الأحكام التي ما زالت محل خلاف، ويمكن الحكومة أن تعرض النص الذي تقترحه اللجنة الثنائية المختلطة على المجلسين لإقراره، ولا يجوز في هذه الحالة قبول أي تعديل إلا بموافقة الحكومة.

    إذا لم تتمكن اللجنة الثنائية المختلطة من اقتراح نص مشترك أو إذا لم يقر المجلسان النص الذي اقترحته يجوز للحكومة أن تعرض على مجلس النواب مشروع أو اقتراح القانون بعد أن تدخل عليهما عند الاقتضاء ما

    تتبناه من التعديلات المقترحة خلال المناقشة البرلمانية، وفي هذه الحالة لا يمكن مجلس النواب أن يقر نهائيا النص المعروض عليه إلا بالأغلبية المطلقة للأعضاء الذين يتألف منهم.

    يعتبر أن مجلس النواب قد وافق على النص المعروض عليه بالأغلبية المطلقة لأعضائه في حالة إقراره عملا بأحكام الفقرة الثانية من الفصل 75.

    يتم إقرار القوانين التنظيمية والتعديلات المدخلة عليها وفق الشروط المشار إليها أعلاه، بيد أن المجلس الذي يعرض عليه أولا مشروع أو اقتراح قانون تنظيمي لا يمكنه أن يتداول فيه أو يصوت عليه إلا بعد مرور عشرة أيام على تاريخ إيداعه لديه.

    يجب أن يتم إقرار القوانين التنظيمية المتعلقة بمجلس المستشارين باتفاق بين مجلسي البرلمان على نص موحد.

    لا يمكن إصدار الأمر بتنفيذ القوانين التنظيمية إلا بعد أن يصرح المجلس

    الدستوري بمطابقتها للدستور.

    الحكومة

    الفصل التاسع والخمسون

    تتألف الحكومة من الوزير الأول والوزراء.



    الفصل الستون

    الحكومة مسؤولة أمام الملك وأمام البرلمان.

    يتقدم الوزير الأول أمام كل من مجلسي البرلمان بعد تعيين الملك لأعضاء الحكومة ويعرض البرنامج الذي يعتزم تطبيقه، ويجب أن يتضمن هذا البرنامج الخطوط الرئيسية للعمل الذي تنوي الحكومة القيام به في مختلف مجالات النشاط الوطني وبالأخص في ميادين السياسة الاقتصادية والاجتماعية والثقافية والخارجية.

    يكون البرنامج المشار إليه أعلاه موضوع مناقشة أمام كلا المجلسين ويتلو مناقشته في مجلس النواب تصويت يجب أن يقع وفق الشروط المنصوص عليها في الفقرتين الثانية والثالثة من الفصل 75 ويترتب عليه الأثر المشار إليه في الفقرة الأخيرة منه.



    الفصل الحادي والستون

    تعمل الحكومة على تنفيذ القوانين تحت مسؤولية الوزير الأول، والإدارة موضوعة رهن تصرفها.



    الفصل الثاني والستون

    للوزير الأول حق التقدم بمشاريع القوانين ولا يمكنه أن يودع أي مشروع قانون بمكتب أي من مجلسي البرلمان قبل المداولة في شأنه بالمجلس الوزاري.



    الفصل الثالث والستون

    يمارس الوزير الأول السلطة التنظيمية.

    تحمل المقررات التنظيمية الصادرة عن الوزير الأول التوقيع بالعطف من لدن الوزراء المكلفين بتنفيذها.



    الفصل الرابع والستون

    للوزير الأول الحق في تفويض بعض سلطه للوزراء.



    الفصل الخامس والستون

    يتحمل الوزير الأول مسؤولية تنسيق النشاطات الوزارية.



    الفصل السادس والستون

    تحال على المجلس الوزاري المسائل الآتية قبل البت فيها :

    -القضايا التي تهم السياسة العامة للدولة؛

    -الإعلان عن حالة الحصار؛

    -إشهار الحرب؛

    -طلب الثقة من مجلس النواب قصد مواصلة الحكومة تحمل مسؤوليتها؛

    -مشاريع القوانين قبل إيداعها بمكتب أي من مجلسي البرلمان؛

    -المراسيم التنظيمية؛

    -المراسيم المشار إليها في الفصول 40 و41 و45 و55 من هذا الدستور؛

    -مشروع المخطط؛

    -مشروع مراجعة الدستور.

    الفصل السابع والستون

    للملك أن يطلب من كلا مجلسي البرلمان أن يقرأ قراءة جديدة كل مشروع أو اقتراح قانون.



    الفصل الثامن والستون

    تطلب القراءة الجديدة بخطاب، ولا يمكن أن ترفض هذه القراءة الجديدة.



    الفصل التاسع والستون

    للملك أن يستفتي شعبه بمقتضى ظهير شريف في شأن كل مشروع أو اقتراح قانون بعد أن يكون المشروع أو الاقتراح قد قرئ قراءة جديدة، اللهم إلا إذا كان نص المشروع أو الاقتراح قد أقر أو رفض في كل من المجلسين بعد قراءته قراءة جديدة بأغلبية ثلثي الأعضاء الذين يتألف منهم.



    الفصل السبعون

    نتائج الاستفتاء تلزم الجميع.



    الفصل الحادي والسبعون

    للملك بعد استشارة رئيسي مجلسي البرلمان ورئيس المجلس الدستوري وتوجيه خطاب للأمة أن يحل مجلسي البرلمان أو أحدهما بظهير شريف.



    الفصل الثاني والسبعون

    يقع انتخاب البرلمان الجديد أو المجلس الجديد في ظرف ثلاثة أشهر على الأكثر بعد تاريخ الحل.

    وفي أثناء ذلك يمارس الملك، بالإضافة إلى السلط المخولة له بمقتضى هذا الدستور، السلط التي يختص بها البرلمان في مجال التشريع.



    الفصل الثالث والسبعون

    إذا وقع حل مجلس فلا يمكن حل المجلس الذي يليه إلا بعد مضي سنة على انتخاب المجلس الجديد.



    الفصل الرابع والسبعون

    يقع إشهار الحرب بعد إحاطة مجلس النواب ومجلس المستشارين علما بذلك.



    علاقات البرلمان بالحكومة



    الفصل الخامس والسبعون

    بإمكان الوزير الأول أن يربط لدى مجلس النواب مواصلة الحكومة مسؤوليتها بتصويت يمنح الثقة بشأن تصريح يفضي به الوزير الأول في موضوع السياسة العامة أو بشأن نص يطلب الموافقة عليه.

    ولا يمكن سحب الثقة من الحكومة أو رفض النص إلا بالأغلبية المطلقة للأعضاء الذين يتألف منهم مجلس النواب.

    لا يقع التصويت إلا بعد مضي ثلاثة أيام كاملة على اليوم الذي طرحت فيه مسألة الثقة.

    يؤدي سحب الثقة إلى استقالة الحكومة استقالة جماعية.



    الفصل السادس والسبعون

    يمكن مجلس النواب أن يعارض في مواصلة الحكومة تحمل مسؤوليتها وذلك بالموافقة على ملتمس الرقابة، ولا يقبل هذا الملتمس إلا إذا وقعه على الأقل ربع الأعضاء الذين يتألف منهم المجلس.

    لا تصح الموافقة على ملتمس الرقابة من لدن مجلس النواب إلا بتصويت الأغلبية المطلقة للأعضاء الذين يتألف منهم، ولا يقع التصويت إلا بعد مضي ثلاثة أيام كاملة على إيداع الملتمس.

    تؤدي الموافقة على ملتمس الرقابة إلى استقالة الحكومة استقالة جماعية.

    إذا وقعت موافقة مجلس النواب على ملتمس الرقابة فلا يقبل بعد ذلك تقديم أي ملتمس رقابة أمامه طيلة سنة.



    الفصل السابع والسبعون

    لمجلس المستشارين أن يصوت على ملتمس توجيه تنبيه للحكومة أو على ملتمس رقابة ضدها.

    لا يكون ملتمس توجيه التنبيه للحكومة مقبولا إلا إذا وقعه على الأقل ثلث أعضاء مجلس المستشارين، ولا تتم الموافقة عليه إلا بالأغلبية المطلقة للأعضاء الذين يتألف منهم هذا المجلس، ولا يقع التصويت إلا بعد مضي ثلاثة أيام كاملة على إيداع الملتمس.

    يبعث رئيس مجلس المستشارين على الفور بنص التنبيه إلى الوزير الأول، وتتاح لهذا الأخير مهلة ستة أيام ليعرض أمام مجلس المستشارين موقف الحكومة من الأسباب التي أدت إلى توجيه التنبيه إليها.

    يتلو إلقاء التصريح الحكومي نقاش لا يعقبه تصويت.

    لا يكون ملتمس الرقابة مقبولا أمام مجلس المستشارين إلا إذا وقعه على الأقل ثلث أعضائه، ولا تتم الموافقة عليه إلا بأغلبية ثلثي الأعضاء الذين يتألف منهم، ولا يقع التصويت إلا بعد مضي ثلاثة أيام كاملة على إيداع الملتمس.

    تؤدي الموافقة على ملتمس الرقابة إلى استقالة الحكومة استقالة جماعية.

    إذا وافق مجلس المستشارين على ملتمس رقابة فلا يقبل بعد ذلك تقديم أي ملتمس رقابة أمامه طيلة سنة.

    المجلس الدستوري



    الفصل الثامن والسبعون

    يحدث مجلس دستوري.



    الفصل التاسع والسبعون

    يتألف المجلس الدستوري من ستة أعضاء يعينهم الملك لمدة تسع سنوات، وستة أعضاء يعين ثلاثة منهم رئيس مجلس النواب وثلاثة رئيس مجلس المستشارين لنفس المدة بعد استشارة الفرق، ويتم كل ثلاث سنوات تجديد ثلث كل فئة من أعضاء المجلس الدستوري.

    يختار الملك رئيس المجلس الدستوري من بين الأعضاء الذين يعينهم.

    مهمة رئيس وأعضاء المجلس الدستوري غير قابلة للتجديد.



    الفصل الثمانون

    يحدد قانون تنظيمي قواعد تنظيم وسير المجلس الدستوري والإجراءات المتبعة أمامه خصوصا ما يتعلق بالآجال المقررة لعرض مختلف النزاعات عليه.

    ويحدد أيضا الوظائف التي لا يجوز الجمع بينها وبين عضوية المجلس الدستوري، وطريقة إجراء التجديدين الأولين لثلث أعضائه، وإجراءات تعيين من يحل محل أعضائه الذين استحال عليهم القيام بمهامهم أو استقالوا أو توفوا أثناء مدة عضويتهم.



    الفصل الحادي والثمانون

    يمارس المجلس الدستوري الاختصاصات المسندة إليه بفصول الدستور أو بأحكام القوانين التنظيمية؛ ويفصل -بالإضافة إلى ذلك- في صحة انتخاب أعضاء البرلمان وعمليات الاستفتاء.

    تحال القوانين التنظيمية قبل إصدار الأمر بتنفيذها، والنظام الداخلي لكل من مجلسي البرلمان قبل الشروع في تطبيقه إلى المجلس الدستوري ليبت في مطابقتها للدستور.

    وللملك أو الوزير الأول أو رئيس مجلس النواب أو رئيس مجلس المستشارين أو ربع أعضاء مجلس النواب أو أعضاء مجلس المستشارين أن يحيلوا القوانين قبل إصدار الأمر بتنفيذها إلى المجلس الدستوري ليبت في مطابقتها للدستور.

    يبت المجلس الدستوري في الحالات المنصوص عليها في الفقرتين السابقتين خلال شهر، وتخفض هذه المدة إلى ثمانية أيام بطلب من الحكومة إذا كان الأمر يدعو إلى التعجيل.

    يترتب على إحالة القوانين إلى المجلس الدستوري في الحالات المشار إليها أعلاه وقف سريان الأجل المحدد لإصدار الأمر بتنفيذها.

    لا يجوز إصدار أو تطبيق أي نص يخالف الدستور.

    لا تقبل قرارات المجلس الدستوري أي طريق من طرق الطعن؛ وتلزم كل السلطات العامة وجميع الجهات الإدارية والقضائية.

    الباب السابع

    القضاء






    القضاء



    الفصل الثاني والثمانون

    القضاء مستقل عن السلطة التشريعية وعن السلطة التنفيذية.



    الفصل الثالث والثمانون

    تصدر الأحكام وتنفذ باسم الملك.



    الفصل الرابع والثمانون

    يعين الملك القضاة بظهير شريف باقتراح من المجلس الأعلى للقضاء.



    الفصل الخامس والثمانون

    لا يعزل قضاة الأحكام ولا ينقلون إلا بمقتضى القانون.



    الفصل السادس والثمانون

    يرأس الملك المجلس الأعلى للقضاء ويتألف هذا المجلس بالإضافة إلى رئيسه من :

    -وزير العدل نائبا للرئيس؛

    -الرئيس الأول للمجلس الأعلى؛

    -الوكيل العام للملك لدى المجلس الأعلى؛

    -رئيس الغرفة الأولى في المجلس الأعلى؛

    -ممثلين اثنين لقضاة محاكم الاستئناف ينتخبهم هؤلاء القضاة من بينهم؛

    -أربعة ممثلين لقضاة محاكم أول درجة ينتخبهم هؤلاء القضاة من بينهم.



    الفصل السابع والثمانون

    يسهر المجلس الأعلى للقضاء على تطبيق الضمانات الممنوحة للقضاة فيما يرجع لترقيتهم وتأديبهم.

    المحكمة العليا






    المحكمة العليا



    الفصل الثامن والثمانون

    أعضاء الحكومة مسؤولون جنائيا عما يرتكبون من جنايات وجنح أثناء ممارستهم لمهامهم.



    الفصل التاسع والثمانون

    يمكن أن يوجه مجلسا البرلمان التهمة إليهم وأن يحالوا على المحكمة العليا.



    الفصل التسعون

    يجب أن يكون اقتراح توجيه الاتهام موقعا على الأقل من ربع أعضاء المجلس الذي يقدم إليه أولا، ويناقشه المجلسان بالتتابع، ولا تتم الموافقة عليه إلا بقرار يتفقان عليه عن طريق التصويت السري بأغلبية ثلثي الأعضاء الذين يتألف منهم كل مجلس باستثناء الأعضاء الذين يعهد إليهم بالمشاركة في المتابعة أو التحقيق أو الحكم.



    الفصل الحادي والتسعون

    تتألف المحكمة العليا من أعضاء ينتخب نصفهم من بين أعضاء مجلس النواب ونصفهم الآخر من بين أعضاء مجلس المستشارين ويعين رئيسها بظهير شريف.



    الفصل الثاني والتسعون

    يحدد قانون تنظيمي عدد أعضاء المحكمة العليا وكيفية انتخابهم وكذا المسطرة التي يتعين اتباعها.

    المجلس الإقتصادي والإجتماعي

    الفصل الثالث والتسعون

    يحدث مجلس اقتصادي واجتماعي.



    الفصل الرابع والتسعون

    للحكومة ولمجلس النواب ولمجلس المستشارين أن يستشيروا المجلس الاقتصادي والاجتماعي في جميع القضايا التي لها طابع اقتصادي واجتماعي.

    يدلي المجلس برأيه في الاتجاهات العامة للاقتصاد الوطني والتكوين.

    يحدد قانون تنظيمي تركيب المجلس الاقتصادي والاجتماعي وتنظيمه وصلاحياته وطريقة تسييره

    الفصل السادس والتسعون

    يتولى المجلس الأعلى للحسابات ممارسة الرقابة العليا على تنفيذ القوانين المالية.

    ويتحقق من سلامة العمليات المتعلقة بمداخيل ومصروفات الأجهزة الخاضعة لرقابته بمقتضى القانون، ويقيم كيفية قيامها بتدبير شؤونها، ويعاقب عند الاقتضاء على كل إخلال بالقواعد السارية على العمليات المذكورة.



    الفصل السابع والتسعون

    يبذل المجلس الأعلى للحسابات مساعدته للبرلمان وللحكومة في الميادين التي تدخل في نطاق اختصاصاته بمقتضى القانون.

    ويرفع إلى الملك بيانا عن جميع الأعمال التي يقوم بها.



    الفصل الثامن والتسعون

    تتولى مجالس جهوية للحسابات مراقبة حسابات الجماعات المحلية وهيئاتها وكيفية قيامها بتدبير شؤونها.



    الفصل التاسع والتسعون

    اختصاصات المجلس الأعلى والمجالس الجهوية للحسابات وقواعد تنظيمها وطريقة سيرها تحدد بالقانون.

    الفصل المائة

    الجماعات المحلية بالمملكة هي الجهات والعمالات والأقاليم والجماعات الحضرية والقروية؛ ولا يمكن إحداث أي جماعة محلية أخرى إلا بقانون.



    الفصل الحادي بعد المائة

    تنتخب الجماعات المحلية مجالس تتكلف بتدبير شؤونها تدبيرا ديمقراطيا طبق شروط يحددها القانون.

    يتولى العمال تنفيذ قرارات مجالس العمالات والأقاليم والجهات طبق شروط يحددها القانون.



    الفصل الثاني بعد المائة

    يمثل العمال الدولة في العمالات والأقاليم والجهات، ويسهرون على تنفيذ القوانين، وهم مسؤولون عن تطبيق قرارات الحكومة كما أنهم مسؤولون، لهذه الغاية، عن تدبير المصالح المحلية التابعة للإدارات المركزية.

    البــاب الثاني عشر

    مراجعة الدستور



    الفصل الثالث بعد المائة

    للملك ولمجلس النواب ولمجلس المستشارين حق اتخاذ المبادرة قصد مراجعة الدستور.

    للملك أن يستفتي شعبه مباشرة في شأن المشروع الذي يستهدف به مراجعة الدستور.



    الفصل الرابع بعد المائة

    إن اقتراح مراجعة الدستور الذي يتقدم به عضو أو أكثر من أعضاء مجلس النواب أو مجلس المستشارين لا تصح الموافقة عليه إلا بتصويت ثلثي الأعضاء الذين يتألف منهم المجلس المعروض عليه الاقتراح، ويحال الاقتراح بعد ذلك إلى المجلس الآخر ولا تصح موافقته عليه إلا بأغلبية ثلثي الأعضاء الذين يتألف منهم.



    الفصل الخامس بعد المائة

    تعرض مشاريع واقتراحات مراجعة الدستور بمقتضى ظهير على الشعب قصد الاستفتاء.

    تصير المراجعة نهائية بعد إقرارها بالاستفتاء.



    الفصل السادس بعد المائة

    النظام الملكي للدولة وكذلك النصوص المتعلقة بالدين الإسلامي لا يمكن أن تتناولها المراجعة.
    البــاب الثالث عشر

    أحكام خاصة



    الفصل السابع بعد المائة

    إلى حين انتخاب مجلسي البرلمان المنصوص عليهما في هذا الدستور يحتفظ مجلس النواب القائم حاليا بصلاحياته ليقوم، على وجه الخصوص، بإقرار القوانين اللازمة لتنصيب مجلسي البرلمان الجديدين، وذلك دون إخلال بالأحكام المنصوص عليها في الفصل 27 من هذا الدستور.



    الفصل الثامن بعد المائة

    إلى أن يتم تنصيب المجلس الدستوري، حسب تركيبته المنصوص عليها في هذا الدستور، يمارس المجلس الدستوري القائم حاليا الاختصاصات المسندة إليه بأحكام الدستور والقوانين التنظيمية.

    Le Royaume du Maroc, Etat musulman souverain, dont la langue officielle est l'arabe,
    constitue une partie du Grand Maghreb Arabe.
    Etat africain, il s'assigne, en outre, comme l'un de ses objectifs la réalisation de l'unité
    africaine.
    Conscient de la nécessité d'inscrire son action dans le cadre des organismes internationaux,
    dont il est un membre actif et dynamique, le Royaume du Maroc souscrit aux principes, droits
    et obligations découlant des Chartes des dits organismes et réaffirme son attachement aux
    droits de l'Homme tels qu'ils sont universellement reconnus.
    De même, le Royaume du Maroc réaffirme sa détermination à oeuvrer pour le maintien de la
    paix et de la sécurité dans le monde.
    TITRE PREMIER
    DISPOSITIONS GENERALES
    DES PRINCIPES FONDAMENTAUX
    ARTICLE PREMIER
    Le Maroc est une Monarchie constitutionnelle, démocratique et sociale.
    ARTlCLE 2
    La souveraineté appartient à la Nation qui l'exerce directement par voie de référendum et
    indirectement par l'intermédiaire des institutions constitutionnelles.
    ARTICLE 3
    Les partis politiques, les organisations syndicales, les Collectivités Locales et les Chambres
    professionnelles concourent à l'organisation et à la représentation des citoyens.
    Il ne peut y avoir de parti unique.
    ARTICLE 4
    La loi est l'expression suprême de la volonté de la Nation. Tous sont tenus de s'y soumettre.
    La loi ne peut avoir d'effet rétroactif.
    ARTICLE 5
    Tous les Marocains sont égaux devant la loi.
    ARTICLE 6
    L'islam est la Religion de l'Etat qui garantit à tous le libre exercice des cultes.
    ARTICLE 7
    L'emblème du Royaume est le drapeau rouge frappé en son centre d'une étoile verte à cinq
    branches.
    La devise du Royaume est DIEU, LA PATRIE, LE ROI.
    ARTICLE 8
    L'homme et la femme jouissent de droits politiques égaux.
    Sont électeurs tous les citoyens majeurs des deux sexes jouissant de leurs droits civils et
    politiques.
    ARTICLE 9
    La Constitution garantit à tous les citoyens:
    - la liberté de circuler et de s'établir dans toutes les parties du Royaume;
    - la liberté d'opinion, la liberté d'expression sous toutes ses formes et la liberté de réunion;
    - la liberté d'association et la liberté d'adhérer à toute organisation syndicale et politique de
    leur choix.
    Il ne peut être apporté de limitation à l'exercice de ces libertés que par la loi.
    ARTICLE 10
    Nul ne peut être arrêté, détenu ou puni que dans les cas et les formes prévus par la loi.
    Le domicile est inviolable. Les perquisitions ou vérifications ne peuvent intervenir que dans
    les conditions et les formes prévues par la loi.
    ARTICLE 11
    La correspondance est secrète.
    ARTICLE 12
    Tous les citoyens peuvent accéder, dans les mêmes conditions, aux fonctions et emplois
    publics.
    ARTICLE 13
    Tous les citoyens ont également droit à l'éducation et au travail.
    ARTICLE 14
    Le droit de grève demeure garanti. Une loi organique précisera les conditions et les formes
    dans lesquelles ce droit peut s'exercer.
    ARTICLE 15
    Le droit de propriété et la liberté d'entreprendre demeurent garantis.
    La loi peut en limiter l'étendue et l'exercice si les exigences du développement économique et
    social de la Nation en dictent la nécessité.
    Il ne peut être procédé à l'expropriation que dans les cas et les formes prévus par la loi.
    ARTICLE 16
    Tous les citoyens contribuent à la défense de la patrie.
    ARTICLE 17
    Tous supportent, en proportion de leurs facultés contributives, les charges publiques que seule
    la loi peut, dans les formes prévues par la présente Constitution, créer et répartir.

    Tous supportent solidairement les charges résultant des calamités nationales.
    TITRE II
    DE LA ROYAUTE
    ARTICLE19
    Le Roi, Amir Al Mouminine. Représentant Suprême de la Nation, Symbole de son unité,
    Garant de la pérennité et de la continuité de l'Etat, veille au respect de l'Islam et de la
    Constitution. Il est le protecteur des droits et libertés des citoyens, groupes sociaux et
    collectivités.
    Il garantit l'indépendance de la Nation et l'intégrité territoriale du Royaume dans ses frontières
    authentiques.
    ARTICLE 20
    La Couronne du Maroc et ses droits constitutionnels sont héréditaires et se transmettent de
    père en fils aux descendants mâles en ligne directe et par ordre de primogéniture de SA
    MAJESTE LE ROI HASSAN II, à moins que le Roi ne désigne, de son vivant, un successeur
    parmi ses fils, autre que son fils aîné. Lorsqu'il n'y a pas de descendants mâles en ligne
    directe, la succession au Trône est dévolue à la ligne collatérale mâle la plus proche et dans
    les mêmes conditions.
    ARTICLE 21
    Le Roi est mineur jusqu'à seize ans accomplis. Durant la minorité du Roi, un Conseil de
    régence exerce les pouvoirs et les droits constitutionnels de la Couronne, sauf ceux relatifs à
    la révision de la Constitution. Le Conseil de régence fonctionnera comme organe consultatif
    auprès du Roi jusqu'au jour où il aura atteint l'âge de vingt ans (20) accomplis.
    Le Conseil de régence est présidé par le premier président de la Cour Suprême. Il se compose,
    en outre, du président de la Chambre des Représentants, du président de la Chambre des
    Conseillers, du Président du Conseil régional des oulémas des villes de Rabat et Salé et de dix
    personnalités désignées par le Roi intuitu personae.
    Les règles de fonctionnement du Conseil de régence sont fixées par une loi organique.
    ARTICLE 22
    Le Roi dispose d'une liste civile.
    ARTICLE 23
    La personne du Roi est inviolable et sacrée.
    ARTICLE 24
    Le Roi nomme le Premier ministre.
    Sur proposition du Premier ministre, Il nomme les autres membres du Gouvernement, Il peut
    mettre fin à leurs fonctions.
    Il met fin aux fonctions du Gouvernement, soit à Son initiative, soit du fait de la démission du
    Gouvernement.
    ARTICLE 25
    Le Roi préside le Conseil des ministres.
    ARTICLE 26
    Le Roi promulgue la loi dans les trente jours qui suivent la transmission au Gouvernement de
    la loi définitivement adoptée.
    ARTICLE 27
    Le Roi peut dissoudre les deux Chambres du Parlement ou l'une d'elles seulement, par dahir,
    dans les conditions prévues aux articles 71 et 73 du titre V.
    ARTICLE 28
    Le Roi peut adresser des messages à la Nation et au Parlement. Les messages sont lus devant
    l'une et l'autre Chambre et ne peuvent y faire l'objet d'aucun débat.
    ARTICLE 29
    Le Roi exerce, par dahir, les pouvoirs qui Lui sont expressément réservés par la Constitution.
    Les dahirs sont contresignés par le Premier ministre, sauf ceux prévus aux articles 21 (2°
    alinéa), 24 (1er, 3° et 4° alinéas) 35, 69, 71, 79, 849 91 et 105.
    ARTICLE 30
    Le Roi est le Chef Suprême des Forces Armées Royales.
    Il nomme aux emplois civils et militaires et peut déléguer ce droit.
    ARTICLE 31
    Le Roi accrédite les ambassadeurs auprès des puissances étrangères et des organismes
    internationaux. Les ambassadeurs ou les représentants des organismes internationaux sont
    accrédités auprès de Lui.
    Il signe et ratifie les traités. Toutefois, les traités engageant les finances de l'Etat ne peuvent
    être ratifiés sans avoir été préalablement approuvés par la loi.
    Les traités susceptibles de remettre en cause les dispositions de la Constitution sont approuvés
    selon les procédures prévues pour la réforme de la Constitution.
    ARTICLE 32
    Le Roi préside le Conseil Supérieur de la Magistrature, le Conseil Supérieur de
    l'Enseignement et le Conseil Supérieur de la Promotion Nationale et du Plan.
    ARTICLE 33
    le Roi nomme les magistrats dans les conditions prévues à l'article 84.
    ARTICLE 34
    Le Roi exerce le droit de grâce.
    ARTICLE 35
    Lorsque l'intégrité du territoire national est menacée ou que se produisent des événements
    susceptibles de mettre en cause le fonctionnement des institutions constitutionnelles, le Roi
    peut, après avoir consulté le président de la Chambre des Représentants. le président de la
    Chambre des Conseillers ainsi que le président du Conseil Constitutionnel, et adressé un
    message à la Nation, proclamer, par dahir, l'état d'exception. De ce fait, Il est habilité,
    nonobstant toutes dispositions contraires, à prendre les mesures qu'imposent la défense de
    l'intégrité territoriale, le retour au fonctionnement des institutions constitutionnelles et la
    conduite des affaires de l'Etat.
    L'état d'exception n'entraîne pas la dissolution du Parlement.
    Il est mis fin à l'état d'exception dans les mêmes normes que sa proclamation.
    TITRE III
    DU PARLEMENT
    DE L'ORGANISATION DU PARLEMENT
    ARTICLE 36
    Le Parlement est composé de deux Chambres, la Chambre des Représentants et la Chambre
    des Conseillers. Leurs membres tiennent leur mandat de la Nation. Leur droit de vote est
    personnel et ne peut être délégué
    ARTICLE 37
    Les membres de la Chambre des Représentants sont élus pour cinq ans au suffrage universel
    direct. La législature prend fin à l'ouverture de la session d'octobre de la cinquième année qui
    suit l'élection de la Chambre. Le nombre des Représentants, le régime électoral, les conditions
    d'éligibilité, le régime des incompatibilités et l'organisation du contentieux électoral sont fixés
    par une loi organique.
    Le président est élu d'abord en début de législature puis à la session d'avril de la troisième
    année de cette dernière et pour la période restant à courir de celle-ci.
    Les membres du bureau sont élus à la représentation proportionnelle des groupes pour une
    durée d'une année.
    ARTICLE 38
    La Chambre des Conseillers comprend, dans la proportion des 3/5, des membres élus dans
    chaque région par un collège électoral composé de représentants des collectivités locales et,
    dans une proportion des 2/5,des membres élus dans chaque région par des collèges électoraux
    composés d'élus des Chambres professionnelles et de membres élus à l'échelon national par
    un collège électoral composé des représentants des salariés.
    Les membres de la Chambre des Conseillers sont élus pour neuf ans. La Chambre des
    Conseillers est renouvelable par tiers tous les trois ans. Les sièges faisant l'objet du premier et
    du deuxième renouvellements seront tirés au sort. Le nombre et le régime électoral des
    Conseillers, le nombre des membres à élire par chacun des collèges électoraux, la répartition
    des sièges par région, les conditions d'éligibilité et le régime des incompatibilités, les
    modalités du tirage au sort prévu ci-dessus ainsi que l'organisation du contentieux électoral
    sont fixés par une loi organique.
    Le président de la Chambre des Conseillers et les membres du bureau sont élus au début de la
    session d'octobre, lors de chaque renouvellement de la Chambre, les membres du bureau sont
    élus à la représentation proportionnelle des groupes.
    Lors de la mise en place de la première Chambre des Conseillers ou de son élection après
    dissolution de celle qui l'a précédée, le Président et les membres du bureau sont élus au début
    de la session qui suit líélection puis renouvelés au début de la session d'octobre lors de chaque
    renouvellement de la Chambre.
    ARTICLE 39
    Aucun membre du Parlement ne peut être poursuivi ou recherché, arrêté, détenu ou jugé à
    l'occasion des opinions ou votes émis par lui dans l'exercice de ses fonctions, hormis le cas où
    les opinions exprimées mettent en cause le régime monarchique, la religion musulmane ou
    constituent une atteinte au respect dû au Roi.
    Aucun membre du Parlement ne peut, pendant la durée des sessions, être poursuivi ou arrêté
    pour crimes ou délits, autres que ceux indiqués à l'alinéa précédent, qu'avec l'autorisation de
    la Chambre à laquelle il appartient, sauf dans le cas de flagrant délit.
    Aucun membre du Parlement ne peut, hors session, être arrêté qu'avec l'autorisation du bureau
    de la Chambre à laquelle il appartient, sauf dans le cas de flagrant délit, de poursuites
    autorisées ou de condamnation définitive.
    La détention ou la poursuite d'un membre du Parlement est suspendue si la Chambre à
    laquelle il appartient le requiert, sauf dans le cas de flagrant délit, de poursuites autorisées ou
    de condamnation définitive.
    ARTICLE 40
    Le Parlement siège pendant deux sessions par an. Le Roi préside l'ouverture de la première
    session qui commence le deuxième vendredi d'octobre. La seconde session s'ouvre le
    deuxième vendredi d'avril.
    Lorsque le Parlement a siégé trois mois au moins, au cours de chaque session, la clôture peut
    être prononcée par décret.
    ARTICLE 41
    Le Parlement peut être réuni en session extraordinaire, soit à la demande de la majorité
    absolue des membres de l'une des deux Chambres, soit par décret. Les sessions
    extraordinaires du Parlement se tiennent sur la base d'un ordre du jour déterminé. Lorsque ce
    dernier est épuisé, la session est close par décret.
    ARTICLE 42
    Les ministres ont accès à chaque Chambre et à leurs commissions; ils peuvent se faire assister
    de commissaires désignés par eux.
    Outre les commissions permanentes mentionnées à l'alinéa précédent, peuvent être créées à
    l'initiative du Roi ou à la demande de la majorité des membres de l'une des deux Chambres,
    au sein de chacune des deux Chambres, des commissions d'enquête formées pour recueillir les
    éléments d'information sur des faits déterminés et soumettre leurs conclusions à celle-ci. Il ne
    peut être créé de commission d'enquête lorsque les faits ont donné lieu à des poursuites
    judiciaires et aussi long temps que ces poursuites sont en cours. Si une commission a déjà été
    créée, sa mission prend fin dès l'ouverture d'une information judiciaire relative aux faits qui
    ont motivé sa création.
    Les commissions d'enquête ont un caractère temporaire. Leur mission prend fin par le dépôt
    de leur rapport.
    Une loi organique fixera les modalités de fonctionnement de ces commissions.
    ARTICLE 43
    Les séances des Chambres du Parlement sont publiques. Le compte rendu intégral des débats
    est publié au bulletin officiel.
    Chaque Chambre peut siéger en comité secret, à la demande du Premier ministre ou du tiers
    de ses membres.
    ARTICLE 44
    Chaque Chambre établit et vote son règlement. Toutefois, il ne pourra être mis en application
    qu'après avoir été déclaré par le Conseil Constitutionnel conforme aux dispositions de la
    présente Constitution.
    DES POUVOIRS DU PARLEMENT
    ARTICLE 45
    La loi est votée par le Parlement.
    Une loi d'habilitation peut autoriser le Gouvernement, pendant un délai limité et en vue d'un
    objectif déterminé, à prendre par décret des mesures qui sont normalement du domaine de la
    loi. Les décrets entrent en vigueur dès leur publication, mais ils doivent être soumis, dans un
    délai fixé par la loi d'habilitation, à la ratification du Parlement. La loi d'habilitation devient
    caduque en cas de dissolution des deux Chambres du Parlement ou de l'une d'entre elles.
    ARTICLE 46
    Sont du domaine de la loi, outre les matières qui lui sont expressément dévolues par d'autres
    articles de la Constitution:
    - les droits individuels et collectifs énumérés au titre premier de la présente Constitution;
    - la détermination des infractions et des peines qui leur sont applicables, la procédure pénale,
    la procédure civile et la création de nouvelles catégories de juridictions;
    - le statut des magistrats;
    - le statut général de la fonction publique;
    - les garanties fondamentales accordées aux fonctionnaires civils et militaires;
    - le régime électoral des assemblées et conseils des Collectivités Locales;
    - le régime des obligations civiles et commerciales;
    - la création des établissements publics;
    - la nationalisation d'entreprises et les transferts d'entreprises du secteur public au secteur
    privé.
    Le Parlement est habilité à voter des lois-cadres concernant les objectifs fondamentaux de
    l'action économique, sociale et culturelle de l'Etat.
    ARTICLE 47
    Les matières autres que celles qui sont du domaine de la loi appartiennent au domaine
    réglementaire.
    ARTICLE 48
    Les textes pris en forme législative peuvent être modifiés par décret, après avis conforme du
    Conseil Constitutionnel lorsqu'ils seront intervenus dans un domaine dévolu à l'exercice du
    pouvoir réglementaire.
    ARTICLE 49
    L'état de siège peut être déclaré, par dahir, pour une durée de trente jours. Le délai de trente
    jours ne peut être prorogé que par la loi.
    ARTICLE 50
    Le Parlement vote la loi de finances dans des conditions prévues par une loi organique.
    Les dépenses d'investissements résultant des plans de développement ne sont votées qu'une
    seule fois, lors de l'approbation du plan par le Parlement. Elles sont reconduites
    automatiquement pendant la durée du plan. Seul le Gouvernement est habilité à déposer des
    projets de lois tendant à modifier le programme ainsi adopté.
    Si, à la fin de l'année budgétaire, la loi de finances n'est pas votée ou n'est pas promulguée en
    raison de sa soumission au Conseil Constitutionnel en application de l'article 81, le
    Gouvernement ouvre, par décret, les crédits nécessaires à la marche des services publics et à
    l'exercice de leur mission, en fonction des propositions budgétaires soumises à approbation.
    Dans ce cas, les recettes continuent à être perçues conformément aux dispositions législatives
    et réglementaires en vigueur les concernant à l'exception, toutefois, des recettes dont la
    suppression est proposée dans le projet de loi de finances. Quant à celles pour lesquelles ledit
    projet prévoit une diminution de taux, elles seront perçues au nouveau taux proposé.
    ARTICLE 51
    Les propositions et amendements formulés par les membres du Parlement ne sont pas
    recevables lorsque leur adoption aurait pour conséquence, par rapport à la loi de finances, soit
    une diminution des ressources publiques, soit la création ou l'aggravation d'une charge
    publique.
    DE L'EXERCICE DU POUVOIR LEGISLATIF
    ARTICLE 52
    L'initiative des lois appartient concurremment au Premier ministre et aux membres du
    Parlement.
    Les projets de lois sont déposés sur le bureau d'une des deux Chambres.
    ARTICLE 53
    Le Gouvernement peut opposer l'irrecevabilité à toute proposition ou amendement qui n'est
    pas du domaine de la loi.
    En cas de désaccord, le Conseil Constitutionnel statue, dans un délai de huit jours, à la
    demande de l'une des deux Chambres ou du Gouvernement.
    ARTICLE 54
    Les projets et propositions sont envoyés pour examen devant des commissions dont l'activité
    se poursuit entre les sessions.
    ARTICLE 55
    Le Gouvernement peut prendre, dans l'intervalle des sessions, avec l'accord des commissions
    concernées des deux Chambres, des décrets-lois qui doivent être, au cours de la session
    ordinaire suivante du Parlement, soumis à ratification de celui-ci.
    Le projet de décret-loi est déposé sur le bureau de l'une des deux Chambres. Il est examiné
    successivement par les commissions concernées des deux Chambres en vue de parvenir à une
    décision commune dans un délai de six jours. A défaut, il est procédé, à la demande du
    Gouvernement, à la constitution d'une commission mixte paritaire qui dispose d'un délai de
    trois jours à compter de sa saisine, en vue de proposer une décision commune à soumettre aux
    commissions concernées.
    L'accord prévu au premier alinéa de cet article est réputé avoir été refusé, si la commission
    mixte paritaire n'aboutit pas dans le délai précité ou si la décision proposée par elle n'est pas
    adoptée par les commissions parlementaires concernées dans un délai de quatre jours.
    ARTICLE 56
    L'ordre du jour de chaque Chambre est établi par son bureau. Il comporte, par priorité, et dans
    l'ordre que le Gouvernement a fixé, la discussion des projets de lois déposés par le
    Gouvernement et des propositions de lois acceptées par lui.
    Une séance par semaine est réservée dans chaque Chambre par priorité, aux questions des
    membres de celle-ci et aux réponses du Gouvernement.
    La réponse du Gouvernement doit être donnée dans les vingt jours suivant la date à laquelle le
    Gouvernement a été saisi de la question.
    ARTICLE 57
    Les membres de chaque Chambre et le Gouvernement ont le droit d'amendement. Après
    l'ouverture du débat, le Gouvernement peut s'opposer à l'examen de tout amendement qui n'a
    pas été antérieurement soumis à la commission intéressée.
    Si le Gouvernement le demande, la Chambre saisie du texte en discussion se prononce par un
    seul vote sur tout ou partie de celui-ci en ne retenant que les amendements proposés ou
    acceptés par le Gouvernement.
    ARTICLE 58
    Tout projet ou proposition de loi est examiné successivement par les deux Chambres du
    Parlement pour parvenir à l'adoption d'un texte identique. La Chambre, saisie la première,
    examine le texte du projet de loi présenté par le Gouvernement ou de la proposition de loi
    inscrite; une Chambre saisie d'un texte voté par l'autre Chambre délibère sur le texte qui lui
    est transmis.
    Lorsqu'un projet ou une proposition de loi n'a pu être adopté après deux lectures par chaque
    Chambre, ou si le Gouvernement a déclaré l'urgence, après une seule lecture par chaque
    Chambre, le Gouvernement peut provoquer la réunion d'une commission mixte paritaire
    chargée de proposer un texte sur les dispositions restant en discussion. Le texte élaboré par la
    commission mixte paritaire peut être soumis pour adoption par le Gouvernement aux deux
    Chambres. Aucun amendement n'est recevable sauf accord du Gouvernement.
    Si la commission mixte paritaire ne parvient pas à l'adoption d'un texte commun ou si celui-ci
    n'est pas adopte par les Chambres, le Gouvernement peut soumettre à la Chambre des
    Représentants le projet ou la proposition de loi, modifié, le cas échéant, par les amendements
    résultant de la discussion parlementaire et repris par le Gouvernement. La Chambre des
    Représentants ne peut adopter définitivement le texte qu'à la majorité absolue des membres la
    composant.
    Sont réputées votées à la majorité absolue de la Chambre des Représentants les dispositions
    adoptées par celle-ci en application de l'article 75, alinéa 2.
    Les lois organiques sont votées et modifiées dans les mêmes conditions. Cependant le projet
    ou la proposition de loi organique n'est soumis à la délibération et au vote de la première
    Chambre saisie qu'à l'issue d'un délai de dix jours après son dépôt.
    Les lois organiques relatives à la Chambre des Conseillers doivent être votées dans les mêmes
    termes par les deux Chambres.
    Les lois organiques ne peuvent être promulguées qu'après que le Conseil Constitutionnel se
    soit prononcé sur leur conformité à la Constitution.
    TITRE IV
    DU GOUVERNEMENT
    ARTICLE 59
    Le Gouvernement se compose du Premier ministre et des ministres.
    ARTICLE 60
    Le Gouvernement est responsable devant le Roi et devant le Parlement.
    Après la nomination des membres du Gouvernement par le Roi, le Premier ministre se
    présente devant chacune des deux Chambres et expose le programme qu'il compte appliquer.
    Ce programme doit dégager les lignes directrices de l'action que le Gouvernement se propose
    de mener dans les divers secteurs de l'activité nationale et, notamment dans les domaines
    intéressant la politique économique, sociale, culturelle et extérieure.
    Ce programme fait l'objet d'un débat devant chacune des deux Chambres. A la Chambre des
    Représentants, il est suivi d'un vote dans les conditions prévues aux deuxième et troisième
    alinéas de l'article 75 et avec l'effet visé au dernier alinéa de ce même article.
    ARTICLE 61
    Sous la responsabilité du Premier ministre, le Gouvernement assure l'exécution des lois et
    dispose de l'administration.
    ARTICLE 62
    Le Premier ministre a l'initiative des lois. Aucun projet de loi ne peut être déposé par ses soins
    sur le bureau de l'une des deux Chambres avant qu'il n'en ait été délibéré en Conseil des
    ministres.
    ARTICLE 63
    Le Premier ministre exerce le pouvoir réglementaire.
    Les actes réglementaires du Premier ministre sont contresignés par les ministres chargés de
    leur exécution.
    ARTICLE 64
    Le Premier ministre peut déléguer certains de ses pouvoirs aux ministres.
    ARTICLE 65
    Le Premier ministre assume la responsabilité de la coordination des activités ministérielles.
    ARTICLE 66
    Le Conseil des ministres est saisi, préalablement à toute décision:
    - des questions concernant la politique générale de l'Etat;
    - de la déclaration de l'état de siège;
    - de la déclaration de guerre;
    - de l'engagement de la responsabilité du gouvernement devant la Chambre des Représentants;
    - des projets de lois avant leur dépôt sur le bureau de l'une des deux Chambres;
    - des décrets réglementaires;
    - des décrets visés aux articles 40, 41, 45 et 55 de la présente Constitution;
    - du projet de plan;
    - du projet de révision de la Constitution.
    TITRE V
    DES RAPPORTS ENTRE LES POUVOIRS
    DES RAPPORTS ENTRE LE ROI ET LE PARLEMENT
    ARTICLE 67
    Le Roi peut demander aux Chambres qu'il soit procédé à une nouvelle lecture de tout projet
    ou proposition de loi.
    ARTICLE 68
    La demande d'une nouvelle lecture est formulée par un message. Cette nouvelle lecture ne
    peut être refusée.
    ARTICLE 69
    Le Roi peut, après une nouvelle lecture, soumettre, par dahir, au référendum tout projet ou
    proposition de loi, hormis le cas où le texte du projet ou de la proposition de loi soumis à la
    nouvelle lecture aurait été adopté ou rejeté par chacune des deux Chambres à la majorité des
    deux tiers des membres la composant.
    ARTICLE 70
    Les résultats du référendum s'imposent à tous.
    ARTICLE 71
    Le Roi peut, après avoir consulté les présidents des deux Chambres et le président du Conseil
    Constitutionnel et adressé un message à la Nation, dissoudre, par dahir, les deux Chambres du
    Parlement ou l'une d'elles seulement.
    ARTICLE 72
    L'élection du nouveau Parlement ou de la nouvelle Chambre intervient trois mois, au plus
    tard, après la dissolution. Le Roi exerce entre-temps, outre les pouvoirs qui Lui sont reconnus
    par la présente Constitution, ceux dévolus au Parlement en matière législative.
    ARTICLE 73
    Lorsqu'une Chambre a été dissoute, celle qui lui succède ne peut être dissoute qu'un an après
    son élection.
    ARTICLE 74
    La déclaration de guerre a lieu après communication faite à la Chambre des Représentants et à
    la Chambre des Conseillers.
    DES RAPPORTS ENTRE LE PARLEMENT ET LE GOUVERNEMENT
    ARTICLE 75
    Le Premier ministre peut engager la responsabilité du Gouvernement devant la Chambre des
    Représentants, sur une déclaration de politique générale ou sur le vote d'un texte.
    La confiance ne peut être refusée ou le texte rejeté qu'à la majorité absolue des membres
    composant la Chambre des Représentants.
    Le vote ne peut intervenir que trois jours francs après que la question de confiance ait été
    posée.
    Le refus de confiance entraîne la démission collective du Gouvernement.
    ARTICLE 76
    La Chambre des Représentants peut mettre en cause la responsabilité du Gouvernement par le
    vote d'une motion de censure. Une telle motion n'est recevable que si elle est signée par le
    quart au moins des membres composant la Chambre.
    La motion de censure n'est approuvée par la Chambre des Représentants que par un vote pris
    à la majorité absolue des membres qui la composent. Le vote ne peut intervenir que trois jours
    francs après le dépôt de la motion.
    Le vote de censure entraîne la démission collective du Gouvernement.
    Lorsque le Gouvernement a été censuré par la Chambre des Représentants, aucune motion de
    censure de la Chambre des Représentants n'est recevable pendant un délai d'un an.
    ARTICLE 77
    La Chambre des Conseillers peut voter des motions d'avertissement ou des motions de
    censure du Gouvernement.
    La motion d'avertissement au Gouvernement doit être signée par le tiers au moins des
    membres de la Chambre des Conseillers. Elle doit être votée à la majorité absolue des
    membres composant la Chambre. Le vote ne peut intervenir que trois jours francs après le
    dépôt de la motion.
    Le texte de l'avertissement est immédiatement adressé par le président de la Chambre des
    Conseillers au Premier ministre qui dispose d'un délai de six jours pour présenter devant la
    Chambre des Conseillers la position du Gouvernement sur les motifs de l'avertissement.
    La déclaration gouvernementale est suivie d'un débat sans vote.
    La motion de censure n'est recevable que si elle est signée par le tiers au moins des membres
    composant la Chambre des Conseillers. Elle n'est approuvée par la Chambre que par un vote
    pris à la majorité des 2/3 des membres qui la composent. Le vote ne peut intervenir que trois
    jours francs après le dépôt de la motion.
    Le vote de censure entraîne la démission collective du Gouvernement.
    Lorsque le Gouvernement a été censuré par la Chambre des Conseillers, aucune motion de
    censure de la Chambre des Conseillers n'est recevable pendant un délai de un an.
    TITRE VI
    DU CONSEIL CONSTITUTIONNEL
    ARTICLE 78
    Il est institué un Conseil Constitutionnel.
    ARTICLE 79
    Le Conseil Constitutionnel comprend six membres désignés par le Roi pour une durée de neuf
    ans et six membres désignés pour la même durée, moitié par le président de la Chambre des
    Représentants, moitié par le président de la Chambre des Conseillers, après consultation des
    groupes. Chaque catégorie de membres est renouvelable par tiers tous les trois ans.
    Le président du Conseil Constitutionnel est choisi par le Roi parmi les membres qu'Il nomme.
    Le mandat du président et des membres du Conseil Constitutionnel n'est pas renouvelable.
    ARTICLE 80
    Une loi organique détermine les règles d'organisation et de fonctionnement du Conseil
    Constitutionnel, la procédure qui est suivie devant lui, et notamment les délais ouverts pour le
    saisir de contestations.
    Elle détermine également les fonctions incompatibles avec celles de membre de ce Conseil,
    les conditions des deux premiers renouvellements triennaux ainsi que les modalités de
    remplacement des membres empêchés, démissionnaires ou décédés en cours de mandat.
    ARTICLE 81
    Le Conseil Constitutionnel exerce les attributions qui lui sont dévolues par les articles de la
    constitution ou par des dispositions de lois organiques. Il statue, par ailleurs, sur la régularité
    de l'élection des membres du Parlement et des opérations du référendum.
    En outre, les lois organiques, avant leur promulgation, et le règlement de chaque Chambre,
    avant sa mise en application, doivent être soumis au Conseil Constitutionnel, qui se prononce
    sur leur conformité à la Constitution.
    Aux mêmes fins, les lois peuvent être déférées au Conseil Constitutionnel avant leur
    promulgation par le Roi, le Premier ministre, le président de la Chambre des Représentants, le
    président de la Chambre des Conseillers ou le quart des membres de l'une ou l'autre Chambre.
    Dans les cas prévus aux deux alinéas précédents, le Conseil Constitutionnel doit statuer dans
    le délai d'un mois. Toutefois, à la demande du Gouvernement, s'il y a urgence, ce délai est
    réduit à huit jours.
    Dans ces mêmes cas, la saisine du Conseil Constitutionnel suspend le délai de promulgation.
    Une disposition inconstitutionnelle ne peut être promulguée ni mise en application.
    Les décisions du Conseil Constitutionnel ne sont susceptibles d'aucun recours. Elles
    s'imposent aux pouvoirs publics et à toutes les autorités administratives et juridictionnelles.
    TITRE VII
    DE LA JUSTICE
    ARTICLE 82
    L'autorité judiciaire est indépendante du pouvoir législatif et du pouvoir exécutif.
    ARTICLE 83
    Les jugements sont rendus et exécutés au nom du ROI.
    ARTICLE 84
    Les magistrats sont nommés ,par dahir, sur proposition du Conseil Supérieur de la
    Magistrature.
    ARTICLE 85
    Les magistrats du siège sont inamovibles.
    ARTICLE 86
    Le Conseil Supérieur de la Magistrature est présidé par le Roi. Il se compose, en outre:
    - du ministre de la Justice, vice-président;
    - du premier président de la Cour Suprême;
    -du procureur général du Roi près de la Cour Suprême;
    - du président de la première Chambre de la Cour Suprême;
    - de deux représentants élus, parmi eux, par les magistrats des Cours d'appel;
    - de quatre représentants élus, parmi eux, par les magistrats des juridictions de premier degré.
    ARTICLE 87
    Le Conseil Supérieur de la Magistrature veille à l'application des garanties accordées aux
    magistrats quant à leur avancement et à leur discipline.
    TITRE VIII
    DE LA HAUTE COUR
    ARTICLE 88
    Les membres du Gouvernement sont pénalement responsables des crimes et délits commis
    dans l'exercice de leurs fonctions.
    ARTICLE 89
    Ils peuvent être mis en accusation par les deux Chambres du Parlement et renvoyés devant la
    Haute Cour.
    ARTICLE 90
    membres de la Chambre devant laquelle elle est présentée en premier lieu. Elle est examinée
    successivement par les deux Chambres et ne peut être approuvée que par un vote identique
    émis La proposition de mise en accusation doit être signée par au moins le quart des dans
    chaque Chambre au scrutin secret et à la majorité des deux tiers des membres la composant , à
    l'exception de ceux appelés à participer aux poursuites, à l'instruction ou au jugement.
    ARTICLE 91
    La Haute Cour est composée, par parts égales, de membres élus au sein de la Chambre des
    Représentants et au sein de la Chambre des Conseillers. Son président est nommé par dahir.
    ARTlCLE 92
    Une loi organique fixe le nombre des membres de la Haute Cour, les modalités de leur
    élection ainsi que la procédure applicable.
    TITRE IX
    DU CONSEIL ECONOMIQUE ET SOCIAL
    ARTICLE 93
    Il est institué un Conseil Economique et Social.
    ARTICLE 94
    Le Conseil Economique et Social peut être consulté par le Gouvernement, par la Chambre des
    Représentants et par la Chambre des Conseillers sur toutes les questions à caractère
    économique ou social.
    Il donne son avis sur les orientations générales de l'économie nationale et de la formation.
    ARTlCLE 95
    La composition, l'organisation, les attributions et les modalités de fonctionnement du Conseil
    Economique et Social sont déterminées par une loi organique.
    TITRE X
    DE LA COUR DES COMPTES
    ARTICLE 96
    La Cour des comptes est chargée d'assurer le contrôle supérieur de l'exécution des lois de
    finances.
    Elle s'assure de la régularité des opérations de recettes et de dépenses des organismes soumis
    à son contrôle en vertu de la loi et en apprécie la gestion. Elle sanctionne, le cas échéant, les
    manquements aux règles qui régissent les dites opérations.
    ARTICLE 97
    La Cour des comptes assiste le Parlement et le Gouvernement dans les domaines relevant de
    sa compétence en vertu de la loi.
    Elle rend compte au Roi de l'ensemble de ses activités.
    ARTICLE 98
    Les Cours régionales des comptes sont chargées d'assurer le contrôle des comptes et de la
    gestion des Collectivités Locales et de leurs groupements.
    ARTICLE 99
    Les attributions, l 'organisation et les modalités de fonctionnement de la Cour des comptes et
    des Cours régionales des comptes sont fixées par la loi.
    TITRE XI
    DES COLLECTIVITES LOCALES
    ARTICLE 100
    Les Collectivités Locales du Royaume sont les régions, les préfectures, les provinces et les
    communes. Toute autre Collectivité Locale est créée par la loi.
    ARTICLE 101
    Elles élisent des assemblées chargées de gérer démocratiquement leurs affaires dans les
    conditions déterminées par la loi.
    Les gouverneurs exécutent les délibérations des assemblées provinciales, préfectorales et
    régionales dans les conditions déterminées par la loi.
    ARTICLE 102
    Dans les provinces , les préfectures et les régions, les gouverneurs représentent l'Etat et
    veillent à l'exécution des lois. Ils sont responsables de l'application des décisions du
    Gouvernement et, à cette fin, de la gestion des services locaux des administrations centrales.
    TITRE XII
    DE LA REVISION DE LA CONSTITUTION
    ARTICLE 103
    L'initiative de la révision de la Constitution appartient au Roi, à la Chambre des Représentants
    et à la Chambre des Conseillers.
    Le Roi peut soumettre directement au référendum le projet de révision dont Il prend
    l'initiative.
    ARTICLE 104
    La proposition de révision émanant d'un ou de plusieurs membres d'une des deux Chambres
    ne peut être adoptée que par un vote à la majorité des deux tiers des membres qui composent
    cette Chambre. Cette proposition est soumise à l'autre Chambre qui peut l'adopter à la
    majorité des deux tiers des membres la composant
    ARTICLE 105
    Les projets et propositions de révision sont soumis , par dahir , au référendum.
    La révision de la Constitution est définitive, après avoir été adoptée par voie de référendum.
    ARTICLE 106
    La forme monarchique de l'Etat ainsi que les dispositions relatives à la religion musulmane ne
    peuvent faire l'objet d'une révision constitutionnelle.
    TITRE XIII
    DISPOSITIONS PARTICULIERES
    ARTICLE 107
    Jusqu'à l'élection des Chambres du Parlement prévue par la présente Constitution, la Chambre
    des Représentants, actuellement en fonction, continuera d'exercer ses attributions, notamment
    pour voter les lois nécessaires à la mise en place des nouvelles Chambres du Parlement, sans
    préjudice de l'application de l'article 27.
    ARTICLE 108
    En attendant l'installation du Conseil Constitutionnel, selon la composition prévue par la
    présente Constitution, le Conseil Constitutionnel, actuellement en fonction, demeure
    compétent pour exercer les attributions qui lui sont conférées par la Constitution et les lois
    organiques.

      The Constitution adopted on September 13th, 1996.

      PREAMBLE


      An Islamic and fully sovereign state whose official language is Arabic, the Kingdom of Morocco constitutes a part of the Great Arab Maghreb.

      As an African state, it has, among its objectives, the realisation of African unity.

      Aware of the need of incorporating its work within the frame of the international organisations of which it has become an active and dynamic member, the Kingdom of Morocco fully adheres to the principles, rights and obligations arising from the charters of such organisations, as it reaffirms its determination to abide by the universally recognised human rights.

      Likewise, it reaffirms its determination to continue its steady endeavours towards the safeguard of peace and security in the world.

      CHAPTER ONE:

      General provisions. Basic principles

      ARTICLE 1

      Morocco shall have a democratic, social and constitutional Monarchy.

      ARTICLE 2

      Sovereignty shall be that of the People who shall exercise it directly, by means of referendum, or indirectly, through the constitutional institutions.

      ARTICLE 3

      Political parties, unions, district councils and trade chambers shall participate in the organisation and representation of the citizens.

      There shall be no one-party system.

      ARTICLE 4

      The law shall be the supreme expression of the will of the Nation.All shall abide by it.The law shall have no retroactive effect.

      ARTICLE 5

      All Moroccan citizens shall be equal before the law.

      ARTICLE 6

      Islam shall be the state religion.The state shall guarantee freedom of worship for all.

      ARTICLE 7

      The emblem of the Kingdom shall be a red flag with a five-pointed green star in the center.

      The motto of the Kingdom shall be : GOD, THE COUNTRY, THE KING.

      ARTICLE 8

      Men and women shall enjoy equal political rights. Any citizen of age enjoying his or her civil and political rights shall be eligible to vote.

      ARTICLE 9

      The constitution shall guarantee all citizens the following:

      (a) freedom of movement through, and of settlement in, all parts of the Kingdom;

      (b) freedom of opinion, of expression in all its forms, and of public gathering;

      (c) freedom of association, and the freedom to belong to any union or political group of their choice.

      No limitation, except by law, shall be put to the exercise of such freedoms.

      ARTICLE 10

      No one shall be arrested, put into custody or penalised except under the circumstances and procedures prescribed by law.

      The home shall be inviolable. Search warrant shall be issued and investigation ordered under the conditions and procedures prescribed by law.

      ARTICLE 11

      Secrecy of personal correspondence shall be preserved.

      ARTICLE 12

      Opportunities for employment in public offices and positions shall be uniformly open to all citizens.

      ARTICLE 13

      All citizens shall have equal rights in seeking education and employment .

      ARTICLE 14

      The right of strike shall be guaranteed.

      Conditions and ways of exercising such a right shall be defined by an organic law.

      ARTICLE 15

      The right of private property and free enterprise shall be guaranteed.

      The law shall put limitations to its extent and use if so required by the socio-economic development planned for the Nation.

      No expropriation shall be ordered except under such circumstances and provisions as prescribed by law.

      ARTICLE 16

      All citizens shall contribute to the defence of the Country.

      ARTICLE 17

      All citizens shall, according to their contributory power, bear public costs which shall be enacted and allocated only by the law, and in the manner stipulated in the provisions of the present Constitution.

      ARTICLE 18

      All shall, in solidarity, bear the costs resulting from disasters suffered by the Nation.

      CHAPTER TWO :

      MONARCHY


      ARTICLE 19

      The King, "Amir Al-Muminin"(Commander of the Faithful), shall be the Supreme Representative of the Nation and the Symbol of the unity thereof. He shall be the guarantor of the perpetuation and the continuity of the State.As Defender of the Faith, He shall ensure the respect for the Constitution. He shall be the Protector of the rights and liberties of the citizens, social groups and organisations.

      The King shall be the guarantor of the independence of the Nation and the territorial integrity of the Kingdom within all its rightfull boundaries.

      ARTICLE 20

      The Moroccan Crown and the constitutional rights thereof shall be heriditary and handed down, from father to son, to descendants in direct male line and by order of primogeniture among the offspring of His Majesty King Hassan II, unless the King should, during his lifetime, designate a successor among his sons apart from the eldest one. In case of failing descendants in direct male line, the right of succession to the Throne shall, under the same conditions, be invested in the closest male in the collateral consanguinity.

      ARTICLE 21

      The King shall be considered minor until he turns sixteen.During the King's phase of minority, a Regency Council shall assume the powers of the constitutional rights of the Crown, with the exception of those pertaining to the revision of the Constitution.

      The Regency Council shall serve as an advisory board to the King until he turns twenty.

      The Regency Council shall be presided over by the First President of the Supreme Court. It shall include, in addition to its Chairman, the President of the House of Representatives, the President of the House of Counsellors , the Chairman of the Rabat and Salé Ulama Council (of scholars), and ten dignitaries appointed with the King's own accord.

      Rules of procedure of the Regency Council shall be governed by an organic law.

      ARTICLE 22

      The King shall be entitled to a Civil List.

      ARTICLE 23

      The person of the King shall be sacred and inviolable.

      ARTICLE 24

      The King shall appoint the Prime Minister.

      Upon the Prime Minister's recommendation, the King shall appoint the other Cabinet members as he may terminate their services.

      The King shall terminate the services of the Government either on his own initiative or because of their resignation.

      ARTICLE 25

      The King shall preside over Cabinet meetings.

      ARTICLE 26

      The King shall promulgate a definitively adopted law within the thirty days following its receipt by the Govemment.

      ARTICLE 27

      The King may dissolve the two Houses of Parliament or one thereof by Royal Decree, in accordance with the conditions prescribed in Articles 71 and 73.

      ARTICLE 28

      The King shall have the right to deliver addresses to the Nation and to the Parliament.The messages shall be read out before both Houses and shall not be subject to any debate.

      ARTICLE 29

      The King shall, by Royal Decrees, exercise the statutory powers explicitly conferred upon him by the Constitution.

      Royal Decrees shall be countersigned by the Prime Minister, with the exception of those provided for in Articles 21 (Paragraph 2), 24 (paragraphs 1, 3 and 4), 35, 69,71, 79, 84, 91, 99 and 105.

      ARTICLE 30

      The King shall be the Commander-in-chief of the Royal Armed Forces. He shall make civil and military appointments and shall reserve the right to delegate such a power.

      ARTICLE 31

      The King shall accredit ambassadors to foreign nations and international organisations. Ambassadors or representatives of international organisations shall be accredited to him.

      The King shall sign and ratify treaties. However, treaties committing State finances shall not be ratified without having been approved under the law.

      Treaties likely to affect the constitutional provisions shall be approved in accordance with the procedures prescribed for the modification of the Constitution.

      ARTICLE 32

      The King shall preside over the Supreme Council of the Magistracy, the Supreme Council of Education and the Supreme Council for National Reconstruction and Planning.

      ARTICLE 33

      The King shall appoint magistrates in accordance with the conditions prescribed in Article 84.

      ARTICLE 34

      The King shall exercise the right of granting pardon.

      ARTICLE 35

      Should the integrity of the national territory ever be under threat or should any event interrupt the course of action of the constitutional institutions, the King shall, after consulting with the President of the House of Representatives and the president of the House of Counsellors as well as the Chairman of the Constitutional Council, and addressing the Nation, have the right to declare a State of Emergency by Royal Decree.

      Notwithstanding all contrary provisions, he shall hence assume the responsibility of taking all the necessary measures for the country's defence and the restoration of a normal functioning of constitutional institutions and State affairs.

      The State of Emergency shall not entail the dissolution of the Parliament.

      The State of Emergency shall be terminated according to the same procedure followed in the proclamation thereof.

      CHAPTER THREE:

      ORGANISATION OF THE PARLIAMENT


      ARTICLE 36

      The Parliament shall be made up of two Houses, the House of Representatives and the House of Counsellors .Members of the Houses shall hold their mandate from the Nation. Their right to vote shall be personal and cannot be delegated.


      ARTICLE 37

      Members of the House of Representatives shall be elected for a six- year term by direct universal suffrage. The legal legislative period shall end at the opening of the October session in the fifth year following the election of the House.

      The number of representatives as well as the voting system, eligibility requirements, incompatibility cases, legal contentions concerning elections shall be set out in an organic law.

      The President shall be elected first at the beginning of the legislative period, then at the April session in the third year of the said period and for the remaining portion thereof.

      Members of the Board shall be elected for one year; their number shall be in propotion to their respective groups.

      ARTICLE 38

      For 3/5 of its membership, the House of Counsellors shall consist of members elected in each region by electoral colleges made up of elected members of trade chambers as well as members elected at the national level by an electoral college consisting of wage-earners' representatives.

      Members of the House of Counsellors shall be elected for a nine-year term.One third of the House shall be renewed every three years.In the first and second renewal operations, seats shall be drawn by lot. The number of counsellors as well as the voting system, the number of members to be elected by each electoral college, the distibution of seats according to regions, eligibility requirements, incompatibility cases, balotting procedures mentionned above and legal contentions concerning elections shall be set out in an organic law.

      The President of the House of Counsellors and members of the Board shall be elected at the October session during each renewal operation in the House. Members of the Board shall be elected in propotion to the size of their respective groups.

      Upon the setting up of the first House of Counsellors or upon its election following the dissolution of the preceding House, the President and the members of the Board shall be elected at the beginning of the session which follows the election;they shall seek renewal of their term of office at the beginning of the October session during each renewal operation in the House.

      ARTICLE 39

      No member of Parliament shall be prosecuted, arrested, put into custody or brought to trial as a result of expressing opinions or casting a vote while exercising office functions, except when the opinions expressed may be injurious to the monarchical system and the religion of Islam or derogatory to the respect owed the king.

      During parliamentary sessions, no member of Parliament shall be subject to prosecution or arrest for criminal charges or felonies, besides those mentioned in the preceding paragraph, without permission from the House except flagrante delicto.

      Outside parliamentary sessions, no member of Parliament shall be subject to arrest without permission from the Board of the House , except flagrante delicto, or in the case of authorised prosecution or final judgement.

      The imprisonement or prosecution of a member of Parliament shall be suspended if so required by the House, except flagrante delicto or in the case of authorised prosecution or final judgment.

      ARTICLE 40

      The Parliament shall hold its meetings during two sessions a year. The King shall preside over the opening of the first session which shall begin on the second Friday in October. The second session shall begin on the second Friday in April.

      When the Parliament convenes for at least three months during one session, the session may be adjourned by decree.

      ARTICLE 41

      The Parliament may be convened in special session either at the request of the absolute majority of the members of one of the two Houses or by decree.

      Special sessions of the Parliament shall be held on the basis of a defined agenda. Once the agenda fully addressed , the session shall be adjourned by decree.

      ARTICLE 42

      Cabinet members may attend the meetings of each House and those of the committees thereof; they shall, in this respect, have the right to commission their own assistants.

      Apart from the standing committees referred to in the preceding paragraph, parliamentary fact-finding committees may be established on the King's initiative or upon the request of the majority of the members of one of the two Houses and within each House , with the mission of inquiring about specific facts and submitting findings thereon to that House.

      There shall be no fact-finding committees in cases involving prosecutions, and as long as these are being conducted.

      The mission of any fact-finding committee which may be established shall end with the opening of the judicial investigation pertaining to the instances bringing about the establishment thereof.

      Fact-finding committees shall by nature be temporary. Their mission shall end with the submission of their reports.The functioning of these committees shall be governed by an organic law.

      ARTICLE 43

      Meetings of the Houses of Parliament shall be open to the public. Proceedings of the debates shall be published in extenso in the Gazette .

      Each House may hold private meetings if so requested by the Prime Minister, or by a third of its members.

      ARTICLE 44

      Each House shall establish and vote on its own Rules of Procedure. These shall not, however, go into effect until they are declared by the Constitutional Council as consistent with the provisions of this Constitution.


      POWERS OF THE PARLIAMENT


      ARTICLE 45

      Legislation shall be voted on by Parliament. For a limited period of time, and for a defined purpose, the Government may be empowered by law to take, by decree, measures normally falling within the purview of the law. Decrees shall become effective immediately after the publication thereof; however, they shall be submitted, for ratification, to the Parliament within the time limits set by the empowering law. Should either House be dissolved, such a law shall become void.


      ARTICLE 46

      In addition to jurisdiction matters explicitly assigned in other articles of the Constitution, the Legislative Power shall have competence in the following areas:

      (a) the individual and collective rights enumerated in Chapter One of the present Constitution;

      (b) determining offences and the appropriate penalties, the penal and civil procedure and the promulgation of new categories of jurisdiction;

      (c) the statute of magistrates;

      (d) the general statute of public offices;

      (e) the fundamental guarantees granted civil and military personnel;

      (f) the electoral system of local assemblies and councils;

      (g) the regulation of civil and commercial liabilities;

      (h) the establishment of new public agencies;

      (i) the nationalisation of enterprises or the transfer thereof from the public to the private sector.

      The Parliament shall be empowered to vote on basic laws pertaining to the fundamental objectives of the activities of the State in economic, social and cultural areas.

      ARTICLE 47

      Matters outside the purview of legislature shall come under statutory jurisdiction.

      ARTICLE 48

      Legislated bills may be amended by decree, with the consent of the Constitutional Council and when they fall within the jurisdiction of the authority holding statutory power.

      ARTICLE 49

      A state of martial law may be declared by Royal Decree for a period of thirty days. This duration may be extended by law only.

      ARTICLE 50

      The appropriation law shall be voted on by the Parliament under conditions prescribed by an organic law.

      Capital expenditures resulting from developement plans shall be voted on only at the time the Parliament approves such plans. These expenditures shall automatically be extended throughout the period of the plan.The Government alone shall have the prerogative to submit draft bills aimed at modifying programms thus adopted.

      If, by the end of the fiscal year , the budget is not voted on or is not promulgated as a result of its submission to the Constitutional Council in accordance with Article 81, the Govemment shall, by decree and in accordance with the budgetary proposals submitted for approval, be entitled to allocate funds necessary for the operation of the public services and the exercise of the functions thereof.

      In such a case, revenues shall be collected in accordance with the legislative and statutory prescriptions in force, except, however, those revenues to be cancelled under the proposed appropriation law. As for those to be cut down under the same law, they shall be collected at the proposed new rate.

      ARTICLE 51

      Proposals and amendments introduced by Members of Parliament shall not be acceptable when the adoption thereof might af'fect the proposed I appropriation law by causing a decrease in public resources, an increase in a public expenditure or the creation of a new one.


      THE EXERCISE OF THE LEGISLATIVE POWER


      ARTICLE 52

      The right to introduce laws shall equally be granted the Prime Minister and Members of Parliament.

      Draft bills shall be laid on the table of one of the two Houses.

      ARTICLE 53

      The Govemment may declare the unsuitability of any proposal or amendment considered outside the purview of the legislative power.

      In case of disagreement, the Constitutional Council shall take action within a period of eight days upon request of one of the two Houses or the Govemment.

      ARTICLE 54

      Draft bills and proposals shall be examined by the acting committees whose work shall continue during the interval between the sessions.

      ARTICLE 55

      During the recess periods, the Govemment may, in agreement with the committees concerned, in both Houses, adopt ordinances which shall be submitted, for ratification, during the following regular session of Parliament.

      The draft bill shall be tabled in one of the two Houses. It shall be considered successively by the relevant committees in both Houses in order to reach a joined decision within a period of six days.In case such a decision is not reached, steps shall be taken at the request of the Government to set up a joint committee with equal representation; it shall have three days to work out a joint decision for submission to the relevant committees.

      The agreement mentioned in the first paragraph of the present article shall be considered as refused if the joint committee with equal representation has not reached a decision within the time limits mentioned above or if the decision proposed by the said committee is not endorsed by the relevant committees within a period of four days .

      ARTICLE 56

      The Board of each House shall prepare the agenda of the House. Priority shall be given, in the order defined by the Government, to the discussion of draft bills it introduces and proposed laws accepted by it.

      One meeting per week shall, by priority, be reserved in each House for the questions of the members of the House and the Govemment's responses.

      The Govemment shall give a reply within twenty days after their receipt of the question.

      ARTICLE 57

      Members of each House, as well as the Government, shall have the right to propose amendments. After the opening of the debates, the Government may object to the examination of any amendment not submitted, beforehand, to the acting committee concerned.

      If requested by the Government, the House in which the text under discussion was tabled shall take action by single vote on the whole or part of the bill under discussion. Only amendments proposed or accepted by the Government shall be considered.

      ARTICLE 58

      Any draft bill or proposed bill shall be considered successively by the two Houses of Parliament, with a view to adopting an identical text.The House in which the draft bill is tabled first shall examine the text of the draft bill presented by the Government or the text of the proposed bill on the agenda. A house in which a bill already adopted by the other House is tabled, shall deliberate on the draft referred to it.

      If a draft bill or a proposed bill cannot be adopted after two readings in each House, or if the Government proclaims that the matter is urgent after only one reading in each House, the Government may call a meeting of the joint committee with equal representati on which shall propose a draft on the remaining provisions under discussion.The text drafted by the joint committee may be submitted by the Government to the Houses for adoption.No amendment shall be considered except with the approval of the Government.

      If the joint committee has not managed to adopt a joint bill or if the bill has not been adopted or if the bill has not been adopted by the two Houses, the Government may submit to the House of Representatives the draft bill or the proposed bill as modified, if necessary, in the light of amendments reached during parliamentary debates and taken up by the Government.The House of Representatives shall proclaim final adoption of the bill only with the absolute majority of its members.

      Provisions adopted by the House of Representatives in compliance with article 75 ,paragraph 2, shall be considered as endorsed by the absolute majority of the House.

      Organic laws shall be adopted and amended under the same conditions.However the draft bill or the proposed bill for an organic law shall not be submitted for discussion or voting at the First House in which it is to be tabled until the end of a ten -day period following its registration.

      Organic laws pertaining to the House of Counsellors shall be put to the vote under the same conditions in both Houses.

      Organic laws shall not be promulgated until the constitutional Council issues a decision on their conformity with the Constitution.

      CHAPTER FOUR:

      THE GOVERNMENT


      ARTICLE 59

      The Government shall be composed of the Prime Minister and Ministers.

      ARTICLE 60

      The Government shall be answerable to the King and the Parliament.

      After the appointment of the Cabinet members by the King, the Prime Minister shall appear before each one of the two Houses, to submit the programme to be carried out. Such a programme shall clearly outline the policy to be adopted by the Government in various areas of national activity, namely in economic, social, cultural and foreign affairs.

      This programme shall come under discussion in each one of the two Houses.At the House of Representatives, it shall be put to the vote in accordance with the provisions stipulated in paragraphs 2 and 3 of Article 75, and with the implications accounted for in the last paragraph of the same Article.

      ARTICLE 61

      Under the Prime Minister's responsibility, the Government shall ensure the execution of the laws. All public facilities shall be placed at the Government's disposal.

      ARTICLE 62

      The Prime Minister shall have the right to introduce bills. No draft bill shall be tabled, by his Department, in one of the two Houses before it is debated in a Cabinet meeting.

      ARTICLE 63

      The Prime Minister shall exercise the administrative powers.

      Decrees endorsed by the Prime Minister shall be countersigned by the Ministers responsible for the implementation thereof.

      ARTICLE 64

      The Prime Minister may delegate some of his powers to the Ministers.

      ARTICLE 65

      The Prime Minister shall be responsible for the co-ordination of ministerial activities.

      ARTICLE 66

      The Cabinet shall be notified of the following, before any relevant decision is taken:

      (a) matters related to general policies of the State;

      (b) declaration of martial law

      (c) declaration of war;

      (d) requesting confidence from the House of representatives to allow the Government to carry out their responsabilities further;

      (e) draft bills, before they are brought to one of the two Houses;

      (f) statutory decrees,

      (g) decrees mentioned in Articles 40,41,45and 55 of this Constitution :

      (h) draft plan;

      (i) projects for revising this Constitution

      CHAPTER FIVE :

      THE BRANCHES

      RELATIONS BETWEEN THE KING AND THE PARLIAMENT


      ARTICLE 67

      The King may request a second reading by the two Houses of any draft bill or proposed law.

      ARTICLE 68

      A second reading shall be requested in a message. Such a new reading shall not be refused.

      ARTICLE 69

      After a second reading, the King may, by Royal Decree, submit any draft bill or proposed law to referendum, except in the case of those submitted for a new reading which shall have been adopted or rejected by a two-third majority of the members of each one of the two Houses;

      ARTICLE 70

      The results of the referendum shall be binding upon all.

      ARTICLE 71

      After consulting with the Presidents of the two Houses,and the Chairman of the Constitutional Council and addressing the Nation, the King may decree the dissolution of the two Houses or of one of them only .

      ARTICLE 72

      The election of the new Parliament or the new House shall take place, at the latest, three months after such a dissolution.

      the King shall, in the meantime, exercise the powers lying with the Parliament in terms of law making, in addition to those conferred upon him by this Constitution.

      ARTICLE 73

      When a House is dissolved, the one succeeding it shall not be dissolved until a year after its election.

      ARTICLE 74

      The declaration of war shall be announced after notifying the House of' Representatives and the House of Counsellors.

      RELATIONS BETWEEN PARLIAMENT AND

      THE GOVERNMENT

      ARTICLE 75

      The Prime Minister may engage the responsibility of the Government before the House of Representatives through a vote of confidence regarding a statement on a general policy or a proposal requesting the approval thereof'.

      Confidence shall be withdrawn and a bill rejected only by an absolute majority vote of the Members of the House of' Representatives.

      The vote shall be held three clear days after the matter of the vote of confidence has been raised.

      Withdrawal of confidence shall entail the resignation of the Government in a body.

      ARTICLE 76

      The House of Representative may put into question the pursuance of the Government's responsibilities by adopting a censure motion. Such a motion shall be acceptable only if signed by at least one -fourth of the members of the House.

      The censure motion shall be approved by the House of Representatives only by an absolute majority vote of its members. Voting shall take place three clear days only after the motion has been introduced.

      The vote for censure shall entail the resignation of the Govemment in a body.

      Should the Govemment be censured by the House of Representatives, no other censure motion shall be acceptable before a year has elapsed.

      ARTICLE 77

      The House of Counsellors may vote warning or censure motions against the Government.

      The warning motion must be signed by at least one third of the members of the House of Counsellors.It shall be voted by the absolute majority of the members of the House . Voting shall take place three clear days after the motion has been introduced.

      The text of the warning shall be sent forthwith by the President of the House of Counsellors to the Prime Minister who shall, within six days, present before the House of Counsellors, the Government's position concerning the reasons which prompted the warning.

      The government's statement shall be followed by a debate without a vote.

      The censure motion shall not be introduced unless it is signed by at least one third of the members of the House of Counsellors. It shall be approved only after a vote by a 2/3 majority of the members of the House.Voting shall take place three days after the motion has been introduced.

      The vote for censure shall entail the joint resignation of the Government.

      Should the Government be censured by the House of Counsellors, no other censure motion shall be introduced in the House of Counsellors before a year has elapsed.

      CHAPTER SIX :

      THE CONS'TITUTIONAL COUNCIL


      ARTICLE 78

      A Constitutional Council shall be established.


      ARTICLE 79

      The Constitutional Council shall be made up of six members appointed by the King for a nine -year period.

      Upon consultation with parliamentary groups, six other members shall be appointed for the same period, half of them by the President of the House of Representatives and the other half by the President of the House of Counsellors. A third of each category of members shall be renewed every three years.

      The chairman of the Constitutional Council shall be selected by the king among the members appointed by him.

      The Chairman and the members of the Counstitutional Council shall serve for a non renewable term of office.


      ARTICLE 80

      An organic law shall govern the organisation and work of the Constitutional Council as well as the procedure it shall adopt, particularly with respect to deadlines set for referred disputes.

      Likewise, this organic law shall determine the functions which may not be compatible with that of Council member, the conditions of the first two renewals for a three -year term, as well as the procedure for replacing inactive members, either as a result of resignation or death during their term of office.

      ARTICLE 81

      The Constitutional Council shall perform the functions assigned by the articles of the Constitution or the provisions of the organic laws. It shall furthermore decide on the validity of the election of the Members of Parliament and that of referendum operations.

      Organic laws -before promulgation - and the Rules of Procedure of each House before implementation- shall be submitted to the Constitutional Council to look into their consistence with the Constitution. Before promulgation, laws may, for the same reason, be referred to the Constitutional Council by the King, the Prime Minister, the President of the House of Representatives,the President of the House of Counsellors or one-fourth of the members making up one House or the other.

      The Constitutional Council shall have one month to decide upon the special instances stated in the preceding two paragraphs. However, in case of emergency, the deadline may be reduced to eight days if so requested by the Govemment.

      Regarding the above mentioned instances, referring law to the Constitutional Council shall entail the suspension of the deadline of the promulgation thereof.

      No unconstitutional provision shall be promulgated or implemented.

      Decisions of the Constitutional Council shall, in no way, be put into question. They shall, furthermore, be binding upon all public authorities, administrative and judicial sectors.

      CHAPTER SEVEN:

      THE JUDICIARY



      ARTICLE 82

      The Judiciary shall be independent from the legislative and executive branches.

      ARTICLE 83

      Sentences shall be passed and executed in the King's name

      ARTICLE 84

      Upon recommendations made by the Supreme Council of Magistracy, Magistrates shall be appointed by Royal Decrees.

      ARTICLE 85

      Magistrates in the bench shall be irremovable .

      ARTICLE 86

      The Supreme Council of Magistracy shall be presided over by the King. It shall further consist of

      (a) the Minister of Justice as Vice-President;

      (b) the First President of the Supreme Court;

      (c) the Prosecutor General in the Supreme Court;

      (d) the President of the First Chamber the Supreme Court;

      (c) two representatives elected among magistrates of the Court of Appeal;

      (i) four representatives elected among magistrates of first degree courts.

      ARTICLE 87

      The Supreme Council of Magistracy shall ensure the implementation of the guarantees granted magistrates regarding their promotion and discipline.

      CHAPTER EIGHT :

      THE HIGH COURT OF JUSIICE


      ARTICLE 88

      Members of the Government shall be penally responsible for crimes and felonies they may commit while exercising their functions.

      ARTICLE 89

      They may be indicted by the two Houses of Parliament and referred to the High Court of Justice for trial.

      ARTICLE 90

      The proposed draft for indictment must be signed by at least a quarter of the members of the House in which it was tabled first . It shall be examined successively by the two Houses and shall be approved only when an identical vote is cast by each House by secret ballot and a two- third majority of its members with the exception of those members called upon to take part in conducting the prosecution and the investigation process and issuing the verdict.

      ARTICLE 91

      The High Court of Justice shall consist of equal numbers of members elected from the House of Representatives and the House of Counsellors. Its President shall be appointed by Royal Decree.

      ARTICLE 92

      An organic law shall determine the number of the High Court members, the method of their election and the Rules of Procedure to be adopted.

      CHAPTER NINE:

      THE ECONOMIC AND SOCIAL COUNCIL



      ARTICLE 93

      An Economic and Social Council shall be established.


      ARTICLE 94

      The Economic and Social Council may be consulted by the Government, as well as the House of Representatives and the House of Counsellors on all matters of economic or social nature. It shall give its opinion on the general guidelines pertaining to the national economy and training programmes.

      ARTICLE 95

      The constitution, organisation, prerogatives and rules of procedure of the Economic and Social Council shall be determined by an organic law.

      CHAPTER TEN:

      THE AUDIT COURT


      ARTICLE 96

      The Audit Court shall be responsible for conducting overall supervision of the implementation of the budget.It shall ensure the sound conduct of receipt and expenditure operations and evaluate the management of agencies placed under its control by law.

      It shall also take action, when necessary, against violation of the rules governing such operations.


      ARTICLE 97

      The Audit Courts shall provide assistance to Parliament and the government in its fields of competence as defined by the law.

      It shall report to the king on all its activities

      ARTICLE 98

      Regional Audit Court shall be responsible for checking the accounts and assessing the management of local governments and their groups.

      ARTICLE 99

      The terms of reference, organisation and rules of procedure of the Audit Court and regional Audit Courts shall be determined by law.

      CHAPTER ELEVEN :

      LOCAL GOVERNMENT


      ARTICLE 100

      The local government of the Kingdom shall consist of Regions, prefectures, provinces and communes. No other form of local government may be established except by law.

      Article 101

      Local assemblies shall be elected to be responsible for the conduct of their affairs on the basis of democratic principles and in accordance with provisions defined by law.

      Governors shall carry out decisions by provincial, prefelectoral and regional assemblies in accordance with the conditions set by the law.

      ARTICLE 102

      In the provinces, prefectures and regions, governors shall represent the State and see to it that the law is enforced. They shall be responsible for the implementation of Government decisions and, to the end, for the management of local departments of Government agencies.

      CHAPTER TWELVE :

      REVISING THE CONSTITUTION




      ARTICLE 103

      The king, the House of Representatives and the House of Counsellors shall have the right to initiate a revision of the Constitution.

      The King shall have the right to submit, directly for referundum, the revision project he may initiate .

      ARTICLE 104

      A proposal for revision submitted by one or more members of one of the two Houses shall be adopted only if voted on by a two -third majority of the members of the House concerned. The proposal shall be submitted to the other House which may adopt it by a two -third majority of its members.

      ARTICLE 105

      Revision projects and proposals shall be submitted to the nation for referendum by Royal Decree.

      A revision of the Constitution shall be definitive after approval by referendum.

      ARTICLE 106

      Neither the State system of monarchy nor the prescriptions related to the religion of Islam may be subject to a constitutional revision.

      CHAPTER THIRTEEN :

      SPECIAL PROVISIONS


      ARTICLE 107

      Pending the election of the Houses of Parliament provided for in the present Constitution, the current House of Representatives shall continue to discharge its duties, namely by passing the laws required for the setting up of the new Houses of Parliament, without prejudice to the implementation of the provisions of article 27.


      ARTICLE 108

      Pending the setting up of the Constitutional Council whose membership shall be composed in accordance with the provisions of the present Constitution, the current Constitutional Council shall continue to discharge the duties conferred upon it by the Constitution and the organic laws.
