    دستور الجزائر

    الجمهورية الجزائرية الديمقراطية الشعبية
    بسم الله الرحمن الرحيم

    ديباجة
    الشعب الجزائري شعب حر، ومصمم على البقاء حرا.

    فتاريخه الطويل سلسلة متصلة الحلقات من الكفاح والجهاد، جعلت الجزائر دائما منبت الحرية ، وأرض العزة والكرامة.
    لقد عرفت الجزائر في أعز اللحظات الحاسمة التي عاشها البحر الأبيض المتوسط، كيف تجد في أبنائها، منذ العهد النوميدي، و الفتح الإسلامي، حتى الحروب التحريرية من الاستعمار، روادا للحرية، والوحدة والرقي ، وبناة دول ديمقراطية مزدهرة، طوال فترات المجد والسلام
    وكان أول نوفمبر 1954 نقطة تحول فاصلة في تقرير مصيرها وتتويجا عظيما لمقاومة ضروس، واجهت بها مختلف الاعتداءات على ثقافتها ، وقيمها، والمكونات الأساسية لهويتها، وهي الإسلام والعروبة و الأمازيغية. وتمتد جذور نضالها اليوم في شتى الميادين في ماضي أمتها المجيد
    لقد تجمع الشعب الجزائري في ظل الحركة الوطنية، ثم انضوى تحت لواء جبهة التحرير الوطني ، وقدم تضحيات جساما من أجل أن يتكفل بمصيره الجماعي في كنف الحرية والهوية الثقافية الوطنية المستعادتين، ويشيد مؤسساته الدستورية الشعبية الأصيلة
    وقد توجت جبهة التحرير الوطني ما بذله خيرة أبناء الجزائر من تضحيات في الحرب التحريرية الشعبية بالاستقلال، وشيدت دولة عصرية كاملة السيادة.
    إن إيمان الشعب بالاختيارات الجماعية مكّنه من تحقيق انتصارات كبرى، طبعتها استعادة الثروات الوطنية بطابعها، وجعلتها دولة في خدمة الشعب وحده، تمارس سلطاتها بكل استقلالية، بعيدة عن أي ضغط خارجي.
    إن الشعب الجزائري ناضل ويناضل دوما في سبيل الحرية والديمقراطية، ويعتزم أن يبني بهذا الدستور مؤسسات دستورية، أساسها مشاركة كل جزائري وجزائرية في تسيير الشؤون العمومية، والقدرة على تحقيق العدالة الاجتماعية، والمساواة، وضمان الحرية لكل فرد.
    فالدستور يجسم عبقرية الشعب الخاصة، ومرآته الصافية التي تعكس تطلعاته، وثمرة إصراره، ونتاج التحولات الاجتماعية العميقة التي أحدثها، وبموافقته عليه يؤكد بكل عزم وتقدير أكثر من أي وقت مضى سمو القانون.
    إن الدستور فوق الجميع، وهو القانون الأساسي الذي يضمن الحقوق والحريات الفردية والجماعية، ويحمي مبدأ حرية اختيار الشعب، ويضفي الشرعية على ممارسة السلطات، ويكفل الحماية القانونية، ورقابة عمل السلطات العمومية في مجتمع تسوده الشرعية، ويتحقق فيه تفتح الإنسان بكل أبعاده.
    فالشعب المتحصن بقيمه الروحية الراسخة، والمحافظ على تقاليده في التضامن والعدل، واثق في قدرته على
    المساهمة الفعالة في التقدم الثقافي، والاجتماعي، والاقتصادي ، في عالم اليوم والغد.
    إن الجزائر، أرض الإسلام، وجزء لا يتجزأ من المغرب العربي الكبير، وأرض عربية، وبلاد متوسطية وإفريقية تعتز بإشعاع ثورتها، ثورة أول نوفمبر، ويشرفها الاحترام الذي أحرزته، وعرفت كيف تحافظ عليه بالتزامها إزاء كل القضايا العادلة في العالم.
    وفخر الشعب، وتضحياته، وإحساسه بالمسؤوليات، وتمسكه العريق بالحرية، والعدالة الاجتماعية، تمثل كلها أحسن ضمان لاحترام مبادئ هذا الدستور الذي يصادق عليه وينقله إلى الأجيال القادمة ورثة رواد الحرية وبناة المجتمع الحر.

    الباب الأول
    المبادئ العامة التي تحكم المجتمع الجزائري

    الفصل الأول
    الجزائر

    المادة الأولى : الجزائر جمهورية ديمقراطية شعبية. وهي وحدة لا تتجزأ.
    المادة 2 : الإسلام دين الدولة.
    المادة 3 : اللغة العربية هي اللغة الوطنية والرسمية.
    المادة 4 : عاصمة الجمهورية مدينة الجزائر.
    المادة 5 : العلم الوطني، وخاتم الدولة، والنشيد الوطني، يحددها القانون.

    الفصل الثاني
    الشعب

    المادة 6 : الشعب مصدر كل سلطة.
    السيادة الوطنية ملك للشعب وحده.
    المادة 7 : السلطة التأسيسية ملك للشعب.
    يمارس الشعب سيادته بواسطة المؤسسات الدستورية التي يختارها.
    يمارس الشعب هذه السيادة عن طريق الاستفتاء وبواسطة ممثليه المنتخبين.
    لرئيس الجمهورية أن يلتجئ إلى إرادة الشعب مباشرة
    المادة 8 : يختار الشعب لنفسه مؤسسات، غايتها ما يأتي :
    ـ المحافظة على الاستقلال الوطني، ودعمه.
    ـ المحافظة على الهوية، والوحدة الوطنية، ودعمهما،
    ـ حماية الحريات الأساسية للمواطن، والازدهار الاجتماعي والثقافي للأمة،
    ـ القضاء على استغلال الإنسان للإنسان،
    ـ حماية الاقتصاد الوطني من أي شكل من أشكال التلاعب، أو الاختلاس، أو الاستحواذ، أو المصادرة غير المشروعة.
    المادة 9 : لا يجوز للمؤسسات أن تقوم بما يأتي :
    ـ الممارسات الإقطاعية، و الجهوية، و المحسوبية،
    ـ إقامة علاقات الاستغلال والتبعية،
    ـ السلوك المخالف للخلق الإسلامي وقيم ثورة نوفمبر.
    المادة 10 : الشعب حر في اختيار ممثليه.
    لا حدود لتمثيل الشعب، إلا ما نص عليه الدستور وقانون الانتخابات.

    الفصل الثالث
    الدولة

    المادة 11 : تستمد الدولة مشروعيتها وسبب وجودها من إرادة الشعب.
    شعارها : "بالشعب وللشعب".
    وهي في خدمته وحده.
    المادة 12 : تمارس سيادة الدولة على مجالها البري، و مجالها الجوي، وعلى كما تمارس الدولة حقها السيد على مياهها الذي يقره القانون الدولي على كل منطقة من مختل مناطق المجال البحري التي ترجع إليها
    المادة 13 : لا يجوز البتة التنازل أو التخلي عن أي جزء من التراب الوطني.
    المادة14 : تقوم الدولة على مبادئ التنظيم الديمقراطي والعدالة الاجتماعية.
    المجلس المنتخب هو الإطار الذي يعبر فيه الشعب عن إرادته، ويراقب عمل السلطات العمومية.
    المادة 15 : الجماعات الإقليمية للدولة هي البلدية والولاية.
    البلدية هي الجماعة القاعدية.
    المادة 16 : يمثل المجلس المنتخب قاعدة اللامركزية، ومكان مشاركة المواطنين في تسيير الشؤون العمومية
    المادة 17 : الملكية العامة هي ملك المجموعة الوطنية.
    وتشمل باطن الأرض، والمناجم، و المقالع، و الموارد الطبيعية للطاقة، والثروات المعدنية الطبيعية والحية،
    في مختلف مناطق الأملاك الوطنية البحرية، والمياه، والغابات.
    كما تشمل النقل بالسكك الحديدية، والنقل البحري والجوي ، والبريد والمواصلات السلكية واللاسلكية، وأملاكا أخرى محددة في القانون.
    المادة 18 : الأملاك الوطنية يحددها القانون.
    وتتكون من الأملاك العمومية والخاصة التي تملكها كل من الدولة، والولاية، والبلدية.
    يتم تسيير الأملاك الوطنية طبقا للقانون.
    المادة 19 : تنظيم التجارة الخارجية من اختصاص الدولة.
    يحدد القانون شروط ممارسة التجارة الخارجية ومراقبتها.
    المادة 20 : لا يتم نزع الملكية إلا في إطار القانون. ويترتب عليه تعويض قبلي عادل، ومنصف.
    المادة 21 : لا يمكن أن تكون الوظائف في مؤسسات الدولة مصدرا للثراء، ولا وسيلة لخدمة المصالح الخاصة.
    المادة 22 : يعاقب القانون على التعسف في استعمال السلطة.
    المادة 23 : عدم تحيز الإدارة يضمنه القانون.
    المادة 24 : الدولة مسؤولة عن أمن الأشخاص والممتلكات، وتتكفل بحماية كل مواطن في الخارج.
    المادة 25 : تنتظم الطاقة الدفاعية للأمة، ودعمها، وتطويرها، حول الجيش الوطني الشعبي .
    تتمثل المهمة الدائمة للجيش الوطني الشعبي في المحافظة على الاستقلال الوطني، والدفاع عن السيادة الوطنية.
    كما يضطلع بالدفاع عن وحدة البلاد، وسلامتها الترابية، وحماية مجالها البري والجوي، ومختلف مناطق أملاكها البحرية.
    المادة 26 : تمتنع الجزائر عن اللجوء إلى الحرب من أجل المساس بالسيادة المشروعة للشعوب الأخرى وحريتها.
    وتبذل جهدها لتسوية الخلافات الدولية بالوسائل السلمية.
    المادة 27 : الجزائر متضامنة مع جميع الشعوب التي تكافح من أجل التحرر السياسي والاقتصادي، والحق في تقرير المصير، وضد كل تمييز عنصري.
    المادة 28 : تعمل الجزائر من أجل دعم التعاون الدولي، وتنمية العلاقات الودية بين الدول، على أساس المساواة، والمصلحة المتبادلة، وعدم التدخل في الشؤون الداخلية. وتتبنى مبادئ ميثاق الأمم المتحدة وأهدافه.

    الفصل الرابع
    الحقوق والحريات

    المادة 29 : كل المواطنين سواسية أمام القانون. ولا يمكن أن يُتذرع بأي تمييز يعود سببه إلى المولد، أو العرق، أو الجنس، أو الرأي، أو أي شرط أو ظرف آخر، شخصي أو اجتماعي.
    المادة 30 : الجنسية الجزائرية، معرفة بالقانون.
    شروط اكتساب الجنسية الجزائرية، والاحتفاظ بها، أو فقدانها، أو إسقاطها، محددة بالقانون.
    المادة 31 : تستهدف المؤسسات ضمان مساواة كل المواطنين والمواطنات في الحقوق والواجبات بإزالة العقبات التي تعوق تفتح شخصية الإنسان، وتحول دون مشاركة الجميع الفعلية في الحياة السياسية، والاقتصادية، والاجتماعية، والثقافية.
    المادة 32 : الحريات الأساسية وحقوق الإنسان والمواطن مضمونة.
    وتكون تراثا مشتركا بين جميع الجزائريين والجزائريات، واجبهم أن ينقلوه من جيل إلى جيل كي يحافظوا على سلامته، وعدم انتهاك حرمته.
    المادة 33 : الدفاع الفردي أو عن طريق الجمعية عن الحقوق الأساسية للإنسان وعن الحريات الفردية والجماعية،مضمون.
    المادة 34 : تضمن الدولة عدم انتهاك حرمة الإنسان.
    ويحظر أي عنف بدني أو معنوي أو أي مساس بالكرامة.
    المادة 35 : يعاقب القانون على المخالفات المرتكبة ضد الحقوق والحريات، وعلى كل ما يمس سلامة الإنسان البدنية والمعنوية.
    المادة 36 : لا مساس بحرمة حرية المعتقد، وحرمة حرية الرأي.
    المادة 37 : حرية التجارة والصناعة مضمونة، وتمارس في إطار القانون.
    المادة 38 : حرية الابتكار الفكري والفني والعلمي مضمونة للمواطن.
    حقوق المؤلف يحميها القانون.
    لا يجوز حجز أي مطبوع أو تسجيل أو أية وسيلة أخرى من وسائل التبليغ والإعلام إلا بمقتضى أمر قضائي.
    المادة 39 : لا يجوز انتهاك حرمة حياة المواطن الخاصة، وحرمة شرفه، ويحميهما القانون.
    سرية المراسلات والاتصالات الخاصة بكل أشكالها مضمونة.
    المادة 40 : تضمن الدولة عدم انتهاك حرمة المسكن.
    فلا تفتيش إلاّ بمقتضى القانون، وفي إطار احترامه.
    ولا تفتيش إلا بأمر مكتوب صادر عن السلطة القضائية المختصة.
    المادة 41 : حريات التعبير، وإنشاء الجمعيات، والاجتماع، مضمونة للمواطن.
    المادة 42 : حق إنشاء الأحزاب السياسية معترف به ومضمون.
    ولا يمكن التذرع بهذا الحق لضرب الحريات الأساسية، والقيم والمكونات الأساسية للهوية الوطنية، والوحدة الوطنية، وأمن التراب الوطني وسلامته، واستقلال البلاد، وسيادة الشعب، وكذا الطابع الديمقراطي والجمهوري للدولة.
    وفي ظل احترام أحكام هذا الدستور، لا يجوز تأسيس الأحزاب السياسية على أساس ديني أو لغوي أو عرقي أو جنسي أو مهني أو جهوي.
    ولا يجوز للأحزاب السياسية اللجوء إلى الدعاية الحزبية التي تقوم على العناصر المبينة في الفقرة السابقة.
    يحظر على الأحزاب السياسية كل شكل من أشكال التبعية للمصالح أو الجهات الأجنبية.
    لا يجوز أن يلجأ أي حزب سياسي إلى استعمال العنف أو الإكراه مهما كانت طبيعتهما أو شكلهما.
    تحدد التزامات وواجبات أخرى بموجب قانون.
    المادة 43 : حق إنشاء الجمعيات مضمون.
    تشجع الدولة ازدهار الحركة الجمعوية.
    يحدد القانون شروط وكيفيات إنشاء الجمعيات.
    المادة 44 : يحق لكل مواطن يتمتع بحقوقه المدنية والسياسية، أن يختار بحرية موطن إقامته، وأن ينتقل عبر التراب الوطني.
    حق الدخول إلى التراب الوطني والخروج منه مضمون له.
    المادة 45 : كل شخص يعتبر بريئا حتى تثبت جهة قضائية نظامية إدانته، مع كل الضمانات التي يتطلبها القانون.
    المادة 46 : لا إدانة إلا بمقتضى قانون صادر قبل ارتكاب الفعل المجّرم.
    المادة 47 : لا يتابع أحد، ولا يوقف أو يحتجز إلا في الحالات المحددة بالقانون، وطبقا للأشكال التي نص عليها.
    المادة 48 : يخضع التوقيف للنظر في مجال التحريات الجزائية للرقابة القضائية، ولا يمكن أن يتجاوز مدة ثمان وأربعين (48) ساعة.
    يملك الشخص الذي يوقف للنظر حق الاتصال فورا بأسرته.
    ولا يمكن تمديد مدة التوقيف للنظر، إلا استثناء، ووفقا للشروط المحددة بالقانون.
    ولدى انتهاء مدة التوقيف للنظر، يجب أن يجرى فحص طبي على الشخص الموقوف، إن طلب ذلك، على أن يعلم بهذه الإمكانية.
    المادة 49 : يترتب على الخطإ القضائي تعويض من الدولة.
    ويحدد القانون شروط التعويض وكيفياته.
    المادة 50 : لكل مواطن تتوفر فيه الشروط القانونية أن ينتخب وينتخب.
    المادة 51 : يتساوى جميع المواطنين في تقلد المهام والوظائف في الدولة دون أية شروط أخرى غير الشروط التي يحددها القانون.
    المادة 52 : الملكية الخاصة مضمونة.
    حق الإرث مضمون.
    الأملاك الوقفية وأملاك الجمعيات الخيرية معترف بها، ويحمي القانون تخصيصها.
    المادة 53 : الحق في التعليم مضمون.
    التعليم مجاني حسب الشروط التي يحددها القانون.
    التعليم الأساسي إجباري.
    تنظم الدولة المنظومة التعليمية.
    تسهر الدولة على التساوي في الالتحاق بالتعليم، والتكوين المهني.
    المادة 54 : الرعاية الصحية حق للمواطنين.
    تتكفل الدولة بالوقاية من الأمراض الوبائية والمعدية وبمكافحتها.
    المادة 55 : لكل المواطنين الحق في العمل.
    يضمن القانون في أثناء العمل الحق في الحماية والأمن، والنظافة.
    الحق في الراحة مضمون، ويحدد القانون كيفيات ممارسته.
    المادة 56 : الحق النقابي معترف به لجميع المواطنين.
    المادة 57 : الحق في الإضراب معترف به، ويمارس في إطار القانون.
    يمكن أن يمنع القانون ممارسة هذا الحق، أو يجعل حدودا لممارسته في ميادين الدفاع الوطني والأمن، أوفي جميع الخدمات أو الأعمال العمومية ذات المنفعة الحيوية للمجتمع.
    المادة 58 : تحظى الأسرة بحماية الدولة والمجتمع.
    المادة 59 : ظروف معيشة المواطنين الذين لم يبلغوا سن العمل، والذين لا يستطيعون القيام به، والذين عجزوا عنه نهائيا، مضمونة.

    الفصل الخامس
    الواجبات

    المادة 60 : لا يعذر بجهل القانون.
    يجب على كل شخص أن يحترم الدستور وقوانين الجمهورية.
    المادة 61 : يجب على كل مواطن أن يحمي ويصون استقلال البلاد وسيادتها وسلامة ترابها الوطني وجميع رموز الدولة.
    يعاقب القانون بكل صرامة على الخيانة والتجسس والولاء للعدو، وعلى جميع الجرائم المرتكبة ضد أمن الدولة.
    المادة 62 : على كل مواطن أن يؤدي بإخلاص واجباته تجاه المجموعة الوطنية.
    التزام المواطن إزاء الوطن وإجبارية المشاركة في الدفاع عنه، واجبان مقدسان دائمان.
    تضمن الدولة احترام رموز الثورة، وأرواح الشهداء، وكرامة ذويهم، والمجاهدين.
    المادة 63 : يمارس كل واحد جميع حرياته، في إطار احترام الحقوق المعترف بها للغير في الدستور، لاسيما احترام الحق في الشرف، وستر الحياة الخاصة، وحماية الأسرة والشبيبة والطفولة.
    المادة 64 : كل المواطنين متساوون في أداء الضريبة.
    ويجب على كل واحد أن يشارك في تمويل التكاليف العمومية، حسب قدرته الضريبية.
    لا يجوز أن تحدث أية ضريبة إلا بمقتضى القانون.
    ولا يجوز أن تحدث بأثر رجعي، أية ضريبة، أو جباية، أو رسم، أو أي حق كيفما كان نوعه.
    المادة 65 : يجازي القانون الآباء على القيام بواجب تربية أبنائهم ورعايتهم، كما يجازي الأبناء على القيام بواجب الإحسان إلى آبائهم ومساعدتهم.
    المادة 66 : يجب على كل مواطن أن يحمي الملكية العامة، ومصالح المجموعة الوطنية، ويحترم ملكية الغير.
    المادة 67 : يتمتع كل أجنبي، يكون وجوده فوق التراب الوطني قانونيا، بحماية شخصه وأملاكه طبقا للقانون.
    المادة 68 : لا يسلم أحد خارج التراب الوطني إلا بناء على قانون تسليم المجرمين وتطبيقا له.
    المادة 69 : لا يمكن بأي حال من الأحوال أن يسلم أو يطرد لاجئ سياسي يتمتع قانونا بحق اللجوء.

    الباب الثاني
    تنظيم السلطات

    الفصل الأول
    السلطة التنفيذية

    المادة 70 :يجسد رئيس الجمهورية، رئيس الدولة، وحدة الأمة.
    وهو حامي الدستور.
    ويجسد الدولة داخل البلاد وخارجها.
    له أن يخاطب الأمة مباشرة.
    المادة 71 : ينتخب رئيس الجمهورية، عن طريق الاقتراع العام المباشر والسري.
    يتم الفوز في الانتخاب بالحصول على الأغلبية المطلقة من أصوات الناخبين المعبر عنها.
    ويحدد القانون الكيفيّات الأخرى للانتخابات الرئاسية.
    المادة 72 : يمارس رئيس الجمهورية، السلطة السامية في الحدود المثبتة في الدستور.
    المادة 73 : لا يحق أن ينتخب لرئاسة الجمهورية إلا المترشح الذي :
    - يتمتع، فقط، بالجنسية الجزائرية الأصلية.
    - يدين بالإسلام،
    - يكون عمره أربعين (40) سنة كاملة يوم الانتخاب،
    - يتمتع بكامل حقوقه المدنية والسياسية،
    - يثبت الجنسية الجزائرية لزوجه،
    - يثبت مشاركته في ثورة أول نوفمبر 1954 إذا كان مولودا قبل يوليو 1942،
    - يثبت عدم تورط أبويه في أعمال ضد ثورة أول نوفمبر 1954 إذا كان مولودا بعد يوليو
    1942،
    - يقدم التصريح العلني بممتلكاته العقارية والمنقولة داخل الوطن وخارجه.
    تحدد شروط أخرى بموجب القانون.
    المادة 74 : مدة المهمة الرئاسية خمس (5) سنوات.
    يمكن تجديد انتخاب رئيس الجمهورية مرة واحدة.
    المادة 75 : يؤدي رئيس الجمهورية اليمين أمام الشعب بحضور جميع الهيئات العليا في الأمة، خلال الأسبوع الموالي لانتخابه.
    ويباشر مهمته فور أدائه اليمين.
    المادة 76 : يؤدي رئيس الجمهورية اليمين حسب النص الآتي :
    "بسم الله الرحمن الرحيم،
    وفاء للتضحيات الكبرى، ولأرواح شهدائنا الأبرار، وقيم ثورة نوفمبر الخالدة، أقسم بالله العلي العظيم، أن أحترم الدين الإسلامي وأمجده، وأدافع عن الدستور، وأسهر على استمرارية الدولة، وأعمل على توفير الشروط اللازمة للسير العادي للمؤسسات والنظام الدستوري، وأسعى من أجل تدعيم المسار الديمقراطي، وأحترم حرية اختيار الشعب، ومؤسسات الجمهورية وقوانينها، وأحافظ على سلامة التراب الوطني، ووحدة الشعب والأمة، وأحمي الحريات والحقوق الأساسية للإنسان والمواطن، وأعمل بدون هوادة من أجل تطور الشعب وازدهاره، وأسعى بكل قواي في سبيل تحقيق المثل العليا للعدالة والحرية والسلم في العالم.
    والله على ما أقول شهيد".
    المادة 77 : يضطلع رئيس الجمهورية، بالإضافة إلى السلطات التي تخولها إياه صراحة أحكام أخرى في الدستور، بالسلطات والصلاحيات الآتية :
    1 ـ هو القائد الأعلى للقوات المسلحة للجمهورية،
    2 ـ يتولى مسؤولية الدفاع الوطني،
    3 ـ يقرر السياسة الخارجية للأمة ويوجهها،
    4 ـ يرأس مجلس الوزراء،
    5 ـ يعين رئيس الحكومة وينهي مهامه،
    6 ـ يوقع المراسيم الرئاسية،
    7 ـ له حق إصدار العفو وحق تخفيض العقوبات أو استبدالها،
    8 ـ يمكنه أن يستشير الشعب في كل قضية ذات أهمية وطنية عن طريق الاستفتاء،
    9 ـ يبرم المعاهدات الدولية ويصادق عليها،
    10 ـ يسلم أوسمة الدولة ونياشينها وشهاداتها التشريفية.
    المادة 78 : يعين رئيس الجمهورية في الوظائف والمهام الآتية :
    1 ـ الوظائف والمهام المنصوص عليها في الدستور،
    2 ـ الوظائف المدنية والعسكرية في الدولة،
    3 ـ التعيينات التي تتم في مجلس الوزراء،
    4 ـ رئيس مجلس الدولة،
    5 ـ الأمين العام للحكومة،
    6 ـ محافظ بنك الجزائر،
    7 ـ القضاة،
    8 ـ مسؤولو أجهزة الأمن،
    9 ـ الولاة.
    ويعين رئيس الجمهورية سفراء الجمهورية والمبعوثين فوق العادة إلى الخارج، وينهي مهامهم، ويتسلم أوراق اعتماد الممثلين الدبلوماسيين الأجانب وأوراق إنهاء مهامهم.
    المادة 79 : يقدم رئيس الحكومة أعضاء حكومته الذين اختارهم لرئيس الجمهورية الذي يعينهم.
    يضبط رئيس الحكومة برنامج حكومته ويعرضه في مجلس الوزراء.
    المادة 80 : يقدم رئيس الحكومة برنامجه إلى المجلس الشعبي الوطني للموافقة عليه. ويجري المجلس الشعبي الوطني لهذا الغرض مناقشة عامة.
    ويمكن رئيس الحكومة أن يكيف برنامجه على ضوء هذه المناقشة.
    يقدم رئيس الحكومة عرضا حول برنامجه لمجلس الأمة.
    يمكن مجلس الأمة أن يصدر لائحة.
    المادة 81 : يقدم رئيس الحكومة استقالة حكومته لرئيس الجمهورية في حالة عدم موافقة المجلس الشعبي الوطني على البرنامج المعروض عليه.
    يعين رئيس الجمهورية من جديد رئيس حكومة حسب الكيفيات نفسها.
    المادة 82 : إذا لم تحصل من جديد موافقة المجلس الشعبي الوطني ينحل وجوبا.
    تستمر الحكومة القائمة في تسيير الشؤون العادية إلى غاية انتخاب المجلس الشعبي الوطني وذلك في أجل أقصاه ثلاثة (3) أشهر.
    المادة 83 : ينفذ رئيس الحكومة وينسق البرنامج الذي يصادق عليه المجلس الشعبي الوطني.
    المادة 84 : تقدم الحكومة سنويا إلى المجلس الشعبي الوطني بيانا عن السياسة العامة.
    تعقب بيان السياسة العامة مناقشة عمل الحكومة.
    يمكن أن تختتم هذه المناقشة بلائحة.
    كما يمكن أن يترتب على هذه المناقشة إيداع ملتمس رقابة يقوم به المجلس الشعبي الوطني طبقا لأحكام المواد 135 و136و 137 أدناه.
    لرئيس الحكومة أن يطلب من المجلس الشعبي الوطني تصويتا بالثقة. وفي حالة عدم الموافقة على لائحة الثقة يقدم رئيس الحكومة استقالة حكومته.
    في هذه الحالة، يمكن رئيس الجمهورية أن يلجأ، قبل قبول الاستقالة، إلى أحكام المادة 129 أدناه.
    يمكن الحكومة أن تقدم إلى مجلس الأمة بيانا عن السياسة العامة.
    المادة 85 : يمارس رئيس الحكومة، زيادة عن السلطات التي تخولها إياه صراحة أحكام أخرى في الدستور، الصلاحيات الآتية :
    1 ـ يوزع الصلاحيات بين أعضاء الحكومة مع احترام الأحكام الدستورية،
    2 ـ يرأس مجلس الحكومة،
    3 ـ يسهر على تنفيذ القوانين والتنظيمات،
    4 ـ يوقع المراسيم التنفيذية،
    5 ـ يعين في وظائف الدولة دون المساس بأحكام المادتين 77 و 78 السابقتي الذكر،
    6 ـ يسهر على حسن سير الإدارة العمومية.
    المادة 86: يمكن رئيس الحكومة أن يقدم استقالة حكومته لرئيس الجمهورية.
    المادة 87 : لا يجوز بأي حال من الأحوال أن يفوض رئيس الجمهورية سلطته في تعيين رئيس الحكومة وأعضائها وكذا رؤساء المؤسسات الدستورية وأعضائها الذين لم ينص الدستور على طريقة أخرى لتعيينهم.
    كما لا يجوز أن يفوض سلطته في اللجوء إلى الاستفتاء، وحل المجلس الشعبي الوطني، وتقرير إجراء الانتخابات التشريعية قبل أوانها وتطبيق الأحكام المنصوص عليها في المواد 77 و 78 و 91 ومن 93 إلى 95 و 97 و 124 و126 و 127 و 128 من الدستور.
    المادة 88 : إذا استحال على رئيس الجمهورية أن يمارس مهامه بسبب مرض خطير ومزمن، يجتمع المجلس الدستوري وجوبا، وبعد أن يتثبت من حقيقة هذا المانع بكل الوسائل الملائمة ، يقترح بالإجماع على البرلمان التصريح بثبوت المانع.
    يعلن البرلمان، المنعقد بغرفتيه المجتمعتين معا، ثبوت المانع لرئيس الجمهورية بأغلبية ثلثي (2/3) أعضائه، ويكلف بتولي رئاسة الدولة بالنيابة مدة أقصاها خمسة وأربعون (45) يوما، رئيس مجلس الأمة الذي يمارس صلاحياته مع مراعاة أحكام المادة 90 من الدستور.
    وفي حالة استمرار المانع بعد انقضاء خمسة وأربعين (45) يوما، يعلن الشغور بالاستقالة وجوبا حسب الإجراء المنصوص عليه في الفقرتين السابقتين وطبقا لأحكام الفقرات الآتية من هذه المادة.
    وفي حالة استقالة رئيس الجمهورية أو وفاته، يجتمع المجلس الدستوري وجوبا ويثبت الشغور النهائي لرئاسة الجمهورية.
    وتبلغ فورا شهادة التصريح بالشغور النهائي إلى البرلمان الذي يجتمع وجوبا.
    يتولى رئيس مجلس الأمة مهام رئيس الدولة مدة أقصاها ستون (60) يوما، تنظم خلالها انتخابات رئاسية.
    ولا يحق لرئيس الدولة المعين بهذه الطريقة أن يترشح لرئاسة الجمهورية.
    وإذا اقترنت استقالة رئيس الجمهورية أو وفاته بشغور رئاسة مجلس الأمة لأي سبب كان، يجتمع المجلس الدستوري وجوبا، ويثبت بالإجماع الشغور النهائي لرئاسة الجمهورية وحصول المانع لرئيس مجلس الأمة. وفي هذه الحالة، يتولى رئيس المجلس الدستوري مهام رئيس الدولة. يضطلع رئيس الدولة المعين حسب الشروط المبينة أعلاه بمهمة رئيس الدولة طبقا للشروط المحددة في الفقرات السابقة و في المادة 90 من الدستور. ولا يمكنه أن يترشح لرئاسة الجمهورية.
    المادة 89 : في حالة وفاة أحد المترشحين للانتخابات الرئاسية في الدور الثاني أو انسحابه أو حدوث أي مانع آخر له، يستمر رئيس الجمهورية القائم أو من يمارس مهام رئاسة الدولة في ممارسة مهامه إلى غاية الإعلان عن انتخاب رئيس الجمهورية.
    وفي هذه الحالة، يمدد المجلس الدستوري مهلة إجراء هذه الانتخابات لمدة أقصاها ستون (60) يوما.
    يحدد قانون عضوي كيفيات وشروط تطبيق هذه الأحكام.
    المادة 90 : لا يمكن أن تقال أو تعدل الحكومة القائمة إبان حصول المانع لرئيس الجمهورية،أووفاته، أو استقالته، حتى يشرع رئيس الجمهورية الجديد في ممارسة مهامه.
    يستقيل رئيس الحكومة القائمة وجوبا، إذا ترشح لرئاسة الجمهورية، ويمارس وظيفة رئيس الحكومة حينئذ أحد أعضائها الذي يعينه رئيس الدولة.
    لا يمكن، في فترتي الخمسة والأربعين (45) يوما والستين (60) يوما المنصوص عليهما في المادتين 88 و 89، تطبيق الأحكام المنصوص عليها في الفقرتين 7 و 8 من المادة 77، والمواد 79 و 124و 129 و 136 و 137 و 174 و176و 177 من الدستور.
    لا يمكن خلال هاتين الفترتين، تطبيق أحكام المواد 91 و 93 و94 و 95 و 97 من الدستور، إلا بموافقة البرلمان المنعقد بغرفتيه المجتمعتين معا، بعد استشارة المجلس الدستوري والمجلس الأعلى للأمن.
    المادة 91 : يقرر رئيس الجمهورية، إذا دعت الضرورة الملحة، حالة الطوارئ أو الحصار، لمدة معينة بعد اجتماع المجلس الأعلى للأمن، واستشارة رئيس المجلس الشعبي الوطني، ورئيس مجلس الأمة، ورئيس الحكومة، ورئيس المجلس الدستوري، ويتخذ كل التدابير اللازمة لاستتباب الوضع.
    ولا يمكن تمديد حالة الطوارئ أو الحصار، إلا بعد موافقة البرلمان، المنعقد بغرفتيه المجتمعتين معا.
    المادة 92 : يحدد تنظيم حالة الطوارئ وحالة الحصار بموجب قانون عضوي.
    المادة 93 : يقرر رئيس الجمهورية الحالة الاستثنائية إذا كانت البلاد مهددة بخطر داهم يوشك أن يصيب مؤسساتها الدستورية أو استقلالها أو سلامة ترابها.
    ولا يتخذ مثل هذا الإجراء إلا بعد استشارة رئيس المجلس الشعبي الوطني ورئيس مجلس الأمة والمجلس الدستوري، والاستماع إلى المجلس الأعلى للأمن ومجلس الوزراء.
    تخول الحالة الاستثنائية رئيس الجمهورية أن يتخذ الإجراءات الاستثنائية التي تستوجبها المحافظة على استقلال الأمة والمؤسسات الدستورية في الجمهورية.
    ويجتمع البرلمان وجوبا.
    تنتهي الحالة الاستثنائية، حسب الأشكال والإجراءات السالفة الذكر التي أوجبت إعلانها.
    المادة 94 : يقرر رئيس الجمهورية التعبئة العامة في مجلس الوزراء بعد الاستماع إلى المجلس الأعلى للأمن واستشارة رئيس المجلس الشعبي الوطني ورئيس مجلس الأمة.
    المادة 95 : إذا وقع عدوان فعلي على البلاد أو يوشك أن يقع حسبما نصت عليه الترتيبات الملائمة لميثاق الأمم المتحدة، يعلن رئيس الجمهورية الحرب، بعد اجتماع مجلس الوزراء والاستماع إلى المجلس الأعلى للأمن واستشارة رئيس المجلس الشعبي الوطني ورئيس مجلس الأمة.
    ويجتمع البرلمان وجوبا.
    ويوجه رئيس الجمهورية خطابا للأمة يعلمها بذلك.
    المادة 96 : يوقف العمل بالدستور مدة حالة الحرب ويتولى رئيس الجمهورية جميع السلطات.
    وإذا انتهت المدة الرئاسية لرئيس الجمهورية تمدد وجوبا إلى غاية انتهاء الحرب.
    وفي حالة استقالة رئيس الجمهورية أو وفاته أو حدوث أي مانع آخر له، يخول رئيس مجلس الأمة باعتباره رئيسا للدولة، كل الصلاحيات التي تستوجبها حالة الحرب، حسب الشروط نفسها التي تسري على رئيس الجمهورية.
    في حالة اقتران شغور رئاسة الجمهورية ورئاسة مجلس الأمة، يتولى رئيس المجلس الدستوري وظائف رئيس الدولة حسب الشروط المبينة سابقا.
    المادة 97 : يوقع رئيس الجمهورية اتفاقيات الهدنة ومعاهدات السلم.
    ويتلقى رأي المجلس الدستوري في الاتفاقيات المتعلقة بهما. ويعرضها فورا على كل غرفة من البرلمان لتوافق عليها صراحة.

    الفصل الثاني
    السلطة التشريعية

    المادة 98 : يمارس السلطة التشريعية برلمان يتكون من غرفتين، وهما المجلس الشعبي الوطني ومجلس الأمة.
    وله السيادة في إعداد القانون والتصويت عليه.
    المادة 99 : يراقب البرلمان عمل الحكومة وفقا للشروط المحددة في المواد 80 و 84 و 133 و 134 من الدستور.
    يمارس المجلس الشعبي الوطني الرقابة المنصوص عليها في المواد من 135 إلى 137 من الدستور.
    المادة 100 : واجب البرلمان، في إطار اختصاصاته الدستورية، أن يبقى وفيا لثقة الشعب، ويظل يتحسس تطلعاته.
    المادة 101 : ينتخب أعضاء المجلس الشعبي الوطني عن طريق الاقتراع العام المباشر والسري.
    ينتخب ثلثا (2/3) أعضاء مجلس الأمة عن طريق الاقتراع غير المباشر والسري من بين ومن طرف أعضاء المجالس الشعبية البلدية والمجلس الشعبي الولائي. ويعين رئيس الجمهورية الثلث الآخر من أعضاء مجلس الأمة من بين الشخصيات والكفاءات الوطنية في المجالات العلمية والثقافية والمهنية والاقتصادية والاجتماعية.
    عدد أعضاء مجلس الأمة يساوي، على الأكثر، نصف عدد أعضاء المجلس الشعبي الوطني.
    يحدد القانون كيفيات تطبيق الفقرة الثانية السابقة.
    المادة 102 : ينتخب المجلس الشعبي الوطني لمدة خمس (05) سنوات.
    تحدد مهمة مجلس الأمة بمدة ست (06) سنوات.
    تجدد تشكيلة مجلس الأمة بالنصف كل ثلاث (03) سنوات.
    لا يمكن تمديد مهمة البرلمان إلاّ في ظروف خطيرة جدا لا تسمح بإجراء انتخابات عادية.
    ويثبت البرلمان المنعقد بغرفتيه المجتمعتين معا هذه الحالة بقرار، بناء على اقتراح رئيس الجمهورية واستشارة المجلس الدستوري.
    المادة 103 : تحدد كيفيات انتخاب النواب وكيفيات انتخاب أعضاء مجلس الأمة أو تعيينهم، وشروط قابليتهم للانتخاب، ونظام عدم قابليتهم للانتخاب، وحالة التنافي، بموجب قانون عضوي.
    المادة 104 : إثبات عضوية النواب وأعضاء مجلس الأمة من اختصاص كل من الغرفتين على حدة.
    المادة 105 : مهمة النائب وعضو مجلس الأمة وطنية، قابلة للتجديد، ولا يمكن الجمع بينها وبين مهام أو وظائف أخرى.
    المادة 106 : كل نائب أو عضو مجلس الأمة لا يستوفي شروط قابلية انتخابه أو يفقدها، يتعرض لسقوط مهمته البرلمانية.
    ويقرر المجلس الشعبي الوطني أو مجلس الأمة، حسب الحالة، هذا السقوط بأغلبية أعضائهما.
    المادة 107 : النائب أو عضو مجلس الأمة مسؤول أمام زملائه الذين يمكنهم تجريده من مهمته النيابية إن اقترف فعلا يخل بشرف مهمته.
    يحدد النظام الداخلي لكل واحدة من الغرفتين، الشروط التي يتعرض فيها أي نائب أو عضو مجلس الأمة للإقصاء. ويقرر هذا الإقصاء، حسب الحالة، المجلس الشعبي الوطني أو مجلس الأمة بأغلبية أعضائهما، دون المساس بجميع المتابعات الأخرى الواردة في القانون.
    المادة 108 : يحدد قانون عضوي الحالات التي يقبل فيها البرلمان استقالة أحد أعضائه.
    المادة 109 : الحصانة البرلمانية معترف بها للنواب ولأعضاء مجلس الأمة مدة نيابتهم ومهمتهم البرلمانية.
    و لا يمكن أن يتابعوا أو يوقفوا. وعلى العموم لا يمكن أن ترفع عليهم أية دعوى مدنية أو جزائية أو يسلط عليهم أي ضغط بسبب ما عبروا عنه من آراء أو ما تلفظوا به من كلام، أو بسبب تصويتهم خلال ممارسة مهامهم البرلمانية.
    المادة 110 : لا يجوز الشروع في متابعة أي نائب أو عضو مجلس الأمة بسبب جناية أو جنحة إلا بتنازل صريح منه، أو بإذن، حسب الحالة، من المجلس الشعبي الوطني أو مجلس الأمة الذي يقرر رفع الحصانة عنه بأغلبية أعضائه.
    المادة 111 : في حالة تلبس أحد النواب أو أحد أعضاء مجلس الأمة بجنحة أو جناية، يمكن توقيفه. ويخطر بذلك مكتب المجلس الشعبي الوطني، أو مكتب مجلس الأمة، حسب الحالة، فورا.
    يمكن المكتب المخطر أن يطلب إيقاف المتابعة و إطلاق سراح النائب أو عضو مجلس الأمة، على أن يعمل فيما بعد بأحكام المادة 110 أعلاه.
    المادة 112 : يحدد قانون عضوي شروط استخلاف النائب أو عضو مجلس الأمة في حالة شغور مقعده.
    المادة 113 : تبتدئ الفترة التشريعية، وجوبا، في اليوم العاشر الموالي لتاريخ انتخاب المجلس الشعبي الوطني، تحت رئاسة أكبر النواب سنا، وبمساعدة أصغر نائبين منهم.
    ينتخب المجلس الشعبي الوطني مكتبه ويشكل لجانه.
    تطبق الأحكام السابقة الذكر على مجلس الأمة.
    المادة 114 : ينتخب رئيس المجلس الشعبي الوطني للفترة التشريعية.
    ينتخب رئيس مجلس الأمة بعد كل تجديد جزئي لتشكيلة المجلس.
    المادة 115 : يحدد قانون عضوي تنظيم المجلس الشعبي الوطني ومجلس الأمة، وعمالهما، وكذا العلاقات الوظيفية بينهما وبين الحكومة.
    يحدد القانون ميزانية الغرفتين والتعويضات التي تدفع للنواب وأعضاء مجلس الأمة.
    يعد المجلس الشعبي الوطني ومجلس الأمة نظامهما الداخلي ويصادقان عليهما.
    المادة 116 : جلسات البرلمان علانية.
    وتدون مداولاته في محاضر تنشر طبقا للشروط التي يحددها القانون العضوي.
    يجوز للمجلس الشعبي الوطني ومجلس الأمة أن يعقدا جلسات مغلقة بطلب من رئيسيهما، أو من أغلبية أعضائهما الحاضرين، أو بطلب من رئيس الحكومة.
    المادة 117 : يشكل المجلس الشعبي الوطني ومجلس الأمة لجانهما الدائمة في إطار نظامهما الداخلي.
    المادة 118 : يجتمع البرلمان في دورتين عاديتين كل سنة، ومدة كل دورة أربعة (04) أشهر على الأقل.
    يمكن أن يجتمع البرلمان في دورة غير عادية بمبادرة من رئيس الجمهورية. ويمكن كذلك أن يجتمع باستدعاء من رئيس الجمهورية بطلب من رئيس الحكومة، أو بطلب من ثلثي(2/3) أعضاء المجلس الشعبي الوطني.
    تختتم الدورة غير العادية بمجرد ما يستنفذ البرلمان جدول الأعمال الذي استدعي من أجله.
    المادة 119 : لكلّ من رئيس الحكومة و النّوّاب حقّ المبادرة بالقوانين.
    تكون اقتراحات القوانين قابلة للمناقشة،إذا قّدمها عشرون(20)نائبا.
    تعرض مشاريع القوانين على مجلس الوزراء ،بعد الأخذ برأي مجلس الدّولة ،ثمّ يودعها رئيس الحكومة مكتب المجلس الشعبيّ الوطنيّ.
    المادة 120 : يجب أن يكون كل مشروع أو اقتراح قانون موضوع مناقشة من طرف المجلس الشعبيّ الوطنيّ ومجلس الأمة على التّوالي حتّى تتّم المصادقة عليه.
    تنصّب مناقشة مشاريع أو اقتراحات القوانين من طرف المجلس الشعبيّ الوطنيّ على النّص المعروض عليه.
    يناقش مجلس الأمّة النّص الّذي صوّت عليه المجلس الشعبيّ الوطنيّ ويصادق عليه بأغلبّية ثلاثة أرباع(3/4) أعضائه.
    و في حالة حدوث خلاف بين الغرفتين، تجتمع، بطلب من رئس الحكومة، لجنة متساوية الأعضاء تتكّون من أعضاء كلتا الغرفتين من أجل اقتراح نصّ يتعلّق بالأحكام محلّ الخلاف. تعرض الحكومة هذا النّصّ على الغرفتين للمصادقة عليه، ولا يمكن إدخال أي تعديل عليه إلاّ بموافقة الحكومة.
    وفي حالة استمرار الخلاف يسحب النّصّ.
    يصادق البرلمان على قانون المالية في مدّة أقصاها خمسة وسبعون يوما(75)من تاريخ إيداعه، طبقا للفقرات السابقة.
    وفي حالة عدم المصادقة عليه في الأجل المحدّد سابقا، يصدر رئيس الجمهورية مشروع الحكومة بأمر.
    تحدّد الإجراءات الأخرى بموجب القانون العضوي المذكور في المادة 115 من الدستور.
    المادة 121 : لا يقبل اقتراح أيّ قانون، مضمونه أو نتيجته تخفيض الموارد العمومية، أو زيادة النّفقات العموميّة، إلاّ إذا كان مرفوقا بتدابير تستهدف الزّيادة في إيرادات الدّولة، أو توفير مبالغ مالية في فصل آخر من النّفقات العموميّة تساوي على الأقل المبالغ المقترح إنفاقها.
    المادة 122 : يشرّع البرلمان في الميادين التّي يخصّصها له الدّستور، وكذلك في المجالات الآتية:
    1 ـ حقوق الأشخاص وواجباتهم الأساسيّة، لا سيّما نظام الحرياّت العموميّة، وحماية الحرّياّت الفرديّة، وواجبات المواطنين،
    2 ـ القواعد العامّة المتعلقّة بقانون الأحوال الشّخصيّة، وحقّ الأسرة،لا سيّما الزّواج، والطلاق، والبنوّة، والأهليّة، والتّركاتّ،
    3 ـ شروط استقرار الأشخاص،
    4 ـ التّشريع الأساسيّ المتعلّق بالجنسيّة،
    5 ـ القواعد العامة المتعلقة بوضعية الأجانب،
    6 ـ القواعد المتعلقة بالتنظيم القضائي، وإنشاء الهيئات القضائية،
    7 ـ قواعد قانون العقوبات، والإجراءات الجزائيّة، لا سيّما تحديد الجنايات والجنح، والعقوبات المختلفة المطابقة لها، والعفو الشامل، وتسليم المجرمين، ونظام السجون،
    8 ـ القواعد العامة للإجراءات المدنية وطرق التنفيذ،
    9 ـ نظام الالتزامات المدنية والتجارية، ونظام الملكية،
    10 ـ التقسيم الإقليمي للبلاد،
    11 ـ المصادقة على المخطط الوطنيّ،
    12 ـ التّصويت على ميزانيّة الدّولة،
    13 ـ إحداث الضّرائب والجبايات والرّسوم والحقوق المختلفة، وتحديد أساسها ونسبها،
    14 ـ النظام الجمركي،
    15 ـ نظام إصدار النّقود، ونظام البنوك والقرض والتّأمينات،
    16 ـ القواعد العامّة المتعلّقة بالتّعليم، والبحث العلميّ،
    17 ـ القواعد العامّة المتعلّقة بالصّحّة العموميّة والسّكّان،
    18 ـ القاعد العامة المتعلقة بقانون العمل والضمان الاجتماعي، وممارسة الحق النقابي،
    19 ـ القواعد العامة المتعلقة بالبيئة وإطار المعيشة، والتهيئة العمرانية،
    20 ـ القواعد العامة المتعلقة بحماية الثروة الحيوانية والنباتية،
    21 ـ حماية التراث الثقافي والتاريخي، والمحافظة عليه،
    22 ـ النظام العام للغابات والأراضي الرعوية،
    23 ـ النظام العام للمياه،
    24 ـ النظام العام للمناجم والمحروقات،
    25 ـ النظام العقاري،
    26 ـ الضمانات الأساسية للموظفين، والقانون الأساسي العام للوظيف العمومي،
    27 ـ القواعد العامة المتعلقة بالدفاع الوطني واستعمال السلطات المدنية القوات المسلحة،
    28 ـ قواعد نقل الملكية من القطاع العام إلى القطاع الخاص،
    29 ـ إنشاء فئات المؤسسات،
    30 ـ إنشاء أوسمة الدولة ونياشينها وألقابها التشريفية.
    المادة 123 : إضافة إلى المجالات المخصصة للقوانين العضوية بموجب الدستور، يشرع البرلمان بقوانين عضوية في المجالات الآتية :
    ـ تنظيم السلطات العمومية، وعملها،
    ـ نظام الانتخابات،
    ـ القانون المتعلق بالأحزاب السياسية،
    ـ القانون المتعلق بالإعلام،
    ـ القانون الأساسي للقضاء، والتنظيم القضائي،
    ـ القانون المتعلق بقوانين المالية،
    ـ القانون المتعلق بالأمن الوطني.
    تتم المصادقة على القانون العضوي، بالأغلبية المطلقة للنواب وبأغلبية ثلاثة أرباع(3/4)أعضاء مجلس الأمة.
    يخضع القانون العضوي لمراقبة مطابقة النص مع الدستور من طرف المجلس الدستوري قبل صدوره.
    المادة 124 : لرئيس الجمهورية أن يشرع بأوامر في حالة شغور المجلس الشعبي الوطني، أو بين دورتي البرلمان.
    ويعرض رئيس الجمهورية النصوص التي اتخذها على كل غرفة من البرلمان في أول دورة له لتوافق عليها.
    تعد لاغية الأوامر التي لا يوافق عليها البرلمان.
    يمكن رئيس الجمهورية أن يشرّع بأوامر في الحالة الاستثنائية المذكورة في المادة 93 من الدستور.
    تتخذ الأوامر في مجلس الوزراء.
    المادة 125 : يمارس رئيس الجمهورية السلطة التنظيمية في المسائل غير المخصصة للقانون.
    يندرج تطبيق القوانين في المجال التنظيمي الذي يعود لرئيس الحكومة.
    المادة 126 : يصدر رئيس الجمهورية القانون في أجل ثلاثين (30) يوما، ابتداء من تاريخ تسلمه إياه.
    غير أنه إذا أخطرت سلطة من السلطات المنصوص عليها في المادة 166 الآتية، المجلس الدستوري، قبل صدور القانون، يوقف هذا الأجل حتى يفصل في ذلك المجلس الدستوري وفق الشروط التي تحددها المادة 167 الآتية.
    المادة 127 : يمكن لرئيس الجمهورية أن يطلب إجراء مداولة ثانية في قانون تم التصويت عليه في غضون الثلاثين (30) يوما الموالية لتاريخ إقراره.
    وفي هذه الحالة لا يتم إقرار القانون إلا بأغلبية ثلثي (2/3) أعضاء المجلس الشعبي الوطني.
    المادة 128 : يمكن رئيس الجمهورية أن يوجه خطابا إلى البرلمان.
    المادة 129 : يمكن رئيس الجمهورية أن يقرر حل المجلس الشعبي الوطني، أو إجراء انتخابات تشريعية قبل أوانها، بعد استشارة رئيس المجلس الشعبي الوطني، ورئيس مجلس الأمة، ورئيس الحكومة.
    وتجري هذه الانتخابات في كلتا الحالتين في أجل أقصاه ثلاثة أشهر.
    المادة 130 : يمكن البرلمان أن يفتح مناقشة حول السياسة الخارجية بناء على طلب رئيس الجمهورية أو رئيس إحدى الغرفتين.
    يمكن أن تتوج هذه المناقشة، عند الاقتضاء، بإصدار البرلمان، المنعقد بغرفتيه المجتمعتين معا، لائحة يبلغها إلى رئيس الجمهورية.
    المادة 131 : يصادق رئيس الجمهورية على اتفاقيات الهدنة، ومعاهدات السلم والتحالف والاتحاد والمعاهدات المتعلقة بحدود الدولة، والمعاهدات المتعلقة بقانون الأشخاص، والمعاهدات التي تترتب عليها نفقات غير واردة في ميزانية الدولة، بعد أن توافق عليها كل غرفة من البرلمان صراحة.
    المادة 132 : المعاهدات التي يصادق عليها رئيس الجمهورية، حسب الشروط المنصوص عليها في الدستور، تسمو على القانون.
    المادة 133 : يمكن أعضاء البرلمان استجواب الحكومة في إحدى قضايا الساعة.
    يمكن لجان البرلمان أن تستمع إلى أعضاء الحكومة.
    المادة 134 : يمكن أعضاء البرلمان أن يوجهوا أي سؤال شفوي أو كتابي إلى أي عضو في الحكومة.
    ويكون الجواب عن السؤال الكتابي كتابيا، خلال أجل أقصاه ثلاثون (30) يوما.
    وتتم الإجابة عن الأسئلة الشفوية في جلسات المجلس.
    إذا رأت أي من الغرفتين أن جواب عضو الحكومة، شفويا كان أو كتابيا، يبرر إجراء مناقشة، تجري المناقشة حسب الشروط التي ينص عليها النظام الداخلي للمجلس الشعبي الوطني ومجلس الأمة.
    تنشر الأسئلة والأجوبة طبقا للشروط التي يخضع لها نشر محاضر مناقشات البرلمان.
    المادة 135 : يمكن المجلس الشعبي الوطني لدى مناقشته بيان السياسة العامة، أن يصوت على ملتمس رقابة ينصب على مسؤولية الحكومة.
    ولا يقبل هذا الملتمس إلا إذا وقعه سبع (1/7) عدد النواب على الأقل.
    المادة 136 : تتم الموافقة على ملتمس الرقابة بتصويت أغلبية ثلثي (2/3) النواب.
    ولا يتم التصويت إلا بعد ثلاثة (03) أيام من تاريخ إيداع ملتمس الرقابة.
    المادة 137 : إذا صادق المجلس الشعبي الوطني على ملتمس الرقابة، يقدم رئيس الحكومة استقالة حكومته إلى رئيس الجمهورية.

    الفصل الثالث
    السلطة القضائية

    المادة 138 : السلطة القضائية مستقلة، وتمارس في إطار القانون.
    المادة 139 : تحمي السلطة القضائية المجتمع والحريات، وتضمن للجميع ولكل واحد المحافظة على حقوقهم الأساسية.
    المادة 140 : أساس القضاء مبادئ الشرعية والمساواة.
    الكل سواسية أمام القضاء، وهو في متناول الجميع ويجسده احترام القانون.
    المادة 141 : يصدر القضاء أحكامه باسم الشعب.
    المادة 142 : تخضع العقوبات الجزائية إلى مبدأي الشرعية والشخصية.
    المادة 143 : ينظر القضاء في الطعن في قرارات السلطات الإدارية.
    المادة 144 : تعلل الأحكام القضائية، وينطق بها في جلسات علانية.
    المادة 145 : على كل أجهزة الدولة المختصة أن تقوم، في كل وقت وفي كل مكان، وفي جميع الظروف، بتنفيذ أحكام القضاء.
    المادة 146 : يختص القضاة بإصدار الأحكام.
    ويمكن أن يعينهم في ذلك مساعدون شعبيّون حسب الشروط التي يحددها القانون.
    المادة 147 : لا يخضع القاضي إلا للقانون.
    المادة 148 :القاضي محمي من كل أشكال الضغوط والتدخلات والمناورات التي قد تضر بأداء مهمته، أو تمس نزاهة حكمه.
    المادة 149 : القاضي مسؤول أمام المجلس الأعلى للقضاء عن كيفية قيامه بمهمته، حسب الأشكال المنصوص عليها في القانون.
    المادة 150 : يحمي القانون المتقاضي من أي تعسف أو أي انحراف يصدر من القاضي.
    المادة 151 : الحق في الدفاع معترف به.
    الحق في الدفاع مضمون في القضايا الجزائية.
    المادة 152 : تمثل المحكمة العليا الهيئة المقومة لأعمال المجالس القضائية والمحاكم.
    يؤسس مجلس دولة كهيئة مقومة لأعمال الجهات القضائية الإدارية.
    تضمن المحكمة العليا ومجلس الدولة توحيد الاجتهاد القضائي في جميع أنحاء البلاد ويسهران على احترام القانون.
    تؤسس محكمة تنازع تتولى الفصل في حالات تنازع الاختصاص بين المحكمة العليا ومجلس الدولة.
    المادة 153 : يحدد قانون عضوي تنظيم المحكمة العليا، ومجلس الدولة، ومحكمة التنازع، وعملهم، واختصاصاتهم الأخرى.
    المادة 154 : يرأس رئيس الجمهورية، المجلس الأعلى للقضاء.
    المادة 155 : يقرر المجلس الأعلى للقضاء، طبقا للشروط التي يحددها القانون، تعيين القضاة، ونقلهم، وسير سلّمهم الوظيفي.
    ويسهر على احترام أحكام القانون الأساسي للقضاء، وعلى رقابة انضباط القضاة تحت رئاسة الرئيس الأول للمحكمة العليا.
    المادة 156 : يبدي المجلس الأعلى للقضاء رأيا استشاريا قبليا في ممارسة رئيس الجمهورية حق العفو.
    المادة 157 : يحدد قانون عضوي تشكيل المجلس الأعلى للقضاء، وعمله، وصلاحياته الأخرى.
    المادة 158 : تؤسس محكمة عليا للدولة، تختص بمحاكمة رئيس الجمهورية عن الأفعال التي يمكن وصفها بالخيانة العظمى، ورئيس الحكومة عن الجنايات والجنح، التي يرتكبانها بمناسبة تأديتهما لمهامهما.
    يحدد قانون عضوي تشكيلة المحكمة العليا للدولة وتنظيمها وسيرها وكذلك الإجراءات المطبقة.

    الباب الثالث
    الرقابة والمؤسسات الاستشارية

    الفصل الأول
    الرقابة

    المادة 159 : تضطلع المجالس المنتخبة بوظيفة الرقابة في مدلولها الشعبي.
    المادة 160 : تقدم الحكومة لكل غرفة من البرلمان عرضا عن استعمال الاعتمادات المالية التي أقرتها لكل سنة مالية.
    تختتم السنة المالية فيما يخص البرلمان، بالتصويت على قانون يتضمن تسوية ميزانية السنة المالية المعنية من قبل كل غرفة من البرلمان.
    المادة 161 : يمكن كل غرفة من البرلمان، في إطار اختصاصاتها، أن تنشئ في أي وقت لجان تحقيق في قضايا ذات مصلحة عامة.
    المادة 162 : المؤسسات الدستورية وأجهزة الرقابة مكلّفة بالتحقيق في تطابق العمل التشريعي والتنفيذي مع الدستور، في ظروف استخدام الوسائل المادية والأموال العمومية وتسييرها.
    المادة 163 : يؤسس مجلس دستوري يكلف بالسهر على احترام الدستور.
    كما يسهر المجلس الدستوري على صحة عمليات الاستفتاء، وانتخاب رئيس الجمهورية، والانتخابات التشريعية، ويعلن نتائج هذه العمليات.
    المادة 164 : يتكون المجلس الدستوري من تسعة (09) أعضاء : ثلاثة (03) أعضاء من بينهم رئيس المجلس يعينهم رئيس الجمهورية، واثنان (02) ينتخبهما المجلس الشعبي الوطني، واثنان (02) ينتخبهما مجلس الأمة، وعضو واحد (01) تنتخبه المحكمة العليا، وعضو واحد (01) ينتخبه مجلس الدولة.
    بمجرد انتخاب أعضاء المجلس الدستوري أو تعيينهم، يتوقفون عن ممارسة أي عضوية أو أي وظيفة أو تكليف أو مهمة أخرى.
    يعين رئيس الجمهورية رئيس المجلس الدستوري لفترة واحدة مدتها ست (06) سنوات.
    يضطلع أعضاء المجلس الدستوري بمهامهم مرة واحدة مدتها ست (06) سنوات، ويجدد نصف عدد أعضاء المجلس الدستوري كل ثلاث (03) سنوات.
    المادة 156 : يفصل المجلس الدستوري، بالإضافة إلى الاختصاصات التي خولتها إياه صراحة أحكام أخرى في الدستور، في دستورية المعاهدات والقوانين، والتنظيمات، إما برأي قبل أن تصبح واجبة التنفيذ، أو بقرار في الحالة العكسية.
    يبدي المجلس الدستوري، بعد أن يخطره رئيس الجمهورية، رأيه وجوبا في دستورية القوانين العضوية بعد أن يصادق عليها البرلمان.
    كما يفصل المجلس الدستوري في مطابقة النظام الداخلي لكل من غرفتي البرلمان للدستور، حسب الإجراءات المذكورة في الفقرة السابقة.
    المادة 166 : يخطر رئيس الجمهورية أو رئيس المجلس الشعبي الوطني أو رئيس مجلس الأمة، المجلس الدستوري.
    المادة 167 : يتداول المجلس الدستوري في جلسة مغلقة، ويعطي رأيه أو يصدر قراره في ظرف العشرين(20)يوما الموالية لتاريخ الإخطار.
    يحدد المجلس الدستوري قواعد عمله.
    المادة 168 : إذا ارتأى المجلس الدستوري عدم دستورية معاهدة أو اتفاق، أو اتفاقية، فلا يتم التصديق عليها.
    المادة 169 : إذا ارتأى المجلس الدستوري أن نصا تشريعيا أو تنظيميا غير دستوري، يفقد هذا النص أثره، ابتداء من يوم قرار المجلس.
    المادة 170 : يؤسس مجلس محاسبة يكلف بالرقابة البعدية لأموال الدولة والجماعات الإقليمية والمرافق العمومية.
    يعد مجلس المحاسبة تقريرا سنويا يرفعه إلى رئيس الجمهورية.
    يحدد القانون صلاحية مجلس المحاسبة ويضبط تنظيمه وعمله وجزاء تحقيقاته.

    الفصل الثاني
    المؤسسات الاستشارية

    المادة 171 : يؤسس لدى رئيس الجمهورية مجلس إسلامي أعلى، يتولى على الخصوص ما يأتي:
    ـ الحث على الاجتهاد وترقيته،
    ـ إبداء الحكم الشرعي فيما يعرض عليه،
    ـ رفع تقرير دوري عن نشاطه إلى رئيس الجمهورية.
    المادة 172 : يتكون المجلس الإسلامي الأعلى من خمسة عشر(15) عضوا منهم الرئيس، يعينهم رئيس الجمهورية من بين الكفاءات الوطنية العليا في مختلف العلوم.
    المادة 173 : يؤسس مجلس أعلى للأمن يرأسه رئيس الجمهورية، مهمته تقديم الآراء إلى رئيس الجمهورية في كل القضايا المتعلقة بالأمن الوطني.
    يحدد رئيس الجمهورية كيفيات تنظيم المجلس الأعلى للأمن وعمله.

    الباب الرابع
    التعديل الدستوري

    المادة 174 : لرئيس الجمهورية حق المبادرة بالتعديل الدستوري، وبعد أن يصوت عليه المجلس الشعبي الوطني ومجلس الأمة بنفس الصيغة حسب الشروط نفسها التي تطبق على نص تشريعي، يعرض التعديل على استفتاء الشعب خلال الخمسين(50) يوما الموالية لإقراره.
    يصدر رئيس الجمهورية التعديل الدستوري الذي صادق عليه الشعب.
    المادة 175 : يصبح القانون الذي يتضمن مشروع التعديل الدستوري لاغيا، إذا رفضه الشعب.
    ولا يمكن عرضه من جديد على الشعب خلال الفترة التشريعية
    المادة 176 : إذا ارتأى المجلس الدستوري أن مشروع أي تعديل دستوري لا يمس البتة المبادئ العامة التي تحكم المجتمع الجزائري، وحقوق الإنسان والمواطن وحرياتهما، ولا يمس بأي كيفية التوازنات الأساسية للسلطات والمؤسسات الدستورية، وعلل رأيه، أمكن رئيس الجمهورية أن يصدر القانون الذي يتضمن التعديل الدستوري مباشرة دون أن يعرضه على الاستفتاء الشعبي، متى أحرز ثلاثة أرباع(3/4) أصوات أعضاء غرفتي البرلمان.
    المادة 177: يمكن ثلاثة أرباع(3/4) أعضاء غرفتي البرلمان المجتمعين معا، أن يبادروا باقتراح تعديل الدستور على رئيس الجمهورية الذي يمكنه عرضه على الاستفتاء الشعبي ويصدره في حالة الموافقة عليه.
    المادة 178 : لا يمكن أي تعديل دستوري أن يمس :
    1ـ الطابع الجمهوري للدولة،
    2ـ النظام الديمقراطي القائم على التعددية الحزبية،
    3ـ الإسلام باعتباره دين الدولة،
    4ـ العربية باعتبارها اللغة الوطنية و الرسمية،
    5ـ الحريات الأساسية وحقوق الإنسان والمواطن،
    6ـ سلامة التراب الوطني ووحدته.

    أحكام انتقالية

    المادة 179 : تتولى الهيئة التشريعية القائمة عند إصدار هذا الدستور وإلى غاية انتهاء مهمتها وكذا رئيس الجمهورية بعد انتهاء هذه المهمة وإلى غاية انتخاب المجلس الشعبي الوطني ،مهمة التشريع بأوامر بما في ذلك المسائل التي أصبحت تدخل ضمن القوانين العضوية.
    المادة 180 : ريثما يتم تنصيب المؤسسات المنصوص عليها في هذا الدستور :
    ـ يستمر سريان مفعول القوانين التي تتعلق بالمواضيع التي تخضع لمجال القوانين العضوية،إلى أن تعدل أو تستبدل وفق الإجراءات المنصوص عليها في الدستور ،
    ـ يمارس المجلس الدستوري بتمثيله الحالي الاختصاصات المسندة إليه بموجب هذا الدستور، حتى تاريخ تنصيب المؤسسات الممثلة فيه. وكل تغيير أو إضافة بجب أن يتم مع مراعاة الفقرة 3 من المادة 164 من هذا الدستور، مع استعمال القرعة عند الحاجة،
    ـ يمارس المجلس الشعبي الوطني المنتخب السلطة التشريعية كاملة حتى تنصيب مجلس الأمة. ويمكن رئيس الجمهورية وقف إصدار القوانين المتخذة بمبادرة من النواب إلى غاية المصادقة عليها من قبل مجلس الأمة.
    المادة 181 : يجدد نصف(1/2) عدد أعضاء مجلس الأمة أثناء مدة العضوية الأولى عقب السنة الثالثة عن طريق القرعة.ويستخلف أعضاء مجلس الأمة الذين وقعت عليهم القرعة وفق الشروط نفسها وحسب الإجراء نفسه المعمول به في انتخابهم أو تعيينهم.
    لا تشمل القرعة رئيس مجلس الأمة الذي يمارس العهدة الأولى مدة ست(6) سنوات.
    المادة 182 : يصدر رئيس الجمهورية نص التعديل الدستوري الذي أقره الشعب، وينفذ كقانون أساسي للجمهورية

    <p>PR&Eacute;AMBULE </p><p>Le peuple algérien est un peuple libre, décidé à le demeurer.</p><p>Son histoire est une longue chaîne de luttes qui ont fait de l’Algérie de toujours une terre de liberté et de dignité.</p><p>Placée au cœur des grands moments qu’a connus la Méditerranée au cours de son histoire, l’Algérie a su trouver dans ses fils, depuis le royaume numide et l’épopée de l’Islam jusqu’aux guerres coloniales, les héros de la liberté, de l’unité et du progrès, en même temps que les bâtisseurs d’Etats démocratiques et prospères dans les périodes de grandeur et de paix.</p><p>Le 1er novembre 1954 aura été un des sommets de son destin, aboutissement d’une longue résistance aux agressions menées contre sa culture, ses valeurs et les composantes fondamentales de son identité que sont l’Islam, l’Arabité et l’Amazighité, le 1er novembre aura solidement ancré les luttes présentes dans le passé glorieux de la Nation.</p><p>Réuni dans le mouvement national puis au sein du Front de Libération Nationale, le peuple a versé son sang pour assumer son destin collectif dans la liberté et l’identité culturelle retrouvées et se doter d’institutions authentiquement populaires.</p><p>Couronnant la guerre populaire par une indépendance payée du sacrifice des meilleurs de ses enfants, le Front de Libération Nationale restaure enfin, dans toute sa plénitude, un Etat moderne et souverain.</p><p>Sa foi dans les choix collectifs a permis au peuple de remporter des victoires décisives, marquées par la récupération des richesses nationales et la construction d’un Etat à son service exclusif, exerçant ses pouvoirs en toute indépendance et à l’abri de toute pression extérieure.</p><p>Ayant toujours milité pour la liberté et la démocratie, le peuple entend, par cette Constitution, se doter d’institutions fondées sur la participation des citoyens à la gestion des affaires publiques et qui réalisent la justice sociale, l’égalité et la liberté de chacun et de tous.</p><p>En approuvant cette Constitution, œuvre de son génie propre, reflet de ses aspirations, fruit de sa détermination et produit de mutations sociales profondes, le peuple entend ainsi consacrer plus solennellement que jamais la primauté du droit.</p><p>La Constitution est au-dessus de tous, elle est la loi fondamentale qui garantit les droits et libertés individuels et collectifs, protège la règle du libre choix du peuple et confère la légitimité à l’exercice des pouvoirs. Elle est une et indivisible.</p><p>Article 2 : L'Islam est la religion de l'état. </p><p>Article 3 : L'Arabe est la langue nationale et officielle.</p><p>Article 4 : La capitale de la République est ALGER. </p><p>Article 5 : L'emblème national, le sceau de l'état et l'hymne national sont définis par la loi. </p><p>CHAPITRE II: DU PEUPLE<br />Article 6 : Le peuple est la source de tout pouvoir.<br />La souveraineté nationale appartient exclusivement au peuple.</p><p>Article 7 : Le pouvoir constituant appartient au peuple.<br />Le peuple exerce sa souveraineté par l'intermédiaire des institutions qu'il se donne.<br />Le peuple l'exerce par voie de référendum et par l'intermédiaire de ses représentants élus.<br />Le Président de la République peut directement recourir à l'expression de la volonté du peuple. </p><p>Article 8 : Le peuple se donne des institutions ayant pour finalité : <br />- La sauvegarde et la consolidation de l'indépendance nationale,<br />- La sauvegarde et la consolidation de l'identité et de l'unité nationales,<br />- La protection des libertés fondamentales du citoyen et l'épanouissement social et<br />  culturel de la Nation,<br />- La suppression de l'exploitation de l'homme par l'homme,<br />- La protection de l'économie nationale contre toute forme de malversation ou de<br />  détournement, d'accaparement ou de confiscation illégitime.</p><p>Article 9 : Les institutions s'interdisent: <br />- les pratiques féodales, régionalistes et népotiques,<br />- l'établissement de rapports d'exploitation et de liens de dépendance,<br />- les pratiques contraires à la morale islamique et aux valeurs de la Révolution de<br />  Novembre.</p><p>Article 10 : Le peuple choisit librement ses représentants.<br />La représentation du peuple n'a d'autres limites que celles fixées par la Constitution et la loi électorale. </p><p>Chapitre III: DE L'ETAT<br />Article 11 : L'état puise sa légitimité et sa raison d'être dans la volonté du peuple.<br />Sa devise est "Par le Peuple et pour le Peuple".<br />Il est au service exclusif du peuple.</p><p>Article 12 : La souveraineté de l'état s'exerce sur son espace terrestre, son espace aérien et ses eaux.<br />L'état exerce également son droit souverain établi par le droit international sur chacune des différentes zones de l'espace maritime qui lui reviennent. </p><p>Article 13 : En aucun cas, il ne peut être abandonné ou aliéné une partie du territoire national. </p><p>Article 14 : L'état est fondé sur les principes d'organisation démocratique et de justice sociale.<br />L'assemblée élue constitue le cadre dans lequel s'exprime la volonté du peuple et s'exerce le contrôle de l'action des pouvoirs publics. </p><p>Article 15 : Les collectivités territoriales de l'état sont la Commune et la Wilaya.<br />La Commune est la collectivité de base. </p><p>Article 16 : L'assemblée élue constitue l'assise de la décentralisation et le lieu de la participation des citoyens à la gestion des affaires publiques. </p><p>Article 17 : La propriété publique est un bien de la collectivité nationale. Elle comprend le sous-sol, les mines et les carrières, les sources naturelles d'énergie, les richesses minérales, naturelles et vivantes des différentes zones du domaine maritime national, les eaux et les forêts.<br />Elle est, en outre, établie sur les transports ferroviaires, maritimes et aériens, les postes et les télécommunications, ainsi que sur d'autres biens fixés par la loi. </p><p>Article 18 : Le domaine national est défini par la loi.<br />Il comprend les domaines public et privé de l'état, de la Wilaya et de la Commune.<br />La gestion du domaine national s'effectue conformément à la loi. </p><p>Article 19 : L'organisation du commerce extérieur relève de la compétence de l'état.<br />La loi détermine les conditions d'exercice et de contrôle du commerce extérieur. </p><p>Article 20 : L'expropriation ne peut intervenir que dans le cadre de la loi.<br />Elle donne lieu à une indemnité préalable, juste et équitable. </p><p>Article 21 : Les fonctions au service des institutions de l'état ne peuvent constituer une source d'enrichissement, ni un moyen de servir des intérêts privés. </p><p>Article 22 : L'abus d'autorité est réprimé par la loi. </p><p>Article 23 : L'impartialité de l'administration est garantie par la loi. </p><p>Article 24 : L'état est responsable de la sécurité des personnes et des biens. Il assure la protection de tout citoyen à l'étranger. </p><p>Article 25 : La consolidation et le développement du potentiel de défense de la Nation s'organisent autour de l'armée Nationale Populaire. <br />- L'armée Nationale Populaire a pour mission permanente la sauvegarde de l'indépendance nationale et la défense de la souveraineté nationale.<br />- Elle est chargée d'assurer la défense de l'unité et de l'intégrité territoriale du pays, ainsi que la protection de son espace terrestre, de son espace aérien et des différentes zones de son domaine maritime.</p><p>Article 26 : L'Algérie se défend de recourir à la guerre pour porter atteinte à la souveraineté légitime et à la liberté d'autres peuples.<br />Elle s'efforce de régler les différends internationaux par des moyens pacifiques. </p><p>Article 27 : L'Algérie est solidaire de tous les peuples qui luttent pour la libération politique et économique, pour le droit à l'autodétermination et contre toute discrimination raciale. </p><p>Article 28 : L'Algérie œuvre au renforcement de la coopération internationale et au développement des relations amicales entre les Etats, sur la base de l'égalité, de l'intérêt mutuel et de la non-ingérence dans les affaires intérieures. Elle souscrit aux principes et objectifs de la Charte des Nations Unies. </p><p>CHAPITRE IV : DES DROITS ET DES LIBERTES<br />Article 29 : Les citoyens sont égaux devant la loi, sans que puisse prévaloir aucune discrimination pour cause de naissance, de race, de sexe, d'opinion ou de toute autre condition ou circonstance personnelle ou sociale.</p><p>Article 30 : La nationalité algérienne est définie par la loi.<br />Les conditions d'acquisition, de conservation, de perte et de déchéance de la nationalité algérienne sont déterminées par la loi. </p><p>Article 31 : Les institutions ont pour finalité d'assurer l'égalité en droits et devoirs de tous les citoyens et citoyennes en supprimant les obstacles qui entravent l'épanouissement de la personne humaine et empêchent la participation effective de tous, à la vie politique, économique, sociale et culturelle. </p><p>Article 32 : Les libertés fondamentales et les droits de l'homme et du citoyen sont garantis.<br />Ils constituent le patrimoine commun de tous les Algériens et Algériennes, qu'ils ont le devoir de transmettre de génération en génération pour le conserver dans son intégrité et son inviolabilité. </p><p>Article 33 : La défense individuelle ou associative des droits fondamentaux de l'homme et des libertés individuelles et collectives est garantie. </p><p>Article 34 : L'état garantit l'inviolabilité de la personne humaine.<br />Toute forme de violence physique ou morale ou d'atteinte à la dignité est proscrite. </p><p>Article 35 : Les infractions commises à l'encontre des droits et libertés, ainsi que les atteintes physiques ou morales à l'intégrité de l'être humain sont réprimées par la loi. </p><p>Article 36 : La liberté de conscience et la liberté d'opinion sont inviolables. </p><p>Article 37 : La liberté du commerce et de l'industrie est garantie. Elle s'exerce dans le cadre de la loi. </p><p>Article 38 : La liberté de création intellectuelle, artistique et scientifique est garantie au citoyen. <br />- Les droits d'auteur sont protégés par la loi.<br />- La mise sous séquestre de toute publication, enregistrement ou tout autre moyen de<br />  communication et d'information ne pourra se faire qu'en vertu d'un mandat judiciaire.</p><p>Article 39 : La vie privée et l'honneur du citoyen sont inviolables et protégés par la loi.<br />Le secret de la correspondance et de la communication privées, sous toutes leurs formes, est garanti. </p><p>Article 40 : L'état garantit l'inviolabilité du domicile. <br />- Nulle perquisition ne peut avoir lieu qu'en vertu de la loi et dans le respect de celle-ci.<br />- La perquisition ne peut intervenir que sur ordre écrit émanant de l'autorité judiciaire<br />  compétente.</p><p>Article 41 : Les libertés d'expression, d'association et de réunion sont garanties au citoyen. </p><p>Article 42 : Le droit de créer des partis politiques est reconnu et garanti. <br />Ce droit ne peut toutefois être invoqué pour attenter aux libertés fondamentales, aux valeurs et aux composantes fondamentales de l'identité nationale, à l'unité nationale, à la sécurité et à l'intégrité du territoire national, à l'indépendance du pays et à la souveraineté du peuple ainsi qu'au caractère démocratique et républicain de l'état.</p><p>Dans le respect des dispositions de la présente Constitution, les partis politiques ne peuvent être fondés sur une base religieuse, linguistique, raciale, de sexe, corporatiste ou régionale.</p><p>Les partis politiques ne peuvent recourir à la propagande partisane portant sur les éléments mentionnés à l'alinéa précédent.</p><p>Toute obédience des partis politiques, sous quelle que forme que ce soit à des intérêts ou parties étrangers est proscrite.</p><p>Aucun parti politique ne peut recourir à la violence ou à la contrainte, quelles que soient la nature ou les formes de celles-ci.</p><p>D'autres obligations et devoirs sont prescrits par la loi.</p><p>Article 43 : Le droit de créer des associations est garanti. <br />- L'état encourage l'épanouissement du mouvement associatif.<br />- La loi détermine les conditions et les modalités de création des associations.</p><p>Article 44 : Tout citoyen jouissant de ses droits civils et politiques a le droit de choisir librement le lieu de sa résidence et de circuler sur le territoire national.<br />Le droit d'entrée et de sortie du territoire national lui est garanti. </p><p>Article 45 : Toute personne est présumée innocente jusqu'à l'établissement de sa culpabilité par une juridiction régulière et avec toutes les garanties exigées par la loi. </p><p>Article 46 : Nul ne peut être tenu pour coupable si ce n'est en vertu d'une loi dûment promulguée antérieurement à l'acte incriminé. </p><p>Article 47 : Nul ne peut être poursuivi, arrêté ou détenu que dans les cas déterminés par la loi et selon les formes qu'elle a prescrites. </p><p>Article 48 : En matière d'enquête pénale, la garde à vue est soumise au contrôle judiciaire et ne peut excéder quarante-huit (48) heures. </p><p>- La personne gardée à vue a le droit d'entrer immédiatement en contact avec sa<br />  famille.<br />- La prolongation du délai de garde à vue ne peut avoir lieu, exceptionnellement, que<br />  dans les conditions fixées par la loi.<br />- A l'expiration du délai de garde à vue, il est obligatoirement procédé à l'examen<br />  médical de la personne retenue si celle-ci le demande, et dans tous les cas, elle est<br />  informée de cette faculté.</p><p>Article 49 : L'erreur judiciaire entraîne réparation par l'état.<br />La loi détermine les conditions et modalités de la réparation. </p><p>Article 50 : Tout citoyen remplissant les conditions légales est électeur et éligible.   </p><p>Article 51 : L'égal accès aux fonctions et aux emplois au sein de l'état est garanti à tous les citoyens, sans autres conditions que celles fixées par la loi. </p><p>Article 52 : La propriété privée est garantie. <br />- Le droit d'héritage est garanti.<br />- Les biens "wakf" et les fondations sont reconnus; leur destination est protégée par la<br />  loi.</p><p>Article 53 : Le droit à l'enseignement est garanti. L'enseignement est gratuit dans les conditions fixées par la loi. </p><p>- L'enseignement fondamental est obligatoire.<br />- L'état organise le système d'enseignement.<br />- L'état veille à l'égal accès à l'enseignement et à la formation professionnelle.</p><p>Article 54 : Tous les citoyens ont droit à la protection de leur santé.<br />L'état assure la prévention et la lutte contre les maladies épidémiques et endémiques. </p><p>Article 55 : Tous les citoyens ont droit au travail. Le droit à la protection, à la sécurité et à l'hygiène dans le travail est garanti par la loi.<br />Le droit au repos est garanti; La loi en détermine les modalités d'exercice. </p><p>Article 56 : Le droit syndical est reconnu à tous les citoyens. </p><p>Article 57 : Le droit de grève est reconnu. Il s'exerce dans le cadre de la loi.<br />Celle-ci peut en interdire ou en limiter l'exercice dans les domaines de défense nationale et de sécurité, ou pour tous services ou activités publics d'intérêt vital pour la communauté. </p><p>Article 58 : La famille bénéficie de la protection de l'Etat et de la société.  </p><p>Article 59 : Les conditions de vie des citoyens qui ne peuvent pas encore, qui ne peuvent plus ou qui ne pourront jamais travailler, sont garanties. </p><p>CHAPITRE V : DES DEVOIRS<br />Article 60 : Nul n'est censé ignorer la loi.<br />Toute personne est tenue de respecter la Constitution et de se conformer aux lois de la République.</p><p>Article 61 : Tout citoyen a le devoir de protéger et de sauvegarder l'indépendance du pays, sa souveraineté et l'intégrité de son territoire national, ainsi que tous les attributs de l'Etat.<br />La trahison, l'espionnage, le passage à l'ennemi, ainsi que toutes les infractions commises au préjudice de la sécurité de l'Etat sont réprimés avec toute la rigueur de la loi.  </p><p>Article 62 : Tout citoyen doit remplir loyalement ses obligations vis-à-vis de la collectivité nationale. <br />- L'engagement du citoyen envers la Patrie et l'obligation de contribuer à sa défense,<br />  constituent des devoirs sacrés et permanents.<br />- L'Etat garantit le respect des symboles de la Révolution, la mémoire des chouhada et<br />  la dignité de leurs ayants-droit et des moudjahidine. </p><p>Article 63 : L'ensemble des libertés de chacun s'exerce dans le respect des droits reconnus à autrui par la Constitution, particulièrement dans le respect du droit à l'honneur, à l'intimité et à la protection de la famille, à celle de la jeunesse et de l'enfance. </p><p>Article 64 : Les citoyens sont égaux devant l'impôt. <br />- Chacun doit participer au financement des charges publiques en fonction de sa<br />   capacité contributive.<br />- Nul impôt ne peut être institué qu'en vertu de la loi.<br />- Nul impôt, contribution, taxe ou droit d'aucune sorte, ne peut être institué avec effet<br />  rétroactif. </p><p>Article 65 : La loi sanctionne le devoir des parents dans l'éducation et la protection de leurs enfants, ainsi que le devoir des enfants dans l'aide et l'assistance à leurs parents.  </p><p>Article 66 : Tout citoyen a le devoir de protéger la propriété publique et les intérêts de la collectivité nationale, et de respecter la propriété d'autrui.  </p><p>Article 67 : Tout étranger qui se trouve légalement sur le territoire national jouit, pour sa personne et pour ses biens de la protection de la loi.  </p><p>Article 68 : Nul ne peut être extradé si ce n'est en vertu et en application de la loi d'extradition. </p><p>Article 69 : En aucun cas, un réfugié politique bénéficiant légalement du droit d'asile, ne peut être livré ou extradé.</p><p>TITRE DEUXIEME :<br />DE L’ORGANISATION DES POUVOIRS </p><p>CHAPITRE I : DU POUVOIR EXECUTIF<br />Article 70 : Le Président de la République, chef de l’Etat, incarne l’unité de la Nation.<br />Il est garant de la Constitution.<br />Il incarne l’Etat dans le pays et à l’étranger.<br />Il s’adresse directement à la Nation. </p><p>: : Le Président de la République, chef de l’Etat, incarne l’unité de la Nation.Il est garant de la Constitution.Il incarne l’Etat dans le pays et à l’étranger.Il s’adresse directement à la Nation. <br />Article 71 : Le Président de la République est élu au suffrage universel, direct et secret.<br />L’élection est acquise à la majorité absolue des suffrages exprimés.<br />Les autres modalités de l’élection présidentielle sont fixées par la loi. </p><p>Article 72 : Le Président de la République exerce la magistrature suprême dans les limites fixées par la Constitution. </p><p>Article 73 : Pour être éligible à la Présidence de la République, le candidat doit:<br />- Jouir uniquement de la nationalité algérienne d’origine;<br />- être de confession musulmane;<br />- avoir quarante (40) ans révolus au jour de l’élection;<br />- jouir de la plénitude de ses droits civils et politiques;<br />- attester de la nationalité algérienne du conjoint;<br />- justifier de la participation à la Révolution du 1er Novembre 1954 pour les candidats<br />  nés avant juillet 1942;<br />- justifier de la non - implication des parents du candidat né après juillet 1942, dans<br />  des actes hostiles à la Révolution du 1er Novembre 1954;<br />- produire la déclaration publique du patrimoine mobilier et immobilier, tant à l’intérieur<br />  qu’à l’extérieur de l’Algérie.<br />D’autres conditions sont prescrites par la loi. </p><p>Article 74 : La durée du mandat présidentiel est de cinq (5) ans.<br />Le Président de la République est rééligible une seule fois. </p><p>Article 75 : Le Président de la République prête serment devant le peuple et en présence de toutes les hautes instances de la Nation, dans la semaine qui suit son élection.<br />Il entre en fonction aussitôt après sa prestation de serment. </p><p>Article 76 : Le Président de la République prête serment dans les termes ci-après :<br />" Fidèle au sacrifice suprême et à la mémoire sacrée de nos martys ainsi qu’aux idéaux de la Révolution de Novembre éternelle, je jure par Dieu Tout–Puissant de respecter et de glorifier la religion islamique, de défendre la Constitution, de veiller à la continuité de l’Etat, de réunir les conditions nécessaires au fonctionnement normal des institutions et de l’ordre constitutionnel, d’oeuver au renforcement du processus démocratique, de respecter le libre choix du peuple, ainsi que les institutions et lois de la République, de préserver l’intégrité du territoire national, l’unité du peuple et de la nation, de protéger les libertés et droits fondamentaux de l’homme et du citoyen, de travailler sans relâche au développement et à la prospérité du peuple et d’oeuvrer de toutes mes forces à la réalisation des grands idéaux de justice, de liberté et de paix dans la monde<br />Dieu en est témoin".</p><p>Article 77 : Outre les pouvoirs que lui confèrent expressément d’autres dispositions de la Constitution, le Président de la République jouit des pouvoirs et prérogatives suivants :</p><p>1- il est le Chef suprême de toutes les Forces Armées de la République;<br />2- il est responsable de la Défense Nationale;<br />3- il arrête et conduit la politique extérieure de la Nation;<br />4- il préside le Conseil des Ministres;<br />5- il nomme le Chef du Gouvernement et met fin à ses fonctions;<br />6- il signe les décrets présidentiels;<br />7- il dispose du droit de grâce, du droit de remise ou de commutation de peine;<br />8- il peut, sur toute question d’importance nationale, saisir le peuple par voie de<br />    référendum;<br />9- il conclut et ratifie les traités internationaux;<br />10- il décerne les décorations, distinctions et titres honorifiques d’Etat. </p><p>Article 78 : Le Président de la République nomme :<br />1- aux emplois et mandats prévus par la Constitution;<br />2- aux emplois civils et militaires de l’Etat;<br />3- aux désignations arrêtées en Conseil des Ministres;<br />4- le Président du Conseil d’Etat;<br />5- le Secrétaire Général du Gouvernement;<br />6- le Gouverneur de la Banque d’Algérie;<br />7- les Magistrats;<br />8- les responsables des organes de sécurité ;<br />9- les Walis.<br />Le Président de la République nomme et rappelle les ambassadeurs et les envoyés extraordinaires de la République à l’étranger. Il reçoit les lettres de créance et de rappel des représentants diplomatiques étrangers. </p><p>Article 79 : Le chef du Gouvernement présente les membres du Gouvernement qu’il choisit au Président de la République qui les nomme.<br />Le Chef du Gouvernement arrête son programme qu’il présente en Conseil des Ministres. </p><p>Article 80 : Le chef du Gouvernement soumet son programme à l’approbation de l’assemblée Populaire Nationale. Celle-ci ouvre à cet effet un débat général.<br />Le chef du Gouvernement peut adapter son programme à la lumière de ce débat.<br />Le Chef du Gouvernement présente au Conseil de la Nation une communication sur son programme.<br />Le Conseil de la Nation peut émettre une résolution. </p><p>Article 81 : En cas de non approbation de son programme par l’assemblée Populaire Nationale, le chef du Gouvernement présente la démission de son Gouvernement au Président de la République.<br />Celui-ci nomme à nouveau un chef du Gouvernement selon les mêmes modalités. </p><p>Article 82 : Si l’approbation de l’assemblée Populaire Nationale n’est de nouveau pas obtenue, l’assemblée Populaire Nationale est dissoute de plein droit.<br />Le Gouvernement en place est maintenu pour gérer les affaires courantes, jusqu’à l’élection d’une nouvelle assemblée Populaire Nationale qui doit intervenir dans un délai maximal de trois (3) mois. </p><p>Article 83 : Le chef du Gouvernement exécute et coordonne le programme adopté par l’assemblée Populaire Nationale. </p><p>Article 84 : Le Gouvernement présente annuellement à l’assemblée Populaire Nationale, une déclaration de politique générale.<br />La déclaration de politique générale donne lieu à débat sur l’action du Gouvernement.<br />Ce débat peut s’achever par une résolution.<br />Il peut également donner lieu au dépôt d’une motion de censure par l’assemblée Populaire Nationale, conformément aux dispositions des articles 135, 136 et 137 ci-dessous.<br />Le chef du Gouvernement peut demander à l’assemblée Populaire Nationale un vote de confiance. Si la motion de confiance n’est pas votée, le chef du Gouvernement présente la démission de son Gouvernement.<br />Dans ce cas le Président de la République, peut avant l’acceptation de la démission, faire usage des dispositions de l’article 129 ci-dessous.<br />Le Gouvernement peut également présenter au Conseil de la Nation une déclaration de politique générale. </p><p>Article 85 : Outre les pouvoirs que lui confère expressément d’autres dispositions de la Constitution, le chef du Gouvernement exerce les attributions suivantes :<br />1- il répartit les attributions entre les membres du Gouvernement, dans le respect des dispositions constitutionnelles ;<br />2- il préside le Conseil du Gouvernement ;<br />3- il veille à l’exécution des lois et règlements ;<br />4- il signe les décrets exécutifs ;<br />5- il nomme aux emplois de l’Etat, sans préjudice des dispositions des articles 77 et 78<br />    ci-dessus;<br />6- il veille au bon fonctionnement de l’administration publique. </p><p>Article 86 : Le chef du Gouvernement peut présenter au Président de la République la démission de son Gouvernement.</p><p>Article 87 : Le Président de la République ne peut, en aucun cas, déléguer le pouvoir de nommer le chef du Gouvernement, les membres du Gouvernement, ainsi que les Présidents et membres des institutions constitutionnelles pour lesquels un autre mode de désignation n’est pas prévu par la Constitution.<br />De même, il ne peut déléguer son pouvoir de recourir au référendum, de dissoudre l’assemblée Populaire Nationale, de décider des élections législatives anticipées, de mettre en œuvre les dispositions prévues aux articles 77, 78, 91, 93 et 95, 97, 124, 126, 127 et 128 de la Constitution. </p><p>Article 88 : Lorsque le Président de la République, pour cause de maladie grave et durable, se trouve dans l’impossibilité totale d’exercer ses fonctions, le Conseil Constitutionnel, se réunit de plein droit, et après avoir vérifié la réalité de cet empêchement par tout moyens appropriés, propose, à l’unanimité, au Parlement de déclarer l’état d’empêchement.<br />Le Parlement siégeant en chambres réunies déclare l’état d’empêchement du Président de la République, à la majorité des deux tiers (2/3) de ses membres et charge de l’intérim du Chef de l’Etat, pour une période maximale de quarante cinq ( 45) jours, le Président du Conseil de la Nation, qui exerce ses prérogatives dans le respect des dispositions de l’article 90 de la Constitution.<br />En cas de continuation de l’empêchement à l’expiration du délai de quarante cinq (45) jours, il est procédé à une déclaration de vacance par démission de plein droit, selon la procédure visée aux alinéas ci-dessus et selon les dispositions des alinéas suivants du présent article.<br />En cas de démission ou de décès du Président de la République, le Conseil Constitutionnel se réunit de plein droit et constate la vacance définitive de la Présidence de la République.<br />Il communique immédiatement l’acte de déclaration de vacance définitive au Parlement qui se réunit de plein droit.<br />Le Président du Conseil de la Nation assume la charge de chef de l’Etat pour une durée maximale de soixante (60) jours, au cours de laquelle des élections présidentielles sont organisées.<br />Le Chef de l’Etat, ainsi désigné, ne peut être candidat à la Présidence de la République.<br />En cas de conjonction de la démission ou du décès du Président de la République et de la vacance de la Présidence du Conseil de la Nation, pour quelque cause que ce soit, le Conseil Constitutionnel, se réunit de plein droit et constate à l’unanimité la vacance définitive de la Présidence de la République et l’empêchement du Président du Conseil de la Nation. Dans ce cas, le Président du Conseil Constitutionnel assume la charge de chef de l’Etat dans les conditions fixées aux alinéas précédents du présent article et à l’article 90 de la Constitution . Il ne peut être candidat à la Présidence de la République. </p><p>Article 89 : Lorsque l’un des candidats présents au second tour de l’élection présidentielle décède, se retire ou est empêché par toute autre raison, le Président de la République en exercice ou celui qui assume la fonction de chef de l’Etat demeure en fonction jusqu’à la proclamation de l’élection du Président de la République.<br />Dans ce cas, le Conseil Constitutionnel proroge le délai d’organisation de l’élection pour durée maximale de soixante (60) jours.<br />Une loi organique déterminera les conditions et modalités de mise en œuvre des présentes dispositions. </p><p>Article 90 : Le Gouvernement, en fonction au moment de l’empêchement, du décès ou de la démission du Président de la République, ne peut être démis ou remanié jusqu’à l’entrée en fonction du nouveau Président de la République.<br />Dans le cas où le chef du Gouvernement en fonction, est candidat à la Présidence de la République, il démissionne de plein droit. La fonction de chef du Gouvernement est assumée par un autre membre du Gouvernement désigné par le chef de l’Etat.<br />Pendant les périodes des quarante cinq (45) jours et des soixante (60) jours prévues aux articles 88 et 89, il ne peut être fait application des dispositions prévues aux alinéas 7 et 8 de l’article 77 et aux articles 79, 124, 129, 136, 137, 174, 176 et 177 de la Constitution.<br />Pendant ces mêmes périodes, les dispositions des articles 91, 93, 94, 95 et 97 de la Constitution ne peuvent être mises en œuvre qu’avec l’approbation du Parlement siégeant en chambres réunies, le Conseil Constitutionnel et le Haut Conseil de Sécurité préalablement consultés. </p><p>Article 91 : En cas de nécessité impérieuse, le Haut Conseil de Sécurité réuni, le Président de l’assemblée Populaire Nationale, le Président du Conseil de la Nation, le chef du Gouvernement et le Président du Conseil Constitutionnel consultés, le Président de la République décrète l’état d’urgence ou l’état de siège, pour une durée déterminée et prend toutes les mesures nécessaires au rétablissement de la situation.</p><p>La durée de l’état d’urgence ou de l’état de siège ne peut être prorogée qu’après approbation du Parlement siégeant en chambres réunies. </p><p>Article 92 : L’organisation de l’état d’urgence et de l’état de siège est fixé par une loi organique. </p><p>Article 93 : Lorsque le pays est menacé d’un péril imminent dans ses institutions, dans son indépendance ou dans son intégrité territoriale, le Président de la République décrète l’état d’exception.<br />Une telle mesure est prise, le Président de l’assemblée Populaire Nationale, le Président du Conseil de la Nation et le Conseil Constitutionnel consultés, le Haut Conseil de Sécurité et le Conseil des Ministres entendus.<br />L’état d’exception habilite le Président de la République à prendre les mesures exceptionnelles que commande la sauvegarde de l’indépendance de la Nation et des institutions de la République.<br />Le Parlement se réunit de plein droit.<br />L’état d’exception prend fin dans les mêmes formes et selon les procédures ci-dessus qui ont présidé à sa proclamation. </p><p>Article 94 : Le Haut Conseil de Sécurité entendu, le Président de l’assemblée Populaire Nationale et le Président du Conseil de la Nation consultés, le Président de la République décrète la mobilisation générale en Conseil des Ministres. </p><p>Article 95 : Le Conseil des Ministres réuni, le Haut Conseil de Sécurité entendu, le Président de l’assemblée Populaire Nationale et le Président du Conseil de la Nation consultés, le Président de la République déclare la guerre en cas d’agression effective ou imminente, conformément aux dispositions pertinentes de la Charte des Nations Unies.<br />Le Parlement se réunit de plein droit.<br />Le Président de la République informe la Nation par un message. </p><p>Article 96 : Pendant la durée de l’état de guerre, la Constitution est suspendue, le Président de la République assume tous les pouvoirs.<br />Lorsque le mandat du Président de la République vient à expiration, il est prorogé de plein droit jusqu’à fin de la guerre.<br />Dans le cas de la démission ou du décès du Président de la République, ou tout autre empêchement, le Président du Conseil de la Nation assume en tant que chef de l’Etat et dans les mêmes conditions que le Président de la République toutes les prérogatives exigées par l’état de guerre.<br />En cas de conjonction de la vacance de la Présidence de la République et de la Présidence du Conseil de la Nation, le Président du Conseil Constitutionnel assume les charges de chef de l’Etat dans les conditions prévues ci-dessus. </p><p>Article 97 : Le Président de la République signe les accords d’armistice et les traités de paix.<br />Il recueille l’avis du Conseil Constitutionnel sur les accords qui s’y rapportent.<br />Il soumet ceux-ci immédiatement à l’approbation expresse de chacune des chambres du Parlement.<br /> <br /> <br />Chapitre II : DU POUVOIR LEGISLATIF <br />Article 98 : Le pouvoir législatif est exercé par un Parlement, composé de deux chambres, l’assemblée Populaire Nationale et le Conseil de la Nation.<br />Le Parlement élabore et vote la loi souverainement.</p><p>Article 99 : Le Parlement contrôle l’action du Gouvernement dans les conditions fixées par les articles 80, 84, 133 et 134 de la Constitution.<br />Le contrôle prévu par les articles 135 et 137 de la Constitution, est exercé par l’assemblée Populaire Nationale.</p><p>Article 100 : Dans le cadre de ses attributions constitutionnelles, le Parlement doit rester fidèle au mandat du peuple et demeurer à l’écoute permanente de ses aspirations. </p><p>Article 101 : Les membres de l’assemblée Populaire Nationale, sont élus au suffrage universel, direct et secret.<br />Les membres du Conseil de la Nation sont élus pour les deux tiers (2/3) au suffrage indirect et secret parmi et par les membres des Assemblées Populaires Communales et de l’assemblée Populaire de Wilaya.<br />Un tiers (1/3) des membres du Conseil de la Nation est désigné par le Président de la République parmi les personnalités et compétences nationales dans les domaines scientifiques, culturel, professionnel, économique et social.<br />Le nombre des membres du Conseil de la Nation est égal à la moitié, au plus, des membres de l’assemblée Populaire Nationale.<br />Les modalités d’application du 2ème alinéa ci-dessus sont déterminées par la loi. </p><p>Article 102 : l’assemblée Populaire Nationale est élue pour une durée de cinq (5) ans.<br />Le mandat du Conseil de la Nation est fixé à six (6) ans.<br />La Composition du Conseil de la Nation est renouvelable par moitié tous les trois (3) ans.<br />Le mandat du Parlement ne peut être prolongé qu’en cas de circonstances exceptionnellement graves, empêchant le déroulement normal des élections.<br />situation est constatée par décision du Parlement, siégeant les deux chambres réunies sur proposition du Président de la République, le Conseil Constitutionnel consulté. </p><p>Article 103 : Les modalités d’élection des députés et celles relatives à l’élection ou à la désignation des membres du Conseil de la Nation, les conditions d’éligibilité, le régime des inéligibilités et des incompatibilités, sont fixés par une loi organique. </p><p>Article 104 : La validation des mandats des députés et celle des membres du conseil de la Nation relève de la compétence respective de chacune des deux chambres. </p><p>Article 105 : Le mandat du député et du membre du Conseil de la Nation est national. Il est renouvelable et non cumulable avec d’autres mandat ou fonction. </p><p>Article 106 : Le député ou le membre du Conseil de la Nation qui ne remplit pas ou ne remplit plus les conditions de son éligibilité encourt la déchéance de son mandat.<br />Cette déchéance est décidée selon le cas par l’assemblée Populaire Nationale ou le Conseil de la Nation à la majorité de leurs membres. </p><p>Article 107 : Le député ou le membre du Conseil de la Nation engage sa responsabilité devant ses pairs qui peuvent révoquer son mandat s’il commet un acte indigne de sa mission.<br />Le règlement intérieur de chacune des deux chambres fixe les conditions dans lesquelles un député ou un membre du Conseil de la Nation peut encourir l’exclusion. Celle-ci est prononcée selon le cas, par l’Assemblée Populaire Nationale ou le Conseil de la Nation, à la majorité de ses membres, sans préjudice de toutes autres poursuites de droit commun. </p><p>Article 108 : Les conditions dans lesquelles le Parlement accepte la démission d’un de ses membres sont fixées par la loi organique. </p><p>Article 109 : L’immunité parlementaire est reconnue aux députés et aux membres du Conseil de la Nation pendant la durée de leur mandat.<br />Ils ne peuvent faire l’objet de poursuites, d’arrestation, ou en général de toute action civile ou pénale ou pression, en raison des opinions qu’ils ont exprimées, des propos qu’ils ont tenus ou des votes qu’ils ont émis dans l’exercice de leur mandat. </p><p>Article 110 : Les poursuites ne peuvent être engagées contre un député ou un membre du Conseil de la Nation, pour crime ou délit, que sur renonciation expresse de l’intéressé ou sur autorisation, selon le cas, de l’assemblée Populaire Nationale ou du Conseil de la Nation, qui décide à la majorité de ses membres la levée de son immunité. </p><p>Article 111 : En cas de flagrant délit ou de crime flagrant, il peut être procédé à l’arrestation du député ou du membre du Conseil de la Nation. Le bureau de l’assemblée Populaire Nationale ou du Conseil de la Nation, selon la cas, en est immédiatement informé.<br />Il peut être demandé par le bureau saisi, la suspension des poursuites et la mise en liberté du député ou du membre du Conseil de la Nation; il sera alors procédé conformément aux dispositions de l’article 110 ci-dessus. </p><p>Article 112 : Une loi organique détermine les conditions de remplacement d’un député ou d’un membre du Conseil de la Nation en cas de vacance de son siège. </p><p>Article 113 : La législature débute de plein droit le dixième jour suivant la date d’élection de l’assemblée Populaire Nationale, sous la présidence de son doyen d’âge assisté des deux députés les plus jeunes.<br />L’assemblée Populaire Nationale procède à l’élection de son bureau et à la constitution de ses commissions.<br />Les dispositions ci-dessus sont applicables au Conseil de la Nation.</p><p>Article 114 : Le Président de l’assemblée Populaire Nationale est élu pour la durée de la législature.</p><p>Le Président du Conseil de la Nation est élu après chaque renouvellement partiel de la composition du Conseil.</p><p>Article 115 : L’organisation et le fonctionnement de l’assemblée Populaire Nationale et du Conseil de la Nation, ainsi que les relations fonctionnelles entre les chambres du Parlement et le Gouvernement, sont fixés par une loi organique.</p><p>Le budget des deux chambres, ainsi que les indemnités des députés et des membres du Conseil de la Nation, sont déterminés par la loi.</p><p>L’assemblée Populaire Nationale et le Conseil de la Nation élaborent et adoptent leur règlement intérieur.</p><p>Article 116 : Les séances du Parlement sont publiques.<br />Il en est tenu un procès-verbal dont la publicité est assurée dans les conditions fixées par la loi organique.</p><p>L’assemblée Populaire Nationale et le Conseil de la Nation peuvent siéger à huis-clos, à la demande de leurs présidents, de la majorité de leurs membres présents ou du chef du Gouvernement. </p><p>Article 117 : L’assemblée Populaire Nationale et le Conseil de la Nation créent des commissions permanentes dans le cadre de leur règlement intérieur. </p><p>Article 118 : Le Parlement siège en deux sessions ordinaires par an, chacune d’une durée minimale de quatre (4) mois.<br />Le Parlement peut être réuni en session extraordinaire sur initiative du Président de la République. </p><p>Il peut également être réuni par le Président de la République à la demande du chef du Gouvernement ou à la demande des deux tiers (2/3) des membres composant l’assemblée Populaire Nationale. </p><p>La clôture de la session extraordinaire intervient dès que le Parlement a épuisé l’ordre du jour pour lequel il a été convoqué. </p><p>Article 119 : L’initiative des lois appartient concurremment au chef du Gouvernement et aux députés.<br />Les propositions de lois, pour être recevables, sont déposées par vingt (20) députés. </p><p>Les projets de lois sont présentés en Conseil des Ministres après avis du Conseil d’Etat puis déposés par le chef du Gouvernement sur le bureau de l’assemblée Populaire Nationale. </p><p>Article 120 : Pour être adopté, tout projet ou proposition de loi, doit faire l’objet d’une délibération successivement par l’assemblée Populaire Nationale et par le Conseil de la Nation. </p><p>La discussion des projets ou propositions de lois par l’assemblée Populaire Nationale porte sur le texte qui lui est présenté. </p><p>Le Conseil de la Nation délibère sur le texte voté par l’assemblée Populaire Nationale et l’adopte à la majorité des trois quart (3/4) de ses membres. </p><p>En cas de désaccord entre les deux chambres, une commission paritaire, constituée des membres des deux chambres, se réunit à la demande du chef du Gouvernement pour proposer un texte sur les dispositions objet du désaccord. </p><p>Ce texte est soumis par le Gouvernement à l’adoption des deux chambres et n’est pas susceptible d’amendement, sauf accord du Gouvernement. </p><p>En cas de persistance du désaccord, le dit texte est retiré. </p><p>Le Parlement adopte la loi de finances dans un délai de soixante quinze (75) jours au plus tard, à compter de la date de son dépôt, conformément aux alinéas précédents. </p><p>En cas de sa non adoption dans le délai imparti, le Président de la République promulgue le projet du Gouvernement par ordonnance. </p><p>Les autres procédures seront fixées par la loi organique visée à l’article 115 de la Constitution. </p><p>Article 121 : Est irrecevable toute proposition de loi qui a pour objet ou pour effet de diminuer les ressources publiques ou d’augmenter les dépenses publiques, sauf si elle est accompagnée de mesures visant à augmenter les recettes de l’Etat ou à faire des économies au moins correspondantes sur d’autres postes des dépenses publiques. </p><p>Article 122 : Le Parlement légifère dans les domaines que lui attribue la Constitution, ainsi que dans les domaines suivants : </p><p>1- les droits et devoirs fondamentaux des personnes ; notamment le régime des libertés publiques, la sauvegarde des libertés individuelles et les obligations des citoyens; </p><p>2- les règles générales relatives au statut personnel et au droit de la famille; et notamment au mariage, au divorce, à la filiation, à la capacité et aux successions; </p><p>3- les conditions d’établissement des personnes ; </p><p>4- la législation de base concernant la nationalité ; </p><p>5- les règles générales relatives à la condition des étrangers ; </p><p>6-les règles relatives à l’organisation judiciaire et à la création de juridictions; </p><p>7- les règles générales de droit pénal et de la procédure pénale; et notamment la détermination des crimes et délits, l’institution des peines correspondantes de toute nature, l’amnistie, l’extradition et le régime pénitentiaire ; </p><p>8 - les règles générales de la procédure civile et des voies d’exécution ; </p><p>9 - le régime des obligations civiles, commerciales et de la propriété ; </p><p>10-le découpage territorial du pays ; </p><p>11-l’adoption du plan national ; </p><p>12-le vote du budget de l’Etat ; </p><p>13 - la création, l’assiette et le taux des impôts, contributions, taxes et droits de toute nature ; </p><p>14 - le régime douanier ; </p><p>15 - le règlement d’émission de la monnaie et le régime des banques, du crédit et des assurances ; </p><p>16 - les règles générales relatives à l’enseignement et à la recherche scientifique ; </p><p>17 - les règles générales relatives à la santé publique et à la population ; </p><p>18 - les règles générales relatives au droit du travail, à la sécurité sociale et à l’exercice du droit syndical ; </p><p>19 - les règles générales relatives à l’environnement, au cadre de vie et à<br />       l’aménagement du territoire ; </p><p>20 - les règles générales relatives à la protection de la faune et de la flore ; </p><p>21 - la protection et la sauvegarde du patrimoine culturel et historique ; </p><p>22 - le régime général des forêts et des terres pastorales ; </p><p>23 - le régime général de l’eau ; </p><p>24 - le régime général des mines et des hydrocarbures ; </p><p>25 - le régime foncier ; </p><p>26 - les garanties fondamentales accordées aux fonctionnaires et le statut général de la Fonction Publique ; </p><p>27 - les règles générales relatives à la Défense Nationale et à l’utilisation des forces armées par les autorités civiles ; </p><p>28 - les règles de transfert de propriété du secteur public au secteur privé ; </p><p>29 - la création de catégories d’établissements ; </p><p>30 - la création de décorations, distinctions et titres honorifiques d’Etat. </p><p>Article 123 : Outre les domaines réservés par la Constitution à la loi organique, relèvent également de la loi organique les matières suivantes : </p><p>- l’organisation et le fonctionnement des pouvoirs publics ; </p><p>- le régime électoral ; </p><p>- la loi relative aux partis politiques ; </p><p>- la loi relative à l’information ; </p><p>- les statuts de la magistrature et l’organisation judiciaire ; </p><p>- la loi cadre relative aux lois de finances ; </p><p>- la loi relative à la sécurité nationale. </p><p>La loi organique est adoptée à la majorité absolue des députés et à la majorité des trois quarts (3/4) des membres du Conseil de la Nation.</p><p>Elle est soumise à un contrôle de conformité par le Conseil Constitutionnel avant sa promulgation. </p><p>Article 124 : - En cas de vacance de L’Assemblée Populaire Nationale ou dans les périodes d’intersession du Parlement, le Président de la République peut légiférer par ordonnance. </p><p>Le Président de la République soumet les textes qu’il a pris à l’approbation de chacune des chambres du Parlement, à sa prochaine session. </p><p>Sont caduques les ordonnances non adoptées par le parlement. </p><p>En cas d’état d’exception défini à l’article 93 de la Constitution, le Président de la République peut légiférer par ordonnances. </p><p>Les ordonnances sont prises en Conseil des Ministres. </p><p>Article 125 : Les matières, autres que celles réservées à la loi, relèvent du pouvoir réglementaire du Président de la République. </p><p>L’application des lois relève du domaine réglementaire du chef du Gouvernement. </p><p>Article 126 : La loi est promulguée par le Président de la République dans un délai de trente (30) jours à compter de la date de sa remise. </p><p>Toutefois, lorsque le Conseil Constitutionnel est saisi par l’une des autorités prévues à l’article 166 ci-dessous, avant la promulgation de la loi, ce délai est suspendu jusqu'à ce qu’il soit statué par le Conseil Constitutionnel dans les conditions fixées à l’article 167 ci - dessous. </p><p>Article 127 : Le Président de la République, peut demander une seconde lecture de la loi votée, dans les trente (30) jours qui suivent son adoption.<br />Dans ce cas, la majorité des deux tiers (2 /3) des députés à l’Assemblée Populaire Nationale est requise pour l’adoption de la loi. </p><p>Article 128 : le Président de la République peut adresser un message au Parlement. </p><p>Article 129 : le Président de l'assemblée Populaire Nationale, le Président du Conseil de la Nation et le chef du Gouvernement consultés, le Président de la République peut décider de la dissolution de l'assemblée Populaire Nationale ou d’élections législatives anticipées. </p><p>Dans les deux cas, les élections législatives ont lieu dans un délai maximal de trois (03) mois. </p><p>Article 130 : A la demande du Président de la République ou de l’un des Présidents des deux chambres, le Parlement peut ouvrir un débat de politique étrangère. </p><p>Ce débat peut s’achever, le cas échéant, par une résolution du Parlement, siégeant en chambres réunies, qui sera communiquée au Président de la République. </p><p>Article 131 : Les accords d’armistice, les traités de paix, d’alliances et d’union, les traités relatifs aux frontières de l’Etat, ainsi que les traités relatifs au statut des personnes et ceux entraînant des dépenses non prévues au budget de l’Etat, sont ratifiés par le Président de la République, après leur approbation expresse par chacune des chambres du Parlement.</p><p>Article 132 : Les traités ratifiés par le Président de la République, dans les conditions prévues par la Constitution, sont supérieurs à la loi. </p><p>Article 133 : Les membres du Parlement peuvent interpeller le Gouvernement sur une question d’actualité.<br />Les commissions du Parlement peuvent entendre les membres du Gouvernement. </p><p> </p>

      <table align="center"><tr><td id="Titre0">THE CONSTITUTION<br />of the People’s Democratic Republic of Algeria</td></tr></table><p id="Note1">JORADP N°76 December 8th 1996<br />modified by the law 02-03, April 10th 2002<br />JORADP N°25, April 14th 2002</p><center><img height="66" src="http://www.joradp.dz/IMG/Bismi.gif" width="422" /></center><br /><br /><p id="Titre3">(IN THE NAME OF GOD THE MERCIFUL AND THE COMPASSIONATE)</p><table align="center"><tr><td id="Titre1">PREAMBLE</td></tr></table><table cellspacing="10" cellpadding="0" width="100%"><tr><td id="Ital0">The Algerian people are a free people, and decided to remain so.</td></tr><tr><td id="Ital0">Its history is a long series of struggles which always made Algeria a land of freedom and dignity.</td></tr><tr><td id="Ital0">Being at the heart of great events witnessed by the Mediterranean area throughout history, Algeria has found in her sons, since the Numid era and the islamic epic and up to the wars of decolonization, the pioneers of freedom, unity and progress as well as builders of democratic and prosperous States during the periods of glory and peace.</td></tr><tr><td id="Ital0">The 1st of November 1954 was a turning point for its destiny and a crowning for the long resistance to aggressions carried out against its culture, its values and the fundamental components of its identity which are Islam, Arabity and Amazighity. Its current struggles are well rooted in the glorious past of the nation.</td></tr><tr><td id="Ital0">Gathered in the national movement and later within the National Front of Liberation, the Algerian people have made great sacrifices in order to assume their collective destiny in the framework of recovered freedom and cultural identity and to build authentic people’s democratic constitutional institutions.</td></tr><tr><td id="Ital0">The National Front of Liberation crowned the sacrifices of the best sons of Algeria during the people’s war of liberation with independence and built a modern and full sovereign State.</td></tr><tr><td id="Ital0">The belief in the collective choices allowed the people to achieve great successes, characterized by the recovery of the national resources and the building of a State exclusively for the benefit of the people and exercising freely its powers and without any external pressures.</td></tr><tr><td id="Ital0">Having fought and still fighting for freedom and democracy, the Algerian people, by this Constitution, decided to build constitutional institutions based on the participation of any Algerian, man and woman, in the management of public affairs; and on the ability to achieve social justice, equality and freedom for all.</td></tr><tr><td id="Ital0">The constitution is the concretization of the people’s genius, the reflection of their aspirations, the fruit of their determination and the product of the deep social changes. Thus, in approving this Constitution, the people are, more than ever, decided to consider the law above everything.</td></tr><tr><td id="Ital0">The Constitution is above all, it is the fundamental law which guarantees the individual and collective rights and liberties, protects the principle of the people’s free choice and gives the legitimacy to the exercise of powers. It helps to ensure the legal protection and the control of the public authorities in a society in which lawfulness and man’s progress prevail in all its dimensions.</td></tr><tr><td id="Ital0">Strong with their deeply rooted spiritual values and preserving their traditions of solidarity and justice, the people are confident in their ability to participate efficiently in the cultural, social and economic progress of the present and future world.</td></tr><tr><td id="Ital0">Algeria, being a land of Islam, an integral part of the Great Maghreb, an Arab land, a Mediterranean and African country is proud of the radiance of its 1st of November Revolution and is honoured by the respect the country gained and knew how to preserve it through its engagement towards the just causes in the world.</td></tr><tr><td id="Ital0">The pride of the people, their sacrifices, their sense of responsibility and their ancestral attachment to freedom and to social justice are the best guaranty for the respect to this Constitution which they adopt and transmit to future generations, heirs of the freedom pioneers and the builders of free society.</td></tr></table><table align="center"><tr><td id="Titre1">PART ONE<br />GENERAL PRINCIPLES<br />GOVERNING THE ALGERIAN SOCIETY</td></tr></table><p id="Titre2">Chapter I : Algeria</p><p><b>Article 1</b> - Algeria is a People’s Democratic Republic.<br />It is one and indivisible.</p><p><b>Art. 2</b> - Islam is the religion of the State.</p><p><b>Art. 3</b> - Arabic is the national and official language.</p><p><b>Art. 3 bis</b><img height="14" alt="Constitutional revision of 10 april 2002 adopted in accordance with the procedure provided for in Article 176 of the Constitution." src="http://www.joradp.dz/IMG/Oeil.gif" width="20" /> - Tamazight is also national language.<br />The State works for its promotion and development in all its linguistic variations used all over the national territory.</p><p><b>Art. 4</b> - The capital of the Republic is ALGIERS.</p><p><b>Art. 5</b> - The national flag, the State seal and the national anthem are defined by the law. </p><p id="Titre2">Chapter II : The People</p><p><b>Art. 6</b> - The People are the source of any power.<br />The national sovereignty belongs exclusively to the People.</p><p><b>Art. 7</b> - The constituent power belongs to the People.<br />The People exercise their sovereignty through institutions they set up.<br />The People exercise it by means of referendum and through the elected representatives.<br />The President of the Republic may resort directly to the expression of the People's will.</p><p><b>Art. 8</b> - The People set up institutions having as objectives:<br />- the safeguard and consolidation of the national independence;<br />- the safeguard and consolidation of the national identity and unity;<br />- the protection of fundamental liberties of the citizen and the social and cultural progress of the Nation;<br />- the suppression of the exploitation of man by man;<br />- the protection of the national economy from any form of embezzlement or misappropriation, illegitimate monopolizing or seizure.</p><p><b>Art. 9</b> - The institutions are not allowed:<br />- feudal, regionalist and nepotic practices;<br />- setting up exploitation relationships and dependence links;<br />- practices that are contrary to the islamic ethics and to the values of the November Revolution.</p><p><b>Art. 10</b> - The People choose freely their representatives.<br />The representation of the People has no limits except those defined by the Constitution and the electoral law.</p><p id="Titre2">Chapter III : The State</p><p><b>Art. 11</b> - The State takes its legitimacy and its <i>raison d’être</i> from the People's will.<br />Its motto is «By the People and for the People».<br />It is exclusively for the service of the People.</p><p><b>Art. 12</b> - The sovereignty of the State is exercised on its terrestrial space, its air space, and its waters.<br />The State also exercises its sovereign right established by the international law on any of its various areas of the maritime space to which they belong.</p><p><b>Art. 13</b> - In any circumstances should a part of the national territory be abandoned or alienated.</p><p><b>Art. 14</b> - The State is based on the principles of democratic organization and of social justice.<br />The elected Assembly is the framework in which is expressed the people's will and the control of the public authorities is exercised.</p><p><b>Art. 15</b> - The territorial collectivities of the State are the «Commune» and the «Wilaya».<br />The «Commune» is the basic collectivity.</p><p><b>Art. 16</b> - The elected assembly represents the basis of decentralization and a place of the citizen’s participation in the management of public affairs.</p><p><b>Art. 17</b> - Public property belongs to the national collectivity. It includes the underground, the mines and quarries, the natural resources of energy, the mineral, natural and living resources in the various national maritime areas, waters and forests.<br />It also includes rail, maritime and air transport, the mail and telecommunications as well as other properties defined by the law.</p><p><b>Art. 18</b> - The national properties are defined by the law.<br />They include public and private properties of the State, the «Wilaya» and the «Commune».<br />The management of the national properties is carried out in accordance with the law.</p><p><b>Art. 19</b> - The organization of external trade is the domain of the State only.<br />The law defines the conditions and control of external trade.</p><p><b>Art. 20</b> - Expropriation can be carried out only within the framework of the law.<br />It gives right to a prior, just and fair compensation.</p><p><b>Art. 21</b> - The functions in the State institutions should neither be a source of wealth nor a means of being for the service of private interests.</p><p><b>Art. 22</b> - Power abuse is repressed by the law.</p><p><b>Art. 23</b> - The administration’s impartiality is guaranteed by the law.</p><p><b>Art. 24</b> - The State is responsible for the security of persons and properties. It ensures the protection of every citizen abroad.</p><p><b>Art. 25</b> - The enhancement and the development of the defense capacity of the Nation are organized within the National People’s Army.<br />The permanent task of the National People’s Army is to safeguard the national independence and to defend the national sovereignty.<br />It ensures the defence of the country’s unity and the territorial integrity as well as the protection of its terrestrial and air space, and the various areas of its maritime space.</p><p><b>Art. 26</b> - Algeria does not resort to war in order to undermine the legitimate sovereignty and the freedom of other People’s.<br />It puts forth its efforts to settle international disputes through peaceful means.</p><p><b>Art. 27</b> - Algeria associates itself with all the peoples fighting for their political and economic liberation, for the right of self-determination and against any racial discrimination.</p><p><b>Art. 28</b> - Algeria works for the reinforcement of international cooperation and to the development of friendly relations among States, on equal basis, mutual interest and non interference in the internal affairs. It endorses the principles and objectives of the United Nations Charter.</p><p id="Titre2">Chapter IV : Rights and liberties</p><p><b>Art. 29</b> - All citizens are equal before the law. No discrimination shall prevail because of birth, race, sex, opinion or any other personal or social condition or circumstance.</p><p><b>Art. 30</b> - The Algerian nationality is defined by the law.<br />Conditions for acquiring, keeping, loosing or forfeiture of the Algerian nationality are defined by the law.</p><p><b>Art. 31</b> - The aim of the institutions is to ensure equality of rights and duties of aIl citizens, men and women, by removing the obstacles which hinder the progress of human beings and impede the effective participation of all in the political, economic, social and cultural life.</p><p><b>Art. 32</b> - The fundamental human and citizen's rights and liberties are guaranteed.<br />They are a common heritage of all Algerians, men and women, whose duty is to transmit it from generation to another in order to preserve it and keep it inviolable.</p><p><b>Art. 33</b> - Individual or associative defence of the fundamental human rights and individual and collective liberties is guaranteed.</p><p><b>Art. 34</b> - The State guarantees the inviolability of the human entity.<br />Any form of physical or moral violence or breach of dignity is forbidden.</p><p><b>Art. 35</b> - Infringements committed against rights and liberties and violations of physical or moral integrity of a human being are repressed by the law.</p><p><b>Art. 36</b> - Freedom of creed and opinion is inviolable.</p><p><b>Art. 37</b> - Freedom of trade and industry is guaranteed, it is carried out within the framework of the law.</p><p><b>Art. 38</b> - Freedom of intellectual, artistic and scientific innovation is guaranteed to the citizen.<br />Copyrights are protected by the law.<br />The seizure of any publication, recording or any other means of communication and information can only be done in pursuance of a warrant.</p><p><b>Art. 39</b> - The private life and the honour of the citizen are inviolable and protected by the law.<br />The secrecy of private correspondence and communication, in any form, is guaranteed.</p><p><b>Art. 40</b> - The State guarantees home inviolability.<br />No thorough search can be allowed unless in pursuance of the law and in compliance with the latter.<br />The thorough search can only be in pursuance of a search warrant emanating from the competent judicial authority.</p><p><b>Art. 41</b> - Freedom of expression, association and meeting are guaranteed to the citizen.</p><p><b>Art. 42</b> - The right to create political parties is recognized and guaranteed.<br />However, this right cannot be used to violate the fundamental liberties, the fundamental values and components of the national identity, the national unity, the security and integrity of the national territory, the independence of the country and the People's sovereignty as well as the democratic and republican nature of the State.<br />In respect to the provisions of the present Constitution, the political parties cannot be founded on religious, linguistic, racial, sex, corporatist or regional basis.<br />The political parties cannot resort to partisan propaganda on the elements mentioned in the previous paragraph.<br />Any obedience, in any form, of the political parties to foreign interests or parties is forbidden.<br />No political party can resort to any form of any nature of violence or constraint.<br />Other obligations and duties are prescribed by the law.</p><p><b>Art. 43</b> - The right to create associations is guaranteed.<br />The State encourages the development of associative movement.<br />The law defines the conditions and clauses of the creation of associations.</p><p><b>Art. 44</b> - Any citizen enjoying his civil and political rights has the right to choose freely his place of dwelling and to move on the national territory.<br />The right of entry and exit from the national territory is guaranteed.</p><p><b>Art. 45</b> - Any person is presumed not guilty until his culpability is established by a regular jurisdiction with all the guarantees required by the law.</p><p><b>Art. 46</b> - None is guilty unless it is in accordance with a promulgated law prior to the incriminated action.</p><p><b>Art. 47</b> - None can be pursued, arrested or detained unless within the cases defined by the Iaw and in accordance with the forms prescribed.</p><p><b>Art. 48</b> - In the field of penal investigation, custody is under judiciary control and cannot exceed forty-eight (48) hours.<br />The person held in custody has the right to be immediately in contact with his family.<br />The extension of the period of custody can occur, exceptionally, only within the conditions established by the law.<br />At the expiry of the period of custody, it is compulsory to proceed to a medical examination of the person detained if this latter asks for it, and in any cases, this person is informed of this right.</p><p><b>Art. 49</b> - Miscarriage of justice leads to compensation by the State.<br />The law determines the conditions and modes of compensation.</p><p><b>Art. 50</b> - Any citizen fulfilling the legal conditions can elect and be elected.</p><p><b>Art. 51</b> - Equal access to functions and positions in the State is guaranteed to all citizens without any other conditions except those defined by the law.</p><p><b>Art. 52</b> - Private property is guaranteed.<br />The right to inherit is guaranteed.<br />The «Wakf'» properties and the foundations are recognized; their intended purpose is protected by the law.</p><p><b>Art. 53</b> - The right for education is guaranteed. Education is free within the conditions defined by the law.<br />Fundamental education is compulsory.<br />The State organizes the educational system.<br />The State ensures the equal access to education and professional training.</p><p><b>Art. 54</b> - All citizens have the right for the protection of their health.<br />The State ensures the prevention and the fight of endemics and epidemics.</p><p><b>Art. 55</b> - All citizens have right for work.<br />The right for protection, security and hygiene at work is guaranteed by the law.<br />The right to rest is guaranteed; the law defines the relevant clauses.</p><p><b>Art. 56</b> - The trade union right is recognized to all citizens.</p><p><b>Art. 57</b> - The right to strike is recognized; it is carried out within the framework of the law.<br />The law may forbid or limit the strike in the field of national defence and security, or in any public service or activity of vital interest for the community.</p><p><b>Art. 58</b> - The family gains protection from the State and the society.</p><p><b>Art. 59</b> - The living conditions of the citizens under the age of working or those unable or can never be able to work are guaranteed.</p><p id="Titre2">Chapter V : Duties</p><p><b>Art. 60</b> - Ignorance of the law is no excuse.<br />Every person should abide by the Constitution and comply with the laws of the Republic.</p><p><b>Art. 61</b> - The duty of every citizen is to protect and safeguard the independence of the country and the integrity of its national territory as well as all the symbols of the State.<br />Treason, spying, obedience to the enemy as well as all the infringements committed against the State security are severely repressed by the law.</p><p><b>Art. 62</b> - Every citizen should, loyally, fulfill his obligations towards the national community.<br />The commitment of every citizen towards the Mother Country and the obligation to contribute to its defence are sacred and permanent duties.<br />The State guarantees the respect of the symbols of the Revolution, the memory of the «chouhada» and the dignity of their rightfuls, and the «moudjahidine».</p><p><b>Art. 63</b> - All the individual liberties are carried out within the respect of the rights of others recognized by the Constitution, in particular, the respect of the right for honour, intimacy and the protection of the family, the youth and childhood.</p><p><b>Art. 64</b> - The citizens are equals before the taxes.<br />Everyone should participate in financing the public expenses, in accordance with his contributory capacity.<br />No taxes can be laid down unless in accordance with the law.<br />No taxes, contribution or duty of any nature can be laid down with a retrospective effect.</p><p><b>Art. 65</b> - The law sanctions the duty of parents in the education and protection of their children as well as the duty of the children in helping and assisting their parents.</p><p><b>Art. 66</b> - The duty of every citizen is to protect the public property and the interests of the national community and to respect the property of others.</p><p><b>Art. 67</b> - Any foreigner being legally on the national territory enjoys the protection of his person and his properties by the law.</p><p><b>Art. 68</b> - None can be extradited unless in accordance and in implementation of the extradition law.</p><p><b>Art. 69</b> - In no case, a political refugee having legally the right of asylum can be delivered or extradited.</p><table align="center"><tr><td id="Titre1">PART TWO<br />ORGANIZATION OF POWERS</td></tr></table><p id="Titre2">Chapter I : The executive power</p><p><b>Art. 70</b> - The president of the Republic, Head of the State, embodies the unity of the Nation.<br />He is the guarantor of the Constitution.<br />He embodies the State within the country and abroad.<br />He addresses the Nation directly.</p><p><b>Art. 71</b> - The President of the Republic is elected by direct, secret and universal suffrage.<br />The election is acquired through the absolute majority of the expressed votes.<br />The other modes of presidential election are defined by the law.</p><p><b>Art. 72</b> - The President of the Republic exercises the supreme magistracy within the limits defined by the Constitution.</p><p><b>Art. 73</b> - To be eligible to the Presidency of the Republic, the candidate should:<br />- have, solely, the Algerian nationality by origin;<br />- be a muslim;<br />- be more than forty (40) years-old the day of the election;<br />- enjoy full civil and political rights;<br />- prove the Algerian nationality of the spouse;<br />- justify his participation in the 1st of November 1954 Revolution for the candidates born before July 1942;<br />- justify the non-involvement of the parents of the candidate born after July 1942, in actions hostile to the 1st of November 1954 Revolution;<br />- submit a public declaration of his personal and real estate existing either within Algeria or abroad.<br />- Other conditions are prescribed by the law.</p><p><b>Art. 74</b> - The duration of the presidential mandate is five (5) years.<br />The President of the Republic can be reelected once only.</p><p><b>Art. 75</b> - The president of the Republic takes an oath before the People and in the presence of the high authorities of the Nation, in the week following his election.<br />He enters into office after taking the Oath.</p><p><b>Art. 76</b> - The President of the Republic takes the Oath in the following terms:</p><center><img height="530" src="http://www.joradp.dz/IMG/Serment.gif" width="360" /></center><p></p><p><b>Art. 77</b> - In addition to the powers bestowed, explicitly, upon him by other provisions of the Constitution, the President of the Republic has the following powers and prerogatives:<br />1- he is the Supreme Chief of all the Armed Forces of the Republic;<br />2- he is responsible for the National Defence;<br />3- he decides and conducts the foreign policy of the Nation;<br />4- he presides the Cabinet;<br />5- he appoints the Head of Government and puts an end to his functions;<br />6- he signs the presidential decrees;<br />7- he has the right of pardon, remission or commutation of punishment;<br />8- he can refer to the People through a referendum or any issue of national importance;<br />9- he concludes and ratifies international treaties;<br />10- he awards State medals, decorations and honorific titles.</p><p><b>Art. 78</b> - The President of the Republic appoints:<br />1- to posts and mandates provided by the Constitution;<br />2- to State civil and military posts;<br />3- to nominations decided in the Cabinet;<br />4- the President of the Council of State;<br />5- the Secretary General of the Government;<br />6- the Governor of the Bank of Algeria;<br />7- the Magistrates;<br />8- high officials of security bodies;<br />9- the «walis».<br />The President of the Republic appoints and recalls the ambassadors and the special envoys of the Republic abroad. He receives the credentials and the letters of recall of foreign diplomatic representatives.</p><p><b>Art. 79</b> - The Head of Government presents the members of the Government he choosed to the President of the Republic who appoints them.<br />The Head of Government establishes a programme and submits it to the Cabinet.</p><p><b>Art. 80</b> - The Head of Government submits his programme for approval to the People’s National Assembly. This latter opens, for this purpose, a general debate.<br />The Head of Government may adapt his programme in the light of this debate.<br />The Head of Government addresses a communication on his programme to the Council of Nation.<br />The Council of Nation may issue a resolution.</p><p><b>Art. 81</b> - In case of non approval of his programme by the People’s National Assembly, the Head of Government presents the resignation of his Government to the President of the Republic.<br />This latter appoints again a Head of Government in accordance with the same modes.</p><p><b>Art. 82</b> - If the People’s National Assembly’s approval is not obtained, the People’s National Assembly is dissolved <i>de jure</i>.<br />The Government in office is kept in position in order to manage daily affairs until the election of a new People’s National Assembly within a maximum period of three (3) months.</p><p><b>Art. 83</b> - The Head of Government executes and coordinates the program adopted by the People’s National Assembly.</p><p><b>Art. 84</b> - The Government presents each year a general policy declaration to the People’s National Assembly.<br />The general policy declaration is followed by a debate on the action of the Government.<br />This debate may end up with a resolution.<br />It may also lead the People’s National Assembly to bring in a vote of censure, in accordance with the provisions of articles 135, 136 and 137 under-mentioned.<br />The Head of Government may ask the People’s National Assembly a vote of confidence. If the motion of confidence is not voted, the Head of Government presents the resignation of his Government.<br />In this case, the President of the Republic may, before accepting the resignation, use the provisions of article 129 under-mentioned.<br />The Government may also present a general policy declaration to the Council of Nation.</p><p><b>Art. 85</b> - In addition to the powers bestowed upon him explicitly by other provisions of the Constitution, the Head of Government exercises the following functions:<br />1- he distributes the functions among the members of the Government in accordance with the provisions of the Constitution.<br />2- he presides the Council of Government;<br />3- he sees to the execution of laws and rules;<br />4- he signs executive decrees;<br />5- he appoints to state offices, without prejudice to the provisions of articles 77 and 78 above mentioned;<br />6- he sees to the best functioning of the public administration.</p><p><b>Art. 86</b> - The Head of Government may present to the President of the Republic the resignation of his Government.</p><p><b>Art. 87</b> - The President of the Republic cannot, in any cases, delegate the power to appoint the Head of Government, the members of the Government, as well as the presidents and members of constitutional institutions for whom another mode of designation is not provided by the Constitution.<br />Moreover, he cannot delegate his power to resort to referendum, to dissolve the People’s National Assembly, to decide on anticipated legislative elections, to implement the provisions of articles 77,78,91,93 to 95,97,124,127 and 128 of the Constitution.</p><p><b>Art. 88</b> - If the President of the Republic, because of serious and long-lasting illness, happens to be in the impossibility to carry out his functions, the Constitutional Council meets <i>de jure</i>, and after having verified the reality of the impediment by the appropriate means, proposes, unanimously, to the Parliament to declare the state of impediment.<br />The Parliament sitting, in both chambers convened together, declares the state of impediment of the President of the Republic, with a majority of two-thirds (2/3) of its members and charges the President of the Council of Nation, to stand for the Head of State by interim for a maximum period of forty five (45) days and carry out his prerogatives in accordance with the provisions of article 90 of the Constitution.<br />If the impediment continues at the expiry of the forty-five (45) days period, a declaration of vacancy by resignation <i>de jure</i> is made in accordance with the procedure mentioned in the above paragraphs and the provisions of the following paragraph of the present article.<br />In case of resignation or death of the President of the Republic, the Constitutional Council meets <i>de jure</i> and ascertain the permanent vacancy of the Presidency of the Republic.<br />It, immediately, communicates the permanent vacancy declaration act to the parliament which meets <i>de jure</i>.<br />The president of the Council of Nation assumes the charge of Head of State for a maximum period of sixty (60) days, during which presidential elections are organized.<br />The Head of State, thus designated, cannot be candidate to the Presidency of the Republic.<br />In case the resignation or the death of the President of the Republic comes in conjunction with the vacancy of the Presidency of the Council of Nation whatever the cause may be, the Constitutional Council meets <i>de jure</i> and ascertain, unanimously, the permanent vacancy of the Presidency of the Republic and the impediment of the President of the Council of Nation. In this case, the president of the Constitutional Council assumes the Function of the Head of State in accordance with the conditions defined in the preceding paragraphs of the present article and article 90 of the Constitution. He cannot be candidate for the Presidency of the Republic.</p><p><b>Art. 89</b> - When one of the candidates of the second round of the presidential elections dies, withdraws or is hindered for any reason, the President of the Republic in office or who assumes the function of Head of State remains in office until the proclamation of the election of the President of the Republic.<br />In this case, the Constitutional Council extends the period of organizing the election for a maximum period of sixty (60) days.<br />The organic law will determine the conditions and modes of implementing the present provisions.</p><p><b>Art. 90</b> - The Government in office at the time of the impediment, the death or the resignation of the President of the Republic cannot be resigned or reshuffled until the new President of the Republic comes into office.<br />In the case the Head of Government in office, is candidate for the Presidency of the Republic, he resigns <i>de jure</i>. The function of Head of Government is assumed by a member of the Government appointed by the Head of State.<br />During the periods of forty five (45) days and sixty (60) days provided for by articles 88 and 89, the provisions in the paragraphs 7 and 8 of article 77 and the articles 79, 124, 129, 136, 137, 174, 176 and 177 of the Constitution cannot be implemented.<br />During these same periods, the provisions of articles 91,93, 94, 95 and 97 of the Constitution cannot be implemented unless the Parliament sitting in both chambers convened together gives its approval, the Constitutional Council and the High Security Council referred to before.</p><p><b>Art. 91</b> - In case of urgent necessity, the High Security Council convened, the President of the People's National Assembly, the President of the Council of Nation, the Head of Government and the President of the Constitutional Council referred to, the President of the Republic decrees the state of emergency or the state of siege, for a definite period and takes all the necessary measures to restore the situation.<br />The duration of the state of emergency or the state of siege cannot be extended unless with the approval of the Parliament sitting in both chambers convened together.</p><p><b>Art. 92</b> - The organization of the state of emergency and the state of siege is defined by an organic law.</p><p><b>Art. 93</b> - When the country is threatened by an impending danger to its institutions, to its independence or to its territorial integrity, the President of the Republic decrees the state of exception.<br />Such a measure is taken after referring to the President of the People’s National Assembly, the President of the Council of Nation and the Constitutional Council, and hearing the High Security Council and the Cabinet.<br />The state of exception entitles the President of the Republic to take exceptional measures dictated by the safeguard of the independence of the Nation and the institutions of the Republic.<br />The Parliament meets <i>de jure</i>.<br />The state of exception ends in accordance with the same forms and procedures mentioned above and which led to its proclamation.</p><p><b>Art. 94</b> - The High Security Council heard, the President of the People's National Assembly and the President of the Council of Nation referred to, the President of the Republic decrees the general mobilization during the meeting of the Cabinet.</p><p><b>Art. 95</b> - The Cabinet met, the High Security Council heard, The President of the People's National Assembly and the President of the Council of Nation referred to, the President of the Republic declares war in case of effective or impending aggression in accordance with the relevant provisions of the United Nation Charter.<br />The Parliament meets <i>de jure</i>.<br />The President of the Republic addresses a message informing the Nation.</p><p><b>Art. 96</b> - During the period of the state of war, the Constitution is suspended, the President of the Republic assumes all the powers.<br />When the mandate of the President of the Republic comes to expiry, it is extended <i>de jure</i> until the end of the war.</p><p>In case the President of the Republic resigns or dies or any other impediment, the President of the Council of Nation assumes, as Head of State and within the same conditions as that of the President of the Republic, all the prerogatives required by the state of war.<br />In case there is a conjunction of the vacancy of the Presidency of the Republic and the Presidency of the Council of Nation, the President of the Constitutional Council assumes, the functions of the Head of State within the conditions provided for above.</p><p><b>Art. 97</b> - The President of the Republic signs armistice agreements and peace treaties.<br />He receives the view of the Constitutional Council on the relevant agreements.<br />He submits the latter immediately to be approved explicitly by each of the two chambers of the Parliament.</p><p id="Titre2">Chapter II : The legislative power</p><p><b>Art. 98</b> - The legislative power is exercised by a Parliament, consisting of two chambers, the People's National Assembly and the Council of Nation.<br />The parliament is sovereign to elaborate and vote the law.</p><p><b>Art. 99</b> The Government within the conditions defined by articles 80, 84, 133 and 134 of the Constitution.<br />The control, provided for in articles 135 to 137 of the Constitution, is carried out by the People's National Assembly.</p><p><b>Art. 100</b> - The Parliament should, within its constitutional attributions, remain faithful to the trust of the people and be permanently aware of their aspirations.</p><p><b>Art. 101</b> - The members of the People's National Assembly are elected by means of a universal direct and secret suffrage.<br />Two-thirds (2/3) of the members of the Council of Nation are elected by means of indirect and secret suffrage among and by the members of the People's Communal Assemblies and the People's Wilaya Assembly.<br />One third (1/3) of the members of the Council of Nation is designated by the President of the Republic among the national personalities and qualified persons in the scientific, cultural, professional, economic and social fields.<br />The number of members of the Council of Nation is equal to the half, to the utmost, of the members of the People's National Assembly.<br />The modes of implementing paragraph 2 above mentioned are defined by the law.</p><p><b>Art. 102</b> - The People’s National Assembly is elected for a period of five (05) years.<br />The mandate of the Council of Nation is limited to six (06) years.<br />Half the members of the Council of Nation is renewed every three (03) years.<br />The mandate of the Parliament cannot be extended unless there are very exceptional circumstances which hinder the normal progress of elections.<br />This situation is ascertained by a decision of the Parliament, sitting in both chambers convened together, following a proposal of the President of the Republic and the Constitutional Council referred to.</p><p><b>Art. 103</b> - The modes for the election of deputies and those concerning the election or the appointment of members of the Council of Nation, the conditions of eligibility, the rules of ineligibility and incompatibility are defined by an organic law.</p><p><b>Art. 104</b> - The validation of the mandate of the deputies and that of the members of the Council of Nation comes within the respective competence of each of the two chambers.</p><p><b>Art. 105</b> - The mandate of the deputy and the member of the Council of Nation is national. It can be renewed and not concurrent with other mandate or function.</p><p><b>Art. 106</b> - The deputy or the member of the Council of Nation who does not fulfill or does not fulfill any more the conditions of his eligibility incurs the forfeiture of his mandate.<br />This forfeiture is decided according to the case by the People's National Assembly or the Council of Nation by the majority of their members.</p><p><b>Art. 107</b> - The deputy or the member of the Council of Nation commits himself before his peers who can revoke his mandate if he commits a shameful action for his mission.<br />The internal rules of each of the two chambers define the conditions of excluding a deputy or a member of the Council of Nation. The exclusion is decided according to the case by the People's National Assembly or the Council of Nation, by the majority of its members without prejudice to any other common law lawsuits.</p><p><b>Art. 108</b> - The conditions by which the Parliament accepts the resignation of one of its members are defined by an organic law.</p><p><b>Art. 109</b> - Parliamentary immunity is recognized to deputies and members of the Council of Nation during the period of their mandate.<br />They cannot be subject to lawsuits, arrest, or in general, to any civil or penal action or pressure because of opinions they expressed, utterances they made or votes they gave during the exercise of their mandate.</p><p><b>Art. 110</b> - Lawsuits cannot be instituted against a deputy or a member of the Council of Nation for crime or infringement unless there is an explicit renunciation of the concerned or an authorization according to the case from the People's National Assembly or the Council of Nation which decides by the majority of its members to lift the immunity.</p><p><b>Art. 111</b> - In case of flagrant infringement or flagrant crime, the deputy or the member of the Council of Nation may be arrested. The bureau of the People's National Assembly or of the Council of Nation, depending on the case, is informed immediately.<br />The informed bureau may ask the suspension of lawsuits and the liberation of the deputy or the member of the Council of Nation; it will then be proceeded according to the provisions of article 110 above mentioned.</p><p><b>Art. 112</b> - An organic law defines the conditions for the replacement of a deputy or a member of the Council of Nation in case there is vacancy of his seat.</p><p><b>Art. 113</b> - The term of the legislative body begins <i>de jure</i> the tenth day following the date of the election of the People's National Assembly, under the chairmanship of the oldest member assisted by the two youngest deputies.<br />The People's National Assembly elects its bureau and forms its committees.<br />The above mentioned provisions are applied to the council of Nation.</p><p><b>Art. 114</b> - The President of the People's Assembly is elected for the term of the legislative body.<br />The President of the Council of Nation is elected after each partial renewal of the members of the Council.</p><p><b>Art. 115</b> - The organization and the functioning of the People's National Assembly and the Council of Nation as well as the functional relations between the chambers of the Parliament and the Government are defined by an organic law.<br />The budget of the chambers as well as the salaries of the deputies and the members of the Council of Nation are defined by the law.<br />The People's National Assembly and the Council of Nation elaborate and adopt their internal rules.</p><p><b>Art. 116</b> - The sittings of the Parliament are public.<br />The proceedings are recorded in a book and published in accordance with the conditions defined by an organic law.<br />The People's National Assembly and the Council of Nation may sit in camera upon a request made by their presidents, by the majority of their members present or by the Head of Government.</p><p><b>Art. 117</b> - The People's National Assembly and the Council of Nation set up permanent committees in the framework of their internal rules.</p><p><b>Art. 118</b> - The Parliament meets in two ordinary sessions a year, each lasting a minimum period of four (04) months.<br />The Parliament may hold a meeting in an extraordinary session on the initiative of the President of the Republic.<br />The President of the Republic can hold a meeting of the Parliament on a request made by the Head of Government or by the two thirds (2/3) of the members of the People's National Assembly.<br />The closure of the extraordinary session comes after the Parliament has exhausted the agenda for which it was convened.</p><p><b>Art. 119</b> - The Head of Government and the deputies have the right to initiate laws.<br />To be admissible, proposed laws are brought in by twenty (20) deputies.<br />Draft laws are presented in the Cabinet following the opinion of the Council of State then submitted to the bureau of the People's National Assembly by the Head of Government.</p><p><b>Art. 120</b> - To be adopted, any draft law or law proposal should be debated successively by the People's National Assembly and the Council of Nation.<br />The discussion of draft laws or law proposals by the People's National Assembly concerns the text which is presented to it.<br />The Council of Nation deliberates the text voted by the People's National Assembly and adopts it by the majority of three quarters (3/4) of its members.<br />In case there is a disagreement between the two chambers, a committee of equal representation of the two chambers meets on a request of the Head of Government to propose a text on the provisions subject of the disagreement<br />This text is submitted by the Head of Government to be adopted by the two chambers and cannot be amended unless with the agreement of the Government.<br />In case the disagreement persists, the text is withdrawn.<br />The parliament adopts the financial law within a period of seventy five (75) days at the utmost from the date it was submitted in accordance with the preceding paragraphs.<br />In case it was not adopted in the time limit, the President of the Republic promulgates the draft text of the Government by ordinance.<br />Other procedures are defined by the organic law mentioned in article 115 of the Constitution.</p><p><b>Art. 121</b> - Is inadmissible any law proposal which leads to or the subject of which is to reduce public resources or increase public expenses unless it is accompanied by measures aiming at increasing the State income or making, at least, corresponding savings in other items of public expenses.</p><p><b>Art. 122</b> - The Parliament legislates in the domains which the Constitution assigned to it, as well as the following domains:<br />1- fundamental rights and duties of the individuals, in particular, the rules of public liberties, the safeguard of individual liberties and the obligations of the citizens;<br />2- general rules concerning personal status and the family statute and, in particular, marriage, divorce, affiliation, capacity and inheritance;<br />3- conditions of individual's establishment;<br />4- basic legislation concerning the Nationality;<br />5- general rules related to the condition of the foreigners;<br />6- rules related to the judiciary organization and to the setting up of jurisdictions;<br />7- general rules of penal law and penal procedures; and in particular, the determination of crimes and infringements, the institution of corresponding punishments of any nature, amnesty, extradition and the penitentiary system;<br />8- general rules of civil procedure and execution means;<br />9- rules of civil, trade and property obligations;<br />10- territorial allotment of the country;<br />11- adopting the national plan;<br />12- voting the State budget;<br />13- setting up tax base and rate, contributions and duties of any nature;<br />14- customs regulations;<br />15- money issuing regulations and bank, credit and insurance rules;<br />16- general rules related to teaching and Scientific Research;<br />17- general rules related to public health and population;<br />18- general rules related to work law, social security and to the exercise of trade union right;<br />19- general rules related to environment, living space and land management;<br />20- general rules related to the protection of the fauna and the flora;<br />21- protection and safeguard of cultural and historic heritage;<br />22- general regulation for forests and grazing lands;<br />23- general regulation for water;<br />24- general regulation for mines and hydrocarbons;<br />25- land regulation;<br />26- the fundamental guaranties granted to civil servants and the general statute of civil service;<br />27- general rules related to National Defense and the use of armed forces by civil authorities;<br />28- rules of property transfer from the public sector to the private sector;<br />29- the creation of types of establishments;<br />30- instituting State medals, distinctions and honorific titles.</p><p><b>Art. 123</b> - In addition to the domains intended to the organic laws by the Constitution, the Parliament legislates through organic laws in the following fields:<br />- organization and functioning of public powers;<br />- electoral regulation;<br />- the law pertaining to political parties;<br />- the law related to information;<br />- the statute of magistracy and judiciary organization;<br />- the outline law of financial laws;<br />- the law pertaining to national security;<br />The organic law is adopted by the absolute majority of the deputies and the majority of three quarters (3/4) of the members of the Council of Nation.<br />It is submitted to the Constitutional Council for a conformity control before its promulgation.</p><p><b>Art. 124</b> - The President of the Republic can legislate by ordinance in case there is a vacancy of the People's National Assembly or in the inter-sessions periods of the Parliament.</p><p id="Text">The President of the Republic submits the texts he enacted to be approved by each of the two chambers of the Parliament in its next session.<br />The ordinances not adopted by the Parliament are void.<br />The President of the Republic may legislate by ordinance in case of a state of exception defined by article 93 of the Constitution.<br />The ordinances are taken in a meeting of the Cabinet.</p><p><b>Art. 125</b> - The President of the Republic exercises the powers pertaining to regulations for matters other than those intended to the law</p><p>The implementation of laws is the domain of the Head of Government.</p><p><b>Art. 126</b> - The law is promulgated by the President of the Republic within thirty (30) days from the date of handing it over.<br />However, when the Constitutional Council is called upon by one of the authorities mentioned in article 166 under-mentioned, before the promulgation of the law, this time limit is suspended until the Constitutional Council expresses its opinion in accordance with the conditions defined by article 167 under-mentioned.</p><p><b>Art. 127</b> - The President of the Republic may request a second reading of the voted law within thirty (30) days following its adoption.<br />In this case, the majority of two thirds (2/3) of the deputies of the People's National Assembly is required for the law to be adopted.</p><p><b>Art. 128</b> - The President of the Republic may address a message to the Parliament.</p><p><b>Art. 129</b> - The President of the People's National Assembly, the President of the Council of Nation, the Head of Government, referred to, the President of the Republic may decide the dissolution of the People's National Assembly or the organization of anticipated general elections.<br />In the two cases, general elections are held within a maximum time limit of three (03) months.</p><p><b>Art. 130</b> - The Parliament may open a debate on foreign policy upon a request made by the President of the Republic or one of the presidents of the two chambers.<br />The debate may end up, in that case, with a resolution, of the Parliament sitting in both chambers convened together, which will be sent to the President of the Republic.</p><p><b>Art. 131</b> - Armistice agreements, peace, alliance and union treaties, treaties related to State borders as well as treaties involving expenses not provided for in the State budget are ratified by the President of the Republic following an explicit approval by each of the chambers of the Parliament.</p><p><b>Art. 132</b> - Treaties ratified by the President of the Republic in accordance with the conditions provided for by the Constitution are superior to the law.</p><p><b>Art. 133</b> - Members of the parliament may call upon the Government on a topical issue.<br />The committees of the Parliament may hear the members of Government.</p><p><b>Art. 134</b> - Members of the Parliament may address orally or in a written form any question to any member of the Government.<br />Answers to written questions should be in written form within a maximum time limit of thirty (30) days.<br />Answers to oral questions are given in session.<br />If one of the two chambers considers that oral or written answers of a member of the Government justifies a debate, this latter is opened in accordance with the conditions provided for by the rules of procedure of People's National Assembly and the Council of Nation.<br />The questions and answers are published in accordance with the same conditions as those of the minute of proceedings of the Parliament’s debates.</p><p><b>Art. 135</b> - In debating the general policy declaration, the People's National Assembly may sue the Government's responsibility through voting a motion of censure.<br />Such a motion is admissible only if it was signed by, at least, one seventh (1/7) of the number of deputies.</p><p><b>Art. 136</b> - The motion of censure should be approved by the majority of two thirds (2/3) of the deputies.</p><p id="Text">The vote occurs only three days after the motion of censure is brought in.</p><p><b>Art. 137</b> - If the motion of censure is adopted by the People's National Assembly, the Head of Government submits the resignation of his Government to the President of the Republic. </p><p id="Titre2">Chapter III : The judicial power</p><p><b>Art. 138</b> - The judicial power is independent. It is exercised within the framework of the law.</p><p><b>Art. 139</b> - The judicial power protects the society and the liberties. It guarantees, to all and to everyone, the safeguard of their fundamental rights.</p><p><b>Art. 140</b> - Justice is founded on the principles of lawfulness and equality.<br />It is the same for all, accessible for all and is expressed by the respect of the law.</p><p><b>Art. 141</b> - Justice is dispensed on behalf of the people.</p><p><b>Art. 142</b> - Punishments should comply with the principles of lawfulness and individuality.</p><p><b>Art. 143</b> - Justice deals with appeals against and administrative authorities decisions.</p><p><b>Art. 144</b> - Justice decisions are justified and pronounced in public hearing.</p><p><b>Art. 145</b> - All the qualified State bodies should ensure, at any time, in any place and in any circumstances, the execution of justice decisions.</p><p><b>Art. 146</b> - Justice is pronounced by magistrates. They can be assisted by People's assessors in accordance with the conditions defined by the law.</p><p><b>Art. 147</b> - The judge obeys to the law only.</p><p><b>Art. 148</b> - The judge is protected against any form of pressure, interventions or manoeuvres which prejudice his mission or the respect of his free will.</p><p><b>Art. 149</b> - The magistrate is answerable before the High Council of Magistracy and within the forms prescribed by the law on the way he accomplishes his task.</p><p><b>Art. 150</b> - The law protects the justiciable against any abuse or deviation of the judge.</p><p><b>Art. 151</b> - The right for defense is recognized.<br />In penal matters, it is guaranteed.</p><p><b>Art. 152</b> - The High Court is the regulating body of the activities of the courts and tribunals.<br />A Council of State is instituted as a regulating body of activities of the administrative jurisdictions.<br />The High Court and the Council of State are responsible for the unification of jurisprudence throughout the country and see to the respect of the law.<br />A Tribunal of Conflicts is instituted to settle conflicts of competency between the High Court and the Council of state.</p><p><b>Art. 153</b> - The organization, the functioning and other attributions of the High Court, the Council of State and the Tribunals of Conflicts are defined by an organic law.</p><p><b>Art. 154</b> - The High Council of Magistracy is presided by the President of the Republic.</p><p><b>Art. 155</b> - The High Council of Magistracy decides, within the conditions defined by the law, the appointment, transfer and the progress of the magistrate’s careers.<br />It sees to the respect of the provisions provided for in the statute of the magistracy and of the control of discipline under the chairmanship of the First President of the High Court.</p><p><b>Art. 156</b> - The High Council of Magistracy gives a prior consultative opinion to the exercise of the right of free pardon by the President of the Republic.</p><p><b>Art. 157</b> - The composition, the functioning and the other prerogatives of the High Council of Magistracy are defined by an organic law.</p><p><b>Art. 158</b> - A High Court of State is instituted to deal with actions that can be qualified of high treason committed by the President of the Republic, with crimes and infringements committed by the Head of Government during their office.<br />The composition, the organization and the functioning of the High Court of State as well as the procedures of implementation are defined by an organic law.</p><table align="center"><tr><td id="Titre1">PART THREE<br />CONTROL AND CONSULTATIVE INSTITUTIONS</td></tr></table><p id="Titre2">Chapter I : Control</p><p><b>Art. 159</b> - The elected assemblies assume the function of control within its popular dimension.</p><p><b>Art. 160</b> - The Government presents to each chamber of the Parliament a report on the use of budgetary credits which it voted for each financial year.<br />The financial year is close as far as it concerns the Parliament by a vote, by each of the chambers, of the financial year in question.</p><p><b>Art. 161</b> - Each of the two chambers of the Parliament may, within the framework of its prerogatives, institute at any time committees investigating affairs of general interest.</p><p><b>Art. 162</b> - The control institutions and bodies are in charge of checking the conformity of the legislative and executive action with the Constitution and to verify the conditions of use and management of material means and public funds.</p><p><b>Art. 163</b> - A Constitutional Council is instituted to see to the respect of the Constitution.<br />The Constitutional Council sees also to the due form of referendum operations, the election of the President of the Republic and the general elections. It proclaims the results of these operations.</p><p><b>Art. 164</b> - The Constitutional Council is composed of nine (09) members: three (03) appointed by the President of the Republic among whom is the President, two (02) elected by the People's National Assembly, two (02) elected by the Council of Nation, one (01) elected by the Supreme court of Nation; one (01) elected by the Council of State.<br />Once elected or appointed, the members of the Constitutional Council cease any other mandate, function, responsibility or mission.<br />The President of the Republic appoints the President of the Constitutional Council for a single mandate of six (06) years.<br />The other members of the Constitutional Council fill a unique mandate of six (06) years and are renewed by half every three (03) years.</p><p><b>Art. 165</b> - In addition to the prerogatives explicitly bestowed upon it by other provisions of the Constitution, the Constitutional Council pronounces on the constitutionality of treaties, laws and regulations, either through an opinion if these are not enforced or, otherwise, through a decision.<br />The constitutional Council, called upon by the president of the Republic, expresses a compulsory opinion on the constitutionality of the organic laws following their adoption by the Parliament.<br />The Constitutional Council also pronounces on the conformity of the rules of procedures of each of the two chambers of the Parliament with the Constitution in accordance with the provisions of the above mentioned paragraph.</p><p><b>Art. 166</b> - The Constitutional Council is called upon by the President of the Republic, the President of the People's National Assembly or by the President of the Council of Nation.</p><p><b>Art. 167</b> - The Constitutional Council deliberates in camera; its opinion or its decisions are given within twenty (20) days following the date it was referred to.<br />The Constitutional Council defines the rules of its functioning.</p><p><b>Art. 168</b> - When the Constitutional Council considers that a treaty, an agreement or a convention is not constitutional, its ratification cannot take place.</p><p><b>Art. 169</b> - When the Constitutional Council considers that a legislative or regulatory provision is not constitutional, this latter looses its effect from the date the decision is taken by the Council.</p><p><b>Art. 170</b> - An Audit Office is instituted with the task of controlling a posteriori the finances of the State, the territorial collectivities and public services.<br />The Audit Office establishes a yearly report which is addressed to the President of the Republic.<br />The law defines the prerogatives, the organization and the functioning of the Audit Office as well as the sanctions of its investigations. </p><p id="Titre2">Chapter II : Consultative institutions</p><p><b>Art. 171</b> - A High Islamic Council is instituted to the President of the Republic and is trusted, in particular, with:<br />- Encouraging and promoting «Ijtihad»;<br />- Expressing its views in comparison with religious precepts on matters submitted to it;<br />- Presenting a periodic report of activity to the President of the Republic.</p><p><b>Art. 172</b> - The High Islamic Council is composed of fifteen (15) members, including a president appointed by the President of the Republic among national personalities highly qualified in various fields of science.</p><p><b>Art. 173</b> - A High Security Council presided by the President of the Republic is instituted. Its task is to express views on all the issues related to national security.<br />The President of the Republic defines the modes of organization and functioning of the High Security Council.</p><table align="center"><tr><td id="Titre1">PART FOUR<br />CONSTITUTIONAL REVISION</td></tr></table><p><b>Art. 174</b> - Constitutional revision is decided on the initiative of the President of the Republic. It is voted, in the same manner, in accordance with the same conditions applied to a legislative text by the People’s National Assembly and the council of Nation.<br />It is submitted to a referendum to be approved by the people within fifty (50) days following its adoption.<br />The Constitutional revision, approved by the people is promulgated by the President of the Republic.</p><p><b>Art. 175</b> - The law pertaining to the draft constitutional revision not approved by the people is void.<br />It cannot be submitted again to the people during the same legislature.</p><p><b>Art. 176</b> - When the Constitutional Council considers that the draft constitutional revision does not infringe, at all, upon the general principles governing the Algerian society, the human and citizen's rights and liberties, or does not affect, in any way, the fundamental balance of powers and of institutions, the President of the Republic may promulgate, directly, the law pertaining to constitutional revision without submitting it to people's referendum if it obtains the voices of three quarters (3/4) of the members of the two chambers of the Parliament.</p><p><b>Art. 177</b> - The three quarters (3/4) of the members of the two chambers of the Parliament meeting together can propose a constitutional revision and present it to the President of the Republic who can submit it to a referendum.<br />If approved, it is promulgated.</p><p><b>Art. 178</b> - Any constitutional revision cannot infringe on:<br />1 - the republican nature of the State;<br />2 - the democratic order based on multipartism;<br />3 - Islam as the religion of the State;<br />4 - Arabic as the national and official language;<br />5 - fundamental liberties, human and citizen's rights;<br />6 - integrity of the national territory.</p><table align="center"><tr><td id="Titre1">TRANSITIONAL PROVISIONS</td></tr></table><p><b>Art. 179</b> - The legislative body in office at the date of the promulgation of the present Constitution and up to the end of its mandate, the President of the Republic at the end of the legislative body's mandate and up to the election of the People's National Assembly, legislate through ordinances including the domains pertaining to organic laws.</p><p><b>Art. 180</b> - Awaiting the setting up of the institutions provided for in the present Constitution:<br />- the laws in force pertaining to the organic domain remain applicable up to their replacement or modification in accordance with the procedures provided for by the constitution;<br />- the constitutional Council, with its present representation, assumes the prerogatives bestowed upon it by the present Constitution up to the time of setting up institutions represented in its midst. Any modification or addition should be subject to article 164 (paragraph 3) of the present Constitution, resorting, if necessary, to drawing lots;<br />- the elected People's National Assembly will assume full legislative power until the Council of Nation is set up;<br />However the President of the republic may delay the promulgation of the laws adopted by the deputies until their adoption by the Council of Nation.</p><p><b>Art. 181</b> - The renewal of half (1/2) the members of the Council of Nation during the first mandate is carried out at the end of the third year by drawing lots. Members of the Council of Nation are replaced by drawing lots in the same conditions and following the same procedure of their election or appointment.<br />However, drawing lots does not concern the President of the Council of Nation who assumes the first mandate of six (06) years.</p><p><b>Art. 182</b> - The President of the Republic promulgates the constitutional revision text approved by the people and which will be carried out as the fundamental law of the Republic.</p><table cellspacing="0" cellpadding="0" width="100%" border="0"><tr><td id="Nt1"><b>NOTA</b> : Translation of the terms of the Oath provided for in article 76 of the Constitution:</td></tr><tr><td id="Nt2"><br />«In the Name of God the Merciful and the Compassionate.
